I have been a criminal defense attorney for my entire career, but there is a case out of Berkeley, California that is a real head scratcher. David Xu was the chief metallurgist for a company called Berkeley Engineering and Research (BEAR) and was caught on tape trying to poison a colleague. His actions are blamed for not only causing harm to Rong Yuan, but her parents. After spending only 10 days in jail, Alameda County prosecutors and a judge signed off on a probation deal in the case.

Xu was arrested back in 2019 after Yuan became suspicious that her illness (which she thought might be cancer) might be related to a water bottle that she used at work. When her parents used the bottle to cook, they also became ill. She set up a spy camera at work and caught David Xu tampering with the water bottle. It was tested and found to contain “extraordinarily high levels of cadmium, a poisonous heavy metal.”

That seems a pretty strong case for two counts of poisoning and an attempted murder prosecution. Yet, the prosecutors dropped the attempted murder charge and accepted a plea on the two poisoning counts. Then a probation officer recommended no jail time. The officer wrote that

“The defendant is highly educated and living at home with his wife and children. He is employed and earning a stable income. Although this matter represents the first and only offense, it was serious in nature and could have resulted in death or serious illness of the victims…. It is the hopes of this deputy that the defendant will take advantage of this second chance and can satisfactorily complete this probation.”

Even on the two poisoning counts, one would expect some jail time. This man hurt three people and could have killed a colleague. Yet, Alameda County DA Pamela Price signed off on letting Xu spend less than two weeks in jail for his crimes.

President Joe Biden campaigned in swing-state Wisconsin on Monday to sell his latest student loan bailout program, a multibillion-dollar election-year bribe that delivers a shaky middle finger to the Supreme Court. Not surprisingly, the Democrat’s friends in the accomplice media regurgitated White House talking points on Biden’s Plan B loan- and interest-forgiveness initiative without mentioning the cost to federal debt-burdened U.S. taxpayers. 

According to Wisconsin Public Radio

Under the proposal, debt would be canceled for people already eligible for certain federal student loan forgiveness programs. It would also cancel debt for anyone who began repaying their undergraduate loans more than 20 years ago, or graduate loans more than 25 years ago…

According to a press release, the plan would eliminate all accrued interest for 23 million people and cancel out debt for 4 million people.

The federally subsidized public radio outlet didn’t bother with details like the price tag to taxpayers. Neither did the Milwaukee Journal Sentinel in its promotional piece for Biden’s new bailout. At least The New York Times, while performing its role of Biden administration water carrier, acknowledged, “Officials did not say how much the new plan would cost in coming years, but critics have said it could increase inflation and add to the federal debt by billions of dollars.” 

How could it not? The New York Post estimated Biden’s latest bribe could rival his last failed student debt forgiveness program, a $400 billion-plus unconstitutional behemoth.  

Who is going to pay to shrink student loan debt for 23 million borrowers? The complete bailout of 4 million Americans? Debt buyouts of $5,000 or better for 10 million college loan debt holders (More than $50 billion on that account alone)? 

Taxpayers. Taxpayers with student loan debt. Taxpayers without student loan debt. Taxpayers of all kinds, particularly future taxpayers. Because unless Biden and Congress suddenly wake up and begin wholesale cutting government programs to deal with a $34.6 trillion U.S. debt — and rapidly rising — this borrower forgiveness plan will be borne by today’s consumers and future generations. 

“We’re giving people a chance to make it,” Biden told an assemblage of liberals gathered in a gymnasium at Madison Area Technical College in Wisconsin’s capital city. The Democrat will need to roll up huge vote totals again in the big-government city and left-heavy Dane County if he wants to win Wisconsin, a critical battleground he won by a razor-thin margin in 2020. 

“Today, too many Americans — especially young people — are saddled with unsustainable debts in exchange for college,” Biden said in a 15-minute mumbling speech as a historic solar eclipse darkened wide swaths of the nation’s skies. An ominous sign? 

‘Presidential Do-Over’

You didn’t need special glasses to see that Biden’s bailout, coming less than seven months before the presidential election, is designed to help bailout the octogenarian’s slumping poll numbers. The most recent RealClearPolitics average of polls shows Biden and former President Donald Trump in a dead heat nationally. But Trump leads Biden in six of the seven swing states, which have a significant say over who will occupy the White House next year, according to a Wall Street Journal poll. Biden leads only in Wisconsin, by 3 percentage points, according to the poll. Trump leads by as much as 8 points in North Carolina, and as few as 2 points in Michigan.  

“Biden wants to use your tax dollars to buy votes because more and more young people are supporting President Trump,” Republican National Committee Chairman Michael Whatley said in a statement. He called Biden’s trip to Wisconsin the Bankrupting American Tour. 

“Biden’s student loan bailout for the wealthy was already struck down by the Supreme Court and his policies are driving historic inflation,” Whatley added. 

Indeed. Biden’s previous $400 billion student debt bailout order aimed at 43 million borrowers was released in the summer of 2022, months before the midterm elections. The Supreme Court struck down his executive fiat, declaring it an unconstitutional overreach of the executive branch. Biden has since dabbled around the edges, waving his presidential pen to knock out smaller amounts of outstanding student loan payments. 

The Times called it a “presidential do-over.” That’s not a thing. At least it doesn’t appear to be a legal thing. 

Last month, Kansas led 11 states in a lawsuit against Biden’s so-called SAVE Plan, which has canceled loans for more than 150,000 borrowers, according to the White House. The states charge that the president has again overstepped his authority and defied the Supreme Court. 

The Job Creators Network Foundation sued the Biden administration over its debt cancellation initiative struck down by the high court. The lawsuit, filed in Texas federal court, blocked the bailout at the district level and halted the application process, “allowing the legal challenge to go to the Supreme Court,” according to the conservative advocacy organization. 

‘A Blank Check’

Elaine Parker, president of the Job Creators Network, said Biden’s latest bailout suffers from the same fundamental problems. It illegally bypasses Congress and does nothing to hold the nation’s colleges and universities accountable for making much of the existing mess through exorbitant higher education costs. 

“In fact, every time this administration forgives more loans, it’s a blank check to these universities telling them to keep raising their tuition like they have been and overcharging these students,” Parker told me Monday afternoon on “The Vicki McKenna Show.” 

Biden’s boss, President Barack Obama, drove the massive federal takeover of the student loan program that has proved so costly. Former U.S. Rep. John J. Faso laid out the Obama-inflicted wound in September 2022. The New York Republican noted that Obama promoted the federal takeover of student lending as part of the bill that brought us Obamacare — the Affordable Care Act — in 2010. Another example of why you don’t pull a Pelosi and pass a bill “so you can find out what’s in it.” 

“At that time, Obama proclaimed that by cutting out the ‘middleman’, taxpayers would save $68 billion. Banks would no longer underwrite student loans and the federal government would directly lend to students,” Faso wrote. Every one of Obama’s promises turned out to be untrue. The program didn’t save any money. Loan defaults increased. Colleges accelerated increases in tuitions and fees and student debt skyrocketed. Today’s student loan mess was caused largely by Obama’s failed program.”

As he pitched his new attempted end-around of the Supreme Court ruling, Biden surely hoped the student loan debt-laden “folks” in swing-state Wisconsin would repay his taxpayer-funded generosity with their votes in November. The White says the new program could take effect “early this fall,” or not long before the election, the New York Post reported. Impeccable timing. 

As Parker noted, Congress passed bipartisan legislation last year blocking Biden’s student loan bailouts by executive fiat. Biden vetoed it. She said other reforms are stuck in the Senate. 

“Senate Democrats do not want to take it up and discuss anything remotely close to solutions because they are in an election year and their goal is to buy these votes,” she said.

How vast was the Great COVID Cover-up? Well, my investigation has recently discovered government officials from 15 federal agencies knew in 2018 that the Wuhan Institute of Virology was trying to create a coronavirus like COVID-19.   These officials knew that the Chinese lab was proposing to create a COVID 19-like virus and not one of these officials revealed this scheme to the public. In fact, 15 agencies with knowledge of this project have continuously refused to release any information concerning this alarming and dangerous research.

Government officials representing at least 15 federal agencies were briefed on a project proposed by Peter Daszak’s EcoHealth Alliance and the Wuhan Institute of Virology.

This project, the DEFUSE project, proposed to insert a furin cleavage site into a coronavirus to create a novel chimeric virus that would have been shockingly similar to the COVID-19 virus. 

For years, I have been fighting to obtain records from dozens of federal agencies relating to the origins of COVID-19 and the DEFUSE project. Under duress, the administration finally released documents that show that the DEFUSE project was pitched to at least 15 agencies in January 2018.

What does this mean?

It means that at least 15 federal agencies knew from the beginning of the pandemic that EcoHealth Alliance and the Wuhan Institute of Virology were seeking federal funding in 2018 to create a virus genetically very similar if not identical to COVID-19. Disturbingly, not one of these 15 agencies spoke up to warn us that the Wuhan Institute of Virology had been pitching this research. Not one of these agencies warned anyone that this Chinese lab had already put together plans to create such a virus. Peter Daszak concealed this proposal. University of North Carolina scientist Ralph Baric, a named collaborator on the DEFUSE project, failed to reveal that the Wuhan Institute of Virology had already proposed to create a virus similar to COVID-19.

And now we know that 15 agencies heard the proposal and when each agency discovered that COVID-19 was strangely similar to DEFUSE’s proposed virus creation, not one agency head stepped forward to warn the public that the virus might be man-made and therefore already adapted to transmit freely among humans.

THE ARROGANCE OF ANTHONY FAUCI

Not surprising to some of us, Dr. Anthony Fauci’s National Institute of Allergy and Infectious Diseases (NIAID) was not only briefed on Wuhan’s desire to create this virus, NIAID was actually listed as a participant in the initial DEFUSE pitch. Fauci’s Rocky Mountain Lab was named as a partner alongside the Wuhan Institute of Virology in the proposal.

These documents also reveal that a scientist whose lab has received millions of dollars from EcoHealth was also part of the original plan to create these chimeric coronaviruses. This researcher, Ian Lipkin, also later became one of the authors of “Proximal Origins,” a journal paper commissioned by Fauci and National Institutes of Health head Francis Collins to throw shade on anyone arguing that the virus might have come from the lab. Yet, Ian Lipkin never revealed to the public the DEFUSE proposal.

Did NIAID warn us? Did Anthony Fauci warn us? No! All lips remained sealed. 

Millions of people died from COVID-19. We now know that over 15 government agencies, as well as the investigators Peter Daszak, Ralph Baric, Ian Lipkin and scientists at NIAID’s Rocky Mountain Lab, all knew of the Wuhan Institute of Virology’s desire to create a coronavirus with a furin cleavage site, a virus pre-adapted for human transmission. And no one spoke up. We only know of this DEFUSE proposal because a whistleblower, one brave Marine, Lt. Col. Joseph Murphy, came forward with the truth.

Likely, hundreds of people in the government knew of this proposal to create a COVID-19-like virus and virtually every one of these people chose to keep quiet, to obscure, and ultimately to conceal information that might have saved lives by letting the world know this was no sleepy animal virus with poor transmission. No, all evidence suggests COVID-19 was a laboratory-enhanced virus purposefully adapted for human transmission.

Shame on all those who covered up the DEFUSE project! Of course, they all should be punished but likely won’t. At the very least, though, the perpetrators should be made to admit the truth and Congress should finally put in place sufficient oversight to make sure dangerous gain of function experiments are sufficiently vetted and, if necessary, prevented.

Arizona Can Enforce an 1864 Law Criminalizing Nearly All Abortions, Court Says

The Arizona Supreme Court ruled Tuesday that the state can enforce its long-dormant law criminalizing all abortions except when a mother’s life is at stake.

The case examined whether the state is still subject to a law that predates Arizona’s statehood. The 1864 law provides no exceptions for rape or incest but allows abortions if a mother’s life is in danger. The state’s high court ruling reviewed a 2022 decision by the state Court of Appeals that said doctors couldn’t be charged for performing the procedure in the first 15 weeks of pregnancy.

An older court decision blocked enforcing the 1864 law shortly after the U.S. Supreme Court issued the 1973 Roe v. Wade decision guaranteeing a constitutional right to an abortion. After the U.S. Supreme Court overturned Roe v. Wade in June 2022, then state Attorney General Mark Brnovich, a Republican, persuaded a state judge in Tucson to lift the block on enforcing the 1864 law. Brnovich’s Democratic successor, Attorney General Kris Mayes, had urged the state’s high court to side with the Court of Appeals and hold the 1864 law in abeyance.

“Today’s decision to reimpose a law from a time when Arizona wasn’t a state, the Civil War was raging, and women couldn’t even vote will go down in history as a stain on our state,” Mayes said Tuesday.

The justices said the state can start enforcing the law in 14 days.

Defense Secretary Lloyd Austin said Tuesday there was no evidence Israel has committed genocide against Palestinians during the Hamas war in Gaza. Austin, appearing with Defense Comptroller Mike McCord and Joint Chiefs of Staff Chair Gen. CQ Brown, testified before the Senate Armed Services Committee to discuss the president’s 2025 budget request for the Pentagon.

Pro-Palestinian protesters interrupted Austin several times while the secretary was reading his opening statement. During questioning, Sen. Tom Cotton, R-Ark., asked Austin whether Israel is committing genocide in Gaza.

“We don’t have any evidence of genocide being [committed],” said Austin, before Cotton repeated his question.

“We don’t have evidence of that to my knowledge,” Austin replied.

Cotton commended Austin for his answer, saying he was “better than [CIA] Director [William] Burns and [National Intelligence] Director [Avril] Haines did … last month at the Intelligence Committee when they dodged that question.”

Cotton then said Austin has been accused of “greenlighting genocide” and asked the secretary whether he wanted to respond to such accusations.

“What I would say, Sen. Cotton, from the very beginning, we committed to help assist Israel in defending its territory and its people by providing security assistance,” Austin said, “and I would remind everybody that what happened on Oct. 7 was absolutely horrible.

“So you deny the accusation that you greenlit genocide,” Cotton asked.

“I absolutely deny it,” Austin said.

The Senate hearing was the first-time lawmakers on both sides were able to question the Pentagon’s top civilian and military leadership on the administration’s Israel strategy following Tel Aviv’s deadly strike on World Central Kitchen humanitarian aid workers in Gaza.

The World Central Kitchen strike led to a shift in tone from President Joe Biden on how Israel must protect civilian life in Gaza and drove dozens of House Democrats, including former House Speaker Nancy Pelosi, D-Calif., to call on Biden to halt weapons transfers to Israel.

Gun control activist David Hogg has been hit with allegations over the spending practices of his group Leaders We Deserve PAC. Conservative outlets are reporting that the group spent comparably little on actual candidates as opposed to travel and expenses. His prior counsel is a familiar name in such controversies in Washington: former Clinton campaign general counsel Marc Elias.

Hogg created a group in the aftermath of the 2022 midterm elections to elect Generation Z politicians to offices throughout the country. The group was given favorable national coverage in major media outlets. He explained that contributions would be used to elect young Democrat candidates:

“[We’re] trying to pick them and say, you know, we would like to help you run for office, we’ll supply you with all of the resources that you need and help basically coach you and hold your hand to get there, which is kind of the gap that’s in the space right now, for at least young people at the state legislative level.”

Federal filings reportedly show that year-end 2023, Leaders We Deserve raised over $3 million. That is impressive for its first year in operation.

The conservative sites allege that the group spent “only about $263,000 on its stated mission of electing candidates from Generation Z to office combined with donations to other Democrat Party committees and groups—and instead spent more than $1.4 million on disbursements to themselves for payroll and to political consulting firms and legal fees, in addition to travel and entertainment expenses like hotels, flights, and meals.” However, it reportedly spent more than $1,314,000 on travel and related expenses while giving $80,000 to the Elias Law Group.

Previously, when allegations of self-dealing and accounting improprieties were raised with regard to Black Lives Matter, the group’s attorney, Elias, immediately stood out for many. Elias resigned from his “key role” with BLM as the scandal exploded.

Elias’s name has now again popped up in the controversy involving Hogg, who is accused of raising millions to support liberal candidates but allegedly spending only $263,000 on such candidates while paying $83,000 to the Elias law firm. (These figures are reportedly from federal filings but neither Elias nor Hogg have specifically addressed the media reports).

Elias has long been a controversial figure, including being sanctioned in court. He was named as the key figure in hiding the funding of the Steele dossier by the Clinton campaign, which led later to a FEC fine. Reporters accused the campaign of lying to them about the funding. Elias was also reportedly with campaign chair John Podesta when he allegedly denied such funding to congressional investigators.

Despite accusing the GOP of election denial and manipulation, Elias was also involved in alleged gerrymandering efforts and challenging the outcome of elections based on alleged problems with voting machine tallies.

Back to the most recent controversy, Hogg could argue that, as a well-known activist figure, his travel to these campaigns is the boost that the group promised donors. He is the assistance. Likewise, the group could argue that it is still getting ramped up for greater spending efforts in the fall. As for the legal fees, the group could argue that start up legal fees and reporting fees tend to be higher at the outset.

The controversy does raise some novel questions about the purpose of contributions. Hogg coming to a local campaign is likely to generate media attention for a candidate. He can also claim that he and his staff bring needed expertise and advice to novice or young candidates. That could be their interpretation of the promise to “basically coach you and hold your hand to get there.” Critics are focused on the pitch to “supply you with all of the resources that you need.”

The group is only the latest political or business effort launched by Hogg, who previously tried to start a “progressive pillow company” before stepping away from the enterprise.

For years, we have discussed the failure of universities to take actions against faculty and students shutting down events or acting unlawfully, including faculty guilty of criminal assault. Now, Vanderbilt has expelled three students after anti-Israel protests, including Jack Petocz, a political activist recognized by the White House and featured prominently in the New York Times and other news outlets.

According to the Vanderbilt Hustler and The College Fix, the students were arrested for allegedly assaulting a security guard amid raucous anti-Israel protests inside an Administration building late last month.

Petocz posted a denial on X:

“I did not touch a community service officer, nor am I anywhere near the individual in the video. I’d implore you to trust a student activist over rich, powerful, white men, but that’s your choice.”

He insisted that he and the other students were only “peacefully protesting the genocide in Palestine.”

Petocz’s activism, including opposing the Florida parental rights law, has been widely celebrated in the media including an article that featured him in a January 2022 front story on fighting conservative school boards. President Biden invited him to the White House for a bill signing and took a picture with him in the Oval Office.

It appears that universities are growing impatient with protesters, particularly after a series of sit-ins. Recently, students were suspended for storming the office of Pomona College President Gabrielle Starr. Nineteen students were reportedly arrested.

Starr claimed in an open letter that racial slurs were used by students and declared:

“These actions are actively destructive of the values that underpin our community. Any participants in today’s events … who turn out to be Pomona students, are subject to immediate suspension. Students from the other Claremont Colleges will be banned from Pomona’s campus and subject to discipline on their own campuses.”

The actions of the university have led to protests on campus and calls for the student board to reverse that suspensions.

PBS has a new documentary on the late William F. Buckley Jr., “The Incomparable Mr. Buckley,” airing on stations across the country. From 1966 to 1999, his show, “Firing Line,” which debated the great issues of the time, was a staple on PBS stations nationwide.

As the documentary highlights, one of the most important things that made “Bill,” as he was known to his friends, so incomparable, was his strong and unwavering faith. It was that faith that enabled him to speak boldly, unapologetically, and ultimately prophetically, about the issues of his time.

In 1997, he would tell Michael Cromartie of the Ethics and Public Policy Center, “I like to think that Christianity is universally informative. Whatever you do, there is always something there that consoles, guides, or inhibits.” For Bill, his faith was his guiding star, which influenced his worldview and his relationships — treating those with whom he disagreed with dignity and respect. As a result, he was able to build bridges with others rather than burn them.

It was also that faith that led him to write his seminal work God and Man at Yale in 1951. In it, he first warned about the abandonment of the Judeo-Christian heritage in academia and how it would lead to the present national morass in which we find ourselves.

Bill was a devoted Catholic who believed faith was the foundation of higher education at Yale and in our nation. He saw it coming under increasing attack and felt strongly that he had to sound the alarm about what was not only happening at Yale but beginning to seep out into the hallowed halls of higher education across America — the rejection and replacement of those ideals with secularism, socialism, and government dependence.

In God and Man at Yale, Bill peeled back the layers of the onion at Yale University and exposed its leftist core. As Richard Brookhiser wrote, “Yale in 1951 still pretended to be a bastion of capitalism and Christianity; Bill told the world this was a con, to keep alums sending their sons and their money to New Haven.”

Frayed National Fabric

He also saw that with the left there was no room for debate. As he put it, “Though liberals do a great deal of talking about hearing other points of view, it sometimes shocks them to learn that there are other points of view.” Those words turned out to be prophetic as we face the “cancel culture” of the 21st century.

Bill knew in his heart that it is religious faith that brings people together — regardless of political persuasion — and provides hope and healing. As that faith came under assault, was scorned, and was eventually attacked, our national fabric frayed with it. Our current poisonous political and cultural climate is the result.

Unfortunately, when God and Man at Yale was written, much of America remained blissfully ignorant of what was happening to their children as they entered the ivory towers of American academia. Once the 1960s arrived, they could be ignorant no more.

For instance, Yale alumni and administrators did not take kindly to Bill shedding light on what was going on. McGeorge Bundy, a Yale alumni, writing in The Atlantic Monthly, said: “God and Man at Yale has the somewhat larger significance that it is clearly an attempt to start an assault on the freedom of one of America’s greatest and most conservative universities. … Certainly it will put the Yale authorities to an absurd amount of trouble in making answers to questions based on a set of charges that ought to be beneath contempt.”

But Bill was right, and Bundy and others were wrong. The campus protests and the emergence of the radical left in academia, and then into all other aspects of society, all of which Bill warned about in the early 1950s, transformed American society from one that saw faith as a virtue into one that saw it as a vice.

Brookhiser concluded, “God and Man at Yale is a standing invitation to get under the skin, and an example of how a bright kid once did it.” Evidently, Buckley’s words got under the skin of Mr. Bundy and others who thought Yale was still conservative and great. But that is what happens when one speaks truth in power — something Bill did repeatedly.

Bill’s Legacy

Bill Buckley’s faith, and the words that came directly from it, is his true legacy. Because of Bill’s strong Catholic faith, God was able to use him as an instrument to prophetically raise the alarm about what happens to a society when it abandons faith.

“Man is a sinner. Man can repent. God will forgive. That is so very different from the fashionable secular complement, which is: What is sin?” Buckley wrote in 1987.

It was Bill’s faith that led him to live a remarkably successful, “incomparable” life. Any documentary on his life will miss the mark if it does not focus on this most essential part of his life and legacy, because ultimately it is learning about Bill’s faith and how it shaped him that will fully inform the viewer about the man who was William F. Buckley Jr.

Former President Donald Trump has a slight lead over or is tied with President Joe Biden in seven swing states, according to polling by the Wall Street Journal released last week. Trump’s lead in six of the seven competitive states varies, from six percentage points ahead in North Carolina to just one percentage point in Georgia, among surveyed respondents asked whom they’d support in a match-up between the two. Biden is tied with Trump in Wisconsin with 46 percent support each.

It’s no secret the Biden administration has “reimagined” the U.S. military into a left-wing social experiment. From employing enlisted drag queens to boost recruitment to using taxpayer funds to host LGBT “pride” events on military installations, America’s supreme fighting force has prioritized promoting diversity, equity, and inclusion (DEI) racism over addressing the biggest challenges hampering U.S. military readiness.

A recently released book unveils how this leftist ideology is also infecting the military’s service academies. In Saving Our Service Academies: My Battle with, and for, the US Naval Academy to Make Thinking Officers, author and professor Bruce Fleming documents the pervasiveness of DEI throughout the U.S. Naval Academy (USNA) and shows how the institution’s cookie-cutter bureaucracy is crippling individuality among the school’s midshipmen.

During his over 30-year teaching career at the institution, Fleming served (for a time) on the USNA Admissions Board, which evaluates applicants and decides which are ultimately admitted into the school. While on the board, he allegedly discovered that — like many civilian colleges — the academy considers applicants’ race throughout the admissions process and accepts nonwhite applicants who don’t meet the school’s academic requirements. Fleming claims that “[a]pplicants who self-identified as a member of a race the Academy wished to privilege … were briefed separately to the committee not by a white member but by a minority Navy lieutenant.”

“The choices are simple. If you want students who look a certain way but tend to score lower than others, you accept the lower scores and stop talking about your standards. Or you go with the class that can meet these standards and stop talking about the way they look,” Fleming writes. “The Naval Academy tries to square the circle by both bragging about its standards and letting in half the class to lower standards.”

Last year, the U.S. Supreme Court ruled in a 6-3 decision that the use of race-based admissions, or “affirmative action,” by institutions of higher education is unconstitutional. That decision did not, however, address the use of such policies by U.S. military academies. Students for Fair Admissions — the plaintiff in the aforementioned SCOTUS decision — filed lawsuits against West Point and the Naval Academy over their race-based admissions policies in September and October, respectively.

Throughout his book, Fleming further notes that the USNA’s obsession with race is creating “resentment within the ranks,” and that students who speak out against the school’s DEI-focused promotion system are punished.

“What I saw at Annapolis was that nonracist white midshipmen became resentful at realizing that leadership positions were awarded to less competent midshipmen on the basis of skin color, and that they themselves, if they noted this out loud, were punished for not being with the program — which increased their resentment,” Fleming writes. “All promotions or preferences are individual ones, and ‘broadly reflective diversity’ is bought at the individual level by preferring a less competent individual with the desired skin color. If they are equally competent or more competent, the problem disappears.”

“The military shows all the problems of any top-down totalitarian state, and its members can be court-martialed for resisting,” he adds.

Throughout his career at the academy, Fleming regularly questioned the decision-making from the school’s leadership and penned several op-eds criticizing what he viewed to be its shortcomings. In 2017, for example, he wrote an article in The Federalist detailing how “upper-class students at service academies have lost faith in the system, because it’s based on lies.” Fleming said that “students realize they are cast members in a military Disneyland run for the benefit of the brass and the tourists, not the taxpayers who pay their way and want better-than-average officers.”

Fleming’s public criticisms generated ire from the academy’s bureaucratic leadership. In 2018, the school fired him over allegations of classroom impropriety filed by five students. Fleming profusely denied the accusations and appealed the decision to the U.S. Merit Systems Protection Board, which ordered his reinstatement to the academy in July 2019.

According to the Navy Times, Judge Mark Syska said in his ruling that the midshipman who “filed the longest complaint” had “credibility issues” and that his complaint was “greatly exaggerated — to the point of being hard to credit on certain points.” Syska additionally highlighted that the students who filed the complaints “did not generally take offense or have any actual issue with the appellant.”

“Moreover, much of the charged conduct, as noted by the investigating panel, did not appear to be actual misconduct in the context of free-wheeling classroom discussions,” Syska wrote.

While ultimately reinstated by the academy, Fleming has not been permitted to return to the classroom. The school has placed him on a “forced sabbatical,” according to the “Eyes on Annapolis” podcast, which interviewed Fleming in February.

In concluding his book, Fleming calls on military institutions such as the USNA and West Point to “[d]ial back the hype” and “stop lying about what [they] are.” Specifically, he demands these academies quit pushing mistruths about their selectivity and “quality of the students” to uphold the facade that they’re legacy institutions worthy of praise and adoration.

Our service academies are “beautiful places and, under these circumstances, duty, honor, and country could once again be primary. Sadly, in places like Annapolis as they currently exist, they no longer are,” Fleming writes. “I want them back.”

During a recent segment on “Saturday Night Live,” Michael Che joked President Joe Biden, like the Baltimore bridge that collapsed, “is no longer connecting with black communities.” But for the Biden campaign, it’s not funny. In fact, the president’s low approval ratings and apparent inability to inspire enthusiasm among black voters could mean a repeat of 2016 for Democrats, if the enthusiasm gap is wide enough to outweigh Democrats’ ballot trafficking operations.

A poll surveying Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania, and Wisconsin conducted by the Wall Street Journal found that Biden is winning about 68 percent of black voters in those swing states — a low number, by historical comparison. During the 2020 election, Biden received 91 percent of the black vote nationwide, according to the WSJ.

The WSJ poll, which was conducted March 17-24 and included 600 voters in each state, isn’t the first to suggest black voters may be growing dissatisfied with the Biden administration. In November, a New York Times and Siena College poll found 22 percent of black voters in six key swing states would choose Trump over Biden. A December poll from the University of Chicago found 63 percent of black Americans would vote for Biden while 20 percent said they would vote for “someone else” besides Trump or Biden. Seventeen percent said they would choose Trump.

An NBC News poll also found that while black voters may still overwhelmingly favor Biden when compared to Trump, “the margin shrank” when it came to those under the age of 34. Biden’s support went from 73 percent among black voters of all ages to 60 percent amongst those under 34. Meanwhile, Trump went from 17 percent to 28 percent respectively, according to the poll. The demographic is key for Biden, who won “89% of Black voters under 29 and 78% of those 30 to 44,” according to the poll.

‘Overall Lack of Enthusiasm’

“It doesn’t seem like any choice is really a good choice at all,” 30-year-old Detroit native Kaja Braziel told NPR. Braziel, who voted for former President Barack Obama, said she’s upset Biden “hasn’t done more” to pay for her student loans and is not sure she will even head to the polls come November.

“It feels more so like you’re caught between the devil you know and the devil you don’t. And at this point in time, it feels like both the devils that we know. And I’m not comfortable with either of them,” Braziel said.

Ka’Marr Coleman-Byrd, 27, is a tax consultant who voted for Biden in 2020 but said as of now he has not made up his mind about the 2024 election.

“Growing up, I feel like I voted Democrat just because it just seemed like the thing to do,” Coleman-Byrd told NPR. “I’d say now … I’m sort of more into politics and seeing exactly what both parties present, so it’s not just like a blind vote in a sense.”

Then there is 31-year-old CJ Sampson, who told NPR that while he considers himself to be liberal, Biden does not inspire confidence. He said when comparing whether life was better under Trump or Biden, “it’s kind of a mixture of both.”

Team Trump appears eager to capitalize on the shift among voters. Trump received 6 percent of the black vote in 2016 and 8 percent in 2020, according to a Pew Research analysis. Now the former president is encouraging Republicans in key states like Michigan to reach out to black voters in Detroit and other areas, in the hopes of drawing them away from Biden, according to The Associated Press.

“This is part of Donald Trump’s path to victory,” CEO of Democrat firm HIT Strategies Terrance Woodbury told The Washington Post. “There’s about 32 percent of the Black electorate that’s just cynical, frustrated, closest to the pain, and that voter doesn’t like Democrats or Republicans. They feel like they’ve been failed by both sides and they’ve been failed by a system. And that’s a part of Donald Trump’s ‘the system is broken’ message that appeals to them.”

For Trump, the goal isn’t about “winning” the black vote so much as it is chipping away at Biden’s base.

“Nobody thinks we are going to win the Black vote,” an anonymous Trump adviser told the Post. “But if you get 10 percent or more, the election is over.”

Democrat strategist Doug Schoen contends that “overall lack of enthusiasm” is the biggest issue for Biden.

“I tend to think that black voters will probably come back to Biden in bigger numbers than they are now but that there’s an enthusiasm gap and turnout will be an issue for Biden,” Schoen told The Federalist.

Biden does not have much leeway. In 2020, he won states like Georgia and Arizona by less than 15,000 votes. Voters who decide to choose Trump over Biden — or even the couch over Biden — present a roadblock to the incumbent.

A 2016 Repeat?

If enough voters choose to stay home, Biden could run into the same problem Hillary Clinton did in 2016 when she lost by thin margins after millions of voters either sat the race out or voted for her opponent.

The Washington Post reviewed data from 33 states and Washington D.C. and found at least 1.75 million people who went to the polls in 2016 did not vote for a presidential candidate.

A separate review from Pew Research found that out of the “tens of millions of registered voters” who did not vote at all in 2016, 25 percent said their “dislike” of the candidate drove their decision. When broken down by race, 19 percent of black voters who did not vote cited issues with the candidates.

Clinton’s team misjudged their chances in Wisconsin, for example, where the NYT noted “Clinton had assumed she would win.” Trump ended up winning the state, which saw its lowest voter turnout in 16 years, by just 27,000 votes. (Trump lost the state in 2020 by less than 21,000 votes.)

Wisconsin’s District 15, which was 84 percent black during the 2016 election, saw the state’s biggest turnout decline in 2016 compared to 2012, according to the NYT. Several voters told the Times they were upset about the candidate choices — a common sentiment heard this go-around as well.

Since 2016, of course, Democrats have come a long way in institutionalizing their ballot trafficking operations, which make voter enthusiasm less of a gold standard. Even if enthusiasm for Biden remains dismal, Democrats will do their best to counteract it by harvesting ballots for voters who aren’t motivated enough to get themselves to the polls.

Biden Courts Anti-Israel Radicals

As Biden faces polling drops among black voters, he is also struggling among anti-Israel radicals. In Michigan’s majority-Arab Dearborn, “uncommitted” beat Biden during the state’s presidential primary. Statewide, more than 100,000 voters chose “uncommitted” in the primary, according to the NYT.

Schoen told The Federalist that Biden appears more concerned about losing the progressive wing of his party rather than black voters.

“I think Biden’s worried about progressives,” he said. “He’s worried about the left undermining him, he’s worried about Arab-Americans in states like Michigan and that I think explains in large part his movement … to a policy now that is going to condition military aid for Israel.”

“I’m more confident that black voters will come home [in November] than progressives and I think that’s what Biden thinks as well,” Schoen added. But will taking black voters for granted only give them more reason to be disillusioned with Biden?

Democrats in general seem less enthusiastic about Biden than they were in 2020. A Gallup poll found 42 percent of Democrats say they are less enthusiastic about voting than normal compared to 35 percent of Republicans. A USA Today/Suffolk University poll released in January found 44 percent of Trump supporters scored their enthusiasm for Trump as a 10. Just 18 percent of Biden supporters said the same for the Democrat president.

It’s little wonder Democrats have tried to keep the election from being a referendum on the unpopular incumbent president. The campaign strategy appears to be fearmongering about “threats to democracy” and waging lawfare against Trump, instead of touting Biden’s uninspiring record.

Schoen said Biden needs to address Americans’ concerns about illegal immigration and inflation. Asked whether Biden’s messaging about alleged “threats to democracy” would increase voter turnout and appeal to dissatisfied voters, Schoen told The Federalist: “You can’t eat ‘threat to democracy.’”

Senate Republicans who said they intend to vote against a trial on the impeachment of Homeland Security Secretary Alejandro Mayorkas will be targeted by Heritage Action, the conservative advocacy group told the Washington Examiner on Monday.

The group, the sister organization of the Washington-based Heritage Foundation, said it will unleash a campaign to ensure that the Mayorkas trial proceeds this week.

“The border crisis, which was created and facilitated by this administration, is now the No. 1 concern of Americans,” Heritage Action Executive Vice President Ryan Walker said. “Lawmakers who claim that impeaching Secretary Mayorkas is a waste of time or the Senate is too busy to hold a trial are not only absurd, they’re massively out of touch with the voters who sent them to Washington.”

Heritage Action said it will declare any procedural motion that Senate Majority Leader Chuck Schumer puts on the floor a “key vote” and that any Republican who votes with the Democrats will be put on blast, including in messaging to the organization’s 2 million grassroots supporters.

The vote to table the trial only requires a simple majority and has a one-vote threshold, making it critical that Republicans stay in line.

“Anyone who does Schumer’s bidding and votes to dismiss or table will be complicit in his cover-up and the border crisis itself,” Walker said. “Senators who would rather focus on the terrible bills Schumer has put forward instead of holding a trial for Mayorkas cannot be trusted by conservatives. Heritage Action stands with Americans demanding accountability and will key vote any procedural move put forth to sweep the charges against Mayorkas under the rug.”

House managers are set to deliver the two articles of impeachment to the Senate on Wednesday, almost two months after Mayorkas was impeached on charges of refusing to enforce the law and a breach of public trust.

That day Mayorkas is also scheduled to appear on Capitol Hill for a two congressional hearings connected to his department’s budget.

Impeachment proceedings are set to start in the Senate on Thursday.

The Vatican on Monday issued a declaration, “Dignitas Infinita,” on human dignity, warning that the practice of surrogacytransgender surgeries, and gender theory are contrary to human dignity.

“In the face of so many violations of human dignity that seriously threaten the future of the human family, the Church encourages the promotion of the dignity of every human person, regardless of their physical, mental, cultural, social, and religious characteristics,” the document says. “The Church does this with hope, confident of the power that flows from the Risen Christ, who has fully revealed the integral dignity of every man and woman.”

The name of the document translates to “Infinite Dignity,” and it’s a five-year-long product of the Dicastery for the Doctrine of the Faith that reaffirms Catholic Church teaching on the topics. It addresses a number of weighty topics that have entered the political sphere, including surrogacy.

“The Church also takes a stand against the practice of surrogacy, through which the immensely worthy child becomes a mere object,” the document states.

“First and foremost, the practice of surrogacy violates the dignity of the child,” it continues. “Indeed, every child possesses an intangible dignity that is clearly expressed—albeit in a unique and differentiated way—at every stage of his or her life: from the moment of conception, at birth, growing up as a boy or girl, and becoming an adult.

“Because of this unalienable dignity, the child has the right to have a fully human (and not artificially induced) origin and to receive the gift of a life that manifests both the dignity of the giver and that of the receiver,” the document adds.

It also addresses “critical issues present in gender theory,” warning that “it intends to deny the greatest possible difference that exists between living beings: sexual difference.”

“This foundational difference is not only the greatest imaginable difference, but is also the most beautiful and most powerful of them,” the Vatican document says. “In the male-female couple, this difference achieves the most marvelous of reciprocities. It thus becomes the source of that miracle that never ceases to surprise us: the arrival of new human beings in the world.”

As for attempted sex-change operations, “Dignitas Infinita” emphasizes that the “dignity of the body cannot be considered inferior to that of the person as such.” It quotes the Catechism of the Catholic Church, which states that “the human body shares in the dignity of ‘the image of God.’”

“Any sex-change intervention, as a rule, risks threatening the unique dignity the person has received from the moment of conception,” the document states. “This is not to exclude the possibility that a person with genital abnormalities that are already evident at birth or that develop later may choose to receive the assistance of health care professionals to resolve these abnormalities. However, in this case, such a medical procedure would not constitute a sex change in the sense intended here.”

Below is my column in The Hill on the recent disruptions of events featuring leading Democrats from President Joe Biden to Rep. Jamie Raskin. After years of supporting the censoring and blacklisting of others, these politicians are now being targeted by the very anti-free speech movement that they once fostered. Hillary Clinton last week became the latest Democrat targeted by protesters in a visit to her alma mater, Wellesley College.

You are “killing people,” President Biden told social media companies a couple of years ago. He sought to shame executives into censoring more Americans. Biden has lashed out at disinformation by anti-vaxxers, “election deniers” and others. This month, those words were thrown back at Biden himself as a “genocide denier” by protesters who have labeled him “Genocide Joe” over his support for Israel.

After years of supporting censorship and blacklisting of people with opposing views, politicians and academics are finding themselves the subjects of the very anti-free speech tactics that they helped foster.

Rep. Jamie Raskin (D-Md.), for example, has been a leading figure in Congress opposing efforts to curtail massive censorship programs coordinated by the Biden administration. While opposing the investigation into past federal censorship efforts, Raskin continues to push social media companies to increase the censorship and silencing of Americans. Last December, Raskin sent a letter on behalf of other Democrats on the powerful House Oversight Committee demanding even more censorship, not only on election fraud, COVID or climate change, but also on abortion.

“We are troubled by the rapid spread of abortion misinformation and disinformation on your company’s social media platform,” he wrote, “and the threat this development poses to safe abortion access in the United States.”

When journalists and even other members testified in favor of free speech, Democrats attacked them as “Putin lovers” and fellow travelers supporting “insurrectionists.” Last week, however, the left turned on Raskin. He was giving a lecture titled “Democracy, Autocracy and the Threat to Reason in the 21st Century.” According to the Maryland Reporterthe protesters accused Raskin of being “complicit in genocide.” After efforts to resume his remarks, University of Maryland President Darryll Pines finally ended the event early.

Pines then pulled a Raskin. While mildly criticizing the students for their lack of “civility,” he defended their disruption of Raskin’s remarks as if a heckler’s veto were free speech. “What you saw play out actually was democracy and free speech and academic freedom,” he said. “From our perspective as a university, these are the difficult conversations that we should be having.”

There was, of course, no real conversation because this was not the exercise but the denial of free speech. The protesters were engaging in “deplatforming,” which is common on our campuses, where students and faculty organize to prevent others from hearing opposing views.

So, after years of Raskin encouraging the censorship of others, the mob finally came for him. The yawning response of the university was not unlike his own past response to journalists, professors and dissents who have come before his committee.

The only “difficult” aspect of this conversation is for university figures like Pines who are called upon to defend the free speech rights of speakers or faculty. They need to show the courage and principle required to uphold the free speech commitment of higher education, even at the risk of being targeted themselves. That includes the sanctioning of students who prevent others from hearing opposing views in classrooms and event forums. These students have every right to protest outside such spaces, but higher education is premised on the free exchange of ideas. There is really no further “conversation” needed, just a letter of suspension or expulsion for those who deprive others of their rights.

Deplatforming is the rage on our campuses. Universities often use it to cancel events for conservatives or controversial speakers. Often officials will sit idly by, refusing to remove protesters or deter disruptions. And that can lead to self-help measures by others.

Last week, Walter Isaacson, former CEO of CNN and the Aspen Institute, was accused of assaulting a Tulane student protester, Rory MacDonald, during an event held off campus. Isaacson, 72, who teaches at Tulane, was attending the university-sponsored event and had had enough when MacDonald became the eighth protester to stop the event. He stood up and shoved MacDonald into the hall.

MacDonald insisted that he and his fellow protesters were merely “peacefully interrupting” the event to stop others from speaking. He displayed slight scratch marks and is quoted as expressing a fear of returning to campus after the incident. Protests have been held on campus to have Isaacson fired.

I have long criticized the growing anti-free speech movement in higher education. Yet these students have been taught for years that “speech is violence” and harmful. They have also been told by figures such as Pines that silencing others is an act of free speech. Academics and deans have said that there is no free speech protection for offensive or “disingenuous” speech. In one instance, former CUNY Law Dean Mary Lu Bilek insisted that disrupting a speech on free speech is itself free speech.

Even schools that purportedly forbid such interruptions rarely punish students who engage in them. For example, students disrupted a Northwestern class due to a guest speaker from Immigration and Customs Enforcement (after the class had heard from an undocumented immigrant). The university let the protesters into the room after they promised not to disrupt the class. They proceeded to stop the class and then gave interviews to the media proudly disclosing their names and celebrating the cancellation. Northwestern did nothing beyond express “disappointment.”

At Stanford, law students prevented a federal judge from speaking. When the judge asked for law school officials present to intervene, former Stanford DEI Dean Tirien Steinbach stepped forward and attacked the conservative judge for triggering the students by sharing his views. After a national outcry, Stanford President Marc Tessier-Lavigne and Law School Dean Jenny Martinez issued a joint apology that notably did not include punishment for a single student.

These schools are enablers of the anti-free speech movement as much as figures like Raskin.

For years, academics supported such mobs or remained silent as their colleagues were cancelled or fired. Now they are suddenly discovering the value of free speech as the mob comes for them.

Censorship and blacklisting create an insatiable appetite. While Democrats fostered such efforts to silence conservatives and dissenters on vaccines, climate change, abortion, transgenderism and other issues, they now find themselves pursued by the very mobs that they once led. Just two years ago, Biden was celebrated for denouncing social media executives as “killers” for allowing free speech. Now he, Raskin, and others are accused of killing others with “Zionist disinformation.”

It is an epiphany that often comes too late. During the French Revolution, journalist Jacques Mallet du Pan remarked that “like Saturn, the Revolution devours its children.”

Below is my column in the New York Post on the recent rebuke of the Justice Department by a federal judge in a hearing on the refusal to comply with House subpoenas in the Biden corruption investigation. The Justice Department appears little concerned over the glaring disconnect in how it treats its own attorneys as opposed to other citizens — a pattern that we have discussed previously.

Here is the column:

“Are you kidding me?”

Those are four words that no lawyer wants to hear from a judge in a hearing. But that was not the least of it for Justice Department lawyers fighting House subpoenas into the Biden corruption scandal.

U.S. District Court Judge Ana Reyes slammed the DOJ for stonewalling Congress on the subpoenas while imprisoning figures like former Trump adviser Peter Navarro for doing the same thing. The Biden Administration has blocked the testimony of prosecutors Mark Daly and Jack Morgan, who were involved in an inexplicable decision of the Justice Department to allow major felonies against Hunter Biden to lapse.

In prior hearings, IRS whistleblowers testified that they had an agreement on the table to extend the statute of limitations on the crimes, but Special Counsel David Weiss allowed the period to lapse without any explanation. Since the DOJ was in the midst of a plea negotiations, it made no sense that the DOJ would simply kill potential charges.

The handling of the Hunter Biden investigation has been widely criticized as affording special treatment to the President’s son, including scuttling searches of Biden property and giving Hunter a heads up before attempts to interview him.

Ultimately, the DOJ cut a plea bargain with Hunter that many of us rejected as laughable. It not only failed to charge the full array of still viable criminal allegations (including being an unregistered foreign agent) but included an absurd immunity agreement that would bar future charges. The plea agreement fell apart in open court after the judge asked the lead prosecutor a simple question of whether in his long career, he had ever seen such an immunity deal. He answered no.

Yet even after that meltdown, the DOJ admits that it tried to restore most of the agreement, but Hunter Biden’s team was insistent that the original deal remained enforceable — a position repeatedly rejected by later courts.

The DOJ was in a bizarre position. Its effort to give Hunter a sweetheart deal — or at least most of the original deal — could not occur because the beneficiary wanted it all. It had little choice but to charge him with the tax and gun crimes.

The House is in the midst of an impeachment inquiry that includes allegations of influence over the Hunter investigation. While insisting that there was no pressure or special dealing in the matter, the DOJ has blocked key sources of evidence. That led to the House subpoenas.

I also have previously written on the sharp contrast between the Hunter Biden charges and those against Sen. Menendez despite the underlying similarities.

The only way for the House to investigate such corrupt special dealings is to interview the principle actors, including these two attorneys. Otherwise, as Democratic members have done, critics can insist that they have no direct evidence of wrongdoing.

It appears that confusion expressed by many of us is shared by Judge Reyes. Judge Reyes noted the obvious: “There’s a person in jail right now because you all brought a criminal lawsuit against him because he did not appear for a House subpoena.” The DOJ demanded six months in prison. Navarro is now serving a four-month sentence.

Former Trump adviser Steve Bannon also received a four-month sentence.

Reyes noted that “I think it’s quite rich you guys pursue criminal investigations and put people in jail for not showing up . . . And now you guys are flouting those subpoenas. . . . And you don’t have to show up?”

Reyes noted that the DOJ lawyers were “making a bunch of arguments that you would never accept from any other litigant . . . I imagine that there are hundreds, if not thousands of defense attorneys . . . who would be happy to hear that DOJ’s position is, if you don’t agree with a subpoena, if you believe it’s unconstitutional or unlawful, you can unilaterally not show up.”

The Justice Department insisted that it is different when its own prosecutors refuse to testify and noted that the House had also refused to a demand to have other Justice Department lawyers present for the depositions. They then stressed that the decision to defy the subpoena came after lengthy deliberations “at a high level.”

Reyes then asked if the DOJ would drop its opposition if it were allowed to have DOJ lawyers in the room for the questioning. When the lawyers said that they could not answer that question at this time, Reyes exclaimed, “Are you kidding me?”

The answer is that they really are not kidding about any of this stuff. The Justice Department continues to act with utter impunity in these cases. It abandoned consistency years ago with any semblance of restraint.

After being strung up on charges by President Joe Biden’s Department of Justice (DOJ), a 71-year-old great-grandmother may be thrown in jail because she walked around the Capitol for a few minutes on Jan. 6, 2021. Rebecca Lavrenz was convicted on four counts Thursday after just three days of jury deliberation for entering the Capitol on J6. Lavrenz entered the building through an open door around 2:43 p.m., according to the official statement of facts.

Lavrenz told The American Spectator‘s Jack Cashill that she “felt that if those doors [on the east side of the building] opened I was supposed to go through.” Lavrenz exited the Capitol around 2:53 p.m., just 10 minutes after entering, having briefly spoken to at least one Capitol Police Officer before leaving, according to the statement of facts.

Two FBI agents showed up on April 19, 2021, to Lavrenz’s home in Colorado. Lavrenz told the agents she was in the middle of baking a cake for her son and asked if they could return at a different time, according to The American Spectator. The agents returned one week later for a “consensual interview,” according to the statement of facts.

After months of investigation, agents reportedly told Lavrenz she should be grateful the weaponized agency would only charge the self-described “praying great-grandmother” with four misdemeanor charges for entering a building her tax dollars pay for.

“Glad?” Lavrenz reportedly said. “I shouldn’t be charged with anything.”

Lavrenz was charged with entering and remaining in a restricted building or grounds; disorderly conduct and disruptive conduct in a restricted building or grounds; disorderly conduct in a capitol; and parading, demonstrating, or picketing in a capitol, according to the criminal complaint. According to the Colorado Springs Gazette, Lavrenz could face up to a year in prison and fines of over $200,000, not including legal fees.

“My country is treating me like a criminal because I believe that they stole my rightful president,” Lavrenz said in an emotional video posted to social media. “And just standing up for my country makes me a criminal and it’s not right, it feels so weird to be here.”

Stewart Parks, who was sentenced to eight months in prison after being convicted of the same charges as Lavrenz along with theft of government property after he picked up a metal detector wand and walked around with it for a period of time, said on “The Vicki McKenna Show” that the Biden administration is trying to send a message that the so-called wrong kind of political protests won’t be tolerated.

“If you think about it, my house was raided and I was arrested on June 2, 2021, so I’ve been on a form of probation since that day,” Parks said. “I could have had four or five years if they had done it consecutively. These punishments are just way too harsh for a crime that wasn’t committed.”

The left has tried to portray Jan. 6 as a “violent insurrection” despite video footage and witness testimony contradicting the narrative.   • Why are those controlling President Biden using him to advance so much of a destructive agenda that it will likely end America as we know it?

Here are 11 now familiar steps to civilizational destruction:

1. Wipe out a 2,000-mile border. 

Allow 10 million foreign nationals to enter unlawfully. Have no audit of any; nullify all federal immigration laws. Let in toxic drugs that kill 100,000 Americans a year. Give free support to those millions who broke the law. Smear any objectors as racists and xenophobes.

2. Run up $35 trillion in national debt. 

Keep adding $1 trillion to it each 100 days. Defame anyone wishing to cut wild spending as cruel and inhumane.

3. Appease or subsidize enemies like Iran and China. 

Demonize allies like Israel. Allow terrorists to attack Americans without adequate response. See Islam as either similar or superior to Christianity. Make amends to leftist governments for supposedly past toxic American international behavior. Follow the lead of international agencies like the U.N., ICC and WHO to atone for past American neocolonial and imperialist behavior. Recede to second-tier international status, befitting American decline.

4. In a multiracial democracy, redefine identity only as one’s tribal affiliation. 

Ensure each identity group rivals the other for victimhood and the state spoils it confers. Reboot all political issues by race and sex oppressors and oppressed. Destroy all meritocratic standards of admission, retention, promotion and commendation.

5. Recalibrate violent crime as understandable, cry-of-the-heart expressions of social justice. 

Ensure no bail and same-day release for arrested, repeat violent felons. Empathize with the violent killer and rapist; ignore their victims, especially if they are slain police officers.

6. Emasculate the military by using non-meritocratic standards of race, gender, and sexual orientation to determine promotion and commendation.

Deliberately impugn as racists and insurrectionists the largest demographic in the military who in recent wars died at twice their numbers in the population — so that they leave or never join the military. Encourage retired high officers to slander their commander-in-chief. Cut the defense budget. Stop producing sufficient weapons, but leave billions of dollars’ worth of arms to terrorists.

7. Reinvent the justice system to indict, bankrupt, convict, jail and eliminate political opponents. 

Use ballot removal, impeachment, civil suits, and state and federal indictments rather than elections to defeat an opponent. Mob the homes of non-compliant Supreme Court justices, and attack them personally by name.

8. Encourage the fusion of the bureaucratic state with the electronic media to form a powerful force for political audit, surveillance, censorship and coercion. 

Marry the FBI to Silicon Valley and hire its contractors to warp the news and hound supposed enemies of the people.

9. Make war on affordable gasoline and natural gas. 

Substitute inefficient, unreliable and expensive wind and solar power, even as energy prices nearly bankrupt the middle class.

10. Marry late, but preferably not at all. 

Consider males toxic, especially boys. Have no children, or as few as possible. Otherwise, assure children they are entitled, and must be sheltered.  Raise them to have grievances against past generations and current norms.

11. Turn world-class universities into indoctrination centers. 

Suspend the Bill of Rights on campuses. Train youth to graduate despising their own culture and civilization. Recruit foreign students from hostile nations to subsidize campus commissar bloat. Replace the curriculum with therapeutic propaganda. Ban the SAT/ACT and do not evaluate comparative high school GPAs. Ensure merit does not select the student body. Charge tuition higher than the rate of inflation. Bill the government when students default on their loans.

  • 1. They are delusional and think their socialist and globalist agendas are working and will save us.
  • 2. They are raging nihilists who do not like the U.S. and deliberately want it destroyed as a service to the world. A ruined U.S. is preferable to a strong America.
  • 3. They are Jacobin revolutionaries who are intentionally erasing the old United States as a prerequisite for creating an entirely new America that will arise from the ashes with no trace or even memory of its past.
  • 4. They have no agenda. They are aimless fools and utter incompetents. These bunglers just wing it day-to-day, in response to what their radical media, academic and political masters dictate is necessary for them to retain power. They have no idea of the damage they are doing.
  • 5. A bit of 1-3, but probably not 4.

There is cause for hope among this nihilist remaking of America: the people are fed up and will demand an accounting in the fall.

New York City politicians are pushing for revised laws after a crew of squatters punctuated a months-long terror campaign against their neighbors by burning a house to the ground last November. 

“It was a very quiet neighborhood before and then suddenly when it happened, those people break into the house,” Ming Zhu, who lives two houses down from the razed Brooklyn home, said at a Thursday press conference.

Residents say the cadre of squatters took up residence in the Dyker Heights neighborhood over the summer and quickly made themselves known by stealing security cameras and other goods from surrounding houses – and directly threatening neighbors.

Cheng Chen, 46, was charged with arson and criminal mischief after the Nov. 29 fire at 1237 67th Street last year – he was saddled with a six-month prison sentence after pleading guilty, according to court records.

“The fire was caused by candles,” Chen told police, according to a criminal complaint. “I was smoking a cigarette, lit a candle. While I had the stove on to heat up the water and to keep myself warm, [I] went downstairs to take a shower. When I came back, I saw flames and smoke everywhere.”

But the New York City Police Department told Fox News Digital that Chen started the fire “intentionally” and “recklessly.” 

The inferno caused $900,000 in damage, the New York Post reported, and took dozens of firefighters an hour to extinguish, according to ABC 7. 

A spokesperson for NYC Councilwoman Susan Zhuang’s office told Fox News Digital that the rest of those squatters are living in the home’s backyard to this day.

In light of the arson and a spate of similar incidents, Zhuang called for revisions to the squatter’s rights laws at a Thursday press conference as fed-up residents held up photos of the burning Brooklyn home. 

“In our neighborhood, we don’t have the Hamptons houses,” she told reporters in Gravesend. “We the people have the small houses. We work hard, check by check.

“They are hardworking families that pay their mortgages from paycheck to paycheck. Meanwhile, squatters enter their home while they are on vacation. People’s lives are turned upside down.” 

Zhuang said she has heard an increasing number of stories of homes and businesses being taken over by squatters in the last several months. Neighbor Zhu called upon politicians to clarify tenancy laws at the Thursday event: 

“This is New York City, the greatest city in the world – we have to make the city better,” he said. “Why does the city and the state make laws to make those people… to make an easier life for them?… We pay for everything. Those people don’t do nothing and they get it better than us… this is completely out of control.”

Zhu said the squatters at the home broke his $5,000 security camera. Another person living on the block said the squatters regularly stole water from surrounding houses using barrels.

The incident is just one of the latest squatter nightmares to plague New Yorkers – last month, eight Venezuelan migrants were hauled out of a Bronx home filled with guns and drugs. Many were previously arrested at the southern border and released back into the U.S. and one had a previous rap on a murder charge. 

Also last month, a Manhattan woman was murdered after she surprised two squatters who had taken up residence in her new apartment, police said – her family members found her stuffed inside a duffel bag. 

Lawmakers also called for police and courts to report and track squatting incidents so that it’s possible to know how often they are happening, ABC 7 reported. 

The outlet reported that Thursday’s press conference was one of several rallies centered on the squatting problem, with several held in Queens.

Council members on both sides of the aisle have advocated for closing loopholes that favor occupants refusing to leave residences over landlords, the outlet reported. 

Under New York City law, anyone who beds down in a home or apartment for at least 30 days can claim squatter’s rights, even if they broke into the property – it would be up to state legislators to change that.

Assemblyman Jake Blumencranz has written a bill that would make it easier for police to intervene, clarifying the definition of tenant to exclude squatters.

“We have an affordability crisis, a migrant crisis and a cost of living crisis in New York,” Blumencranz told Fox 5. “People know they can come to New York as a safe harbor, they can receive all kinds of free benefits, and now they know they can use our laws against the residents of New York to their advantage.”

Blumencranz’s proposed bill would allow police to intervene when residents don’t have a lease or proof that they’ve paid rent to live in a home, he said. “All we’re trying to do… is provide the people of New York reassurances that if someone moves into your home and they don’t have proper documentation, they cannot stay there.”

Big-money donors are beginning to coalesce around former President Donald Trump after he has become the presumptive GOP nominee as he attempts to close the cash-on-hand gap with President Biden, who recently set a high-dollar fundraising record.

This weekend in Palm Beach, Florida, Trump will take part in what is being billed as an “Inaugural Leadership Dinner” that includes several Republican high-profile donors and signals the beginning of a major push to cut into Biden’s cash-on-hand lead.  The event will be led by hedge-fund billionaire John Paulson and will be co-chaired by hedge fund tycoon Robert Mercer and his daughter Rebekah, oil tycoon Harold Hamm, hotelier Robert Bigelow and casino mogul Steve Wynn.

Bigelow and Hamm had previously funneled money to Florida Gov. Ron DeSantis in his ill-fated presidential run against Trump in the primary. Hamm previously donated to former U.N. ambassador Nikki Haley’s presidential campaign as well.

Scott Bessent, founder of the investment firm Key Square Group and former chief investment officer at George Soros’s Soros Fund Management, will also be co-hosting the event. Bessent has been rumored to be a potential cabinet nominee in a second Trump administration.  

The event will also be attended by Chairman and Chief Executive Officer of Strategas Jason Trennert, one of Wall Street’s top thought leaders. Chicago Cubs co-owner Todd Ricketts and New York Jets co-owner Woody Johnson are also expected to be involved along with Wilbur Ross, Trump’s former secretary of commerce. 

The event tops out at the “Chairman Level,” which costs $824,600 and includes seating at the former president’s table. 

“Now that President Trump won the primaries, defeating all 10 contenders by a landslide, I think it’s time for Republicans to unite behind him,” Paulsen recently told Bloomberg. “For that reason, I’m hosting this inaugural event to galvanize the broad support there is for the president.”

The event comes after President Biden raised at least $26 million in a star-studded event with former Presidents Barack Obama and Bill Clinton. Many expect Trump’s fundraising haul to eclipse that record-setting figure and possibly raise around $43 million.

On April 10, Trump will hold a fundraising luncheon in the swing state of Georgia with former Georgia Republican Sens. David Perdue and Kelly Loeffler. Top GOP donors are expected to attend, including Home Depot co-founder Bernie Marcus, poultry industry executive Tommy Bagwell, beverage sector executive Don Leebern III and Buckhead advocate Bill White.

On that same day, Trump will be holding a fundraiser in Orlando, Florida, with attorney Dan Newlin.

President Donald J. Trump has again created a fundraising juggernaut among Republicans. While he has been the presumptive nominee for the Republican Party for less than a month, the RNC and Trump campaign are one unified operation and focused on victory,” Republican National Committee Chairman Michael Whatley said in a statement this week.

Fox News Digital confirmed Trump and the RNC brought in $65.6 million in March and ended the month with $93.1 million in cash on hand. The figures include money raised by a number of fundraising committees.

The Biden campaign reported raising $53 million in February, ending the month with $155 million on hand. 

While Trump trails with cash on hand, The New York Times reported in February that Trump leads Biden when it comes to small-dollar donors who gave less than $200.

As suicide rates, sexual assaults, mass depression, and anxiety grip America’s youth, the Biden administration, state legislatures, and public school districts have begun usurping science education with “transgender and gender-nonconforming” curriculum.

Students in over a dozen states no longer have access to biologically based sex education; that’s been replaced by liberal laws and policies requiring classrooms to exchange biologically proven facts with pseudo-scientific advocacy of gender fluidity. 

Despite the claims of the U.S. Department of Education, no quantitative studies show gender transition or “gender nonconformity” is a healthy or normal part of human development.

These child-targeted policy prescriptions are often sweetened artificially by using comfortable terminology, such as “comprehensive,” “inclusive,” and “gender affirming” to paint those who disagree with the unscientific, immoral content aimed at minors as bigoted and heartless. If parents respond negatively to the content of these postmodern sex-education revisions, news outlets (which may claim to be unbiased) use those gaslighting terms in their coverage of the outrage.

This effectively gatekeeps any debate about negative consequences by portraying dissidents as knuckle-dragging Neanderthals. After all, what kind of monster wouldn’t be inclusive and affirming?

The most recent and flagrant example of this has been seen in Arizona’s Flagstaff Unified School District. Local parents obtained a video of school district staff discussing changes to the sex-ed curriculum that included removing the boy/girl binary. 

When parents shared their concerns at the next school board meeting, board President Christine Fredericks responded: “I will never apologize for being inclusive.”

So far, liberals’ strategy of dismissing any commonsense concerns with moral scolding straight out of a 1990s anti-bullying commercial has been effective. Parents who expressed concern about teenage boys pretending to be girls to gain access to girls’ locker rooms were disregarded as backward, uninformed, and unfeeling. When tragedy struck, in part due to these policies and worldviews—as in the sexual assault by a “gender-nonconforming” boy in a girls’ restroom of Virginia’s Loudoun County Public Schools—parents were scolded again and charged with being bigoted opportunists.

Similarly, after the shooting at Nashville’s Covenant School, in which a transgender assailant slaughtered three 9-year-old students and three staff members at the private Christian school, White House press secretary Karine Jean-Pierre responded by suggesting that “transphobia” was the true danger.

An LGBTQ+ activist organization called The Trevor Project has intimated repeatedly that the near 40% suicide rate for transgender individuals isn’t due to mental illness and toxic prescriptions. Instead, it’s the result of “bullying,” which also has been redefined to mean “anyone who doesn’t passionately support the child’s transition.” The assertion has been echoed consistently without question by federally funded media outlets such as PBS.

This quantitatively unverified accusation is a key rationale from the Left in why updating sex education curriculum is essential for them. After all, the point of sex ed is to answer students’ questions concerning physiological and reproductive development. These answers in biology-based sex education clearly differentiate men and women, not just in external sexual organs but in development rate, hormone production and balance, and higher susceptibility to certain diseases and conditions.

A postmodern, “inclusive” approach as outlined by LGBTQ+ advocacy groups, teachers unions, and massive grants from the Biden administration removes that differentiation altogether. 

Separating sex and gender as physicality and mentality, therefore disconnecting behavior from sex by suggesting that your sex comprises your organs whereas your gender is all in your mind, is heinously distant from reality. Naturally produced hormones based on sex govern anatomical systems, behavior, immune response, and reproduction.

The additional foolishness of encouraging minors that changing external appendages somehow certifies a gender change only adds insult to the injury of what was historically a scientifically sound subject.

Although biological sex education warned boys and girls of their higher likelihood of developing cancerous tumors in certain sex-specific organs and advised them to watch for signs at different ages, the new “gender affirming” sex ed does nothing to warn students about the carcinogenic danger of “hormonal treatments” in gender transitions.

The human endocrine system is incredibly fragile; tampering with it can be perilous. Women who seek hormonal treatment for menopause are required to be warned that doing so quadruples their risk of developing cancer. Although the same hormones are injected in transgender treatments, no such carcinogen warning is required or offered in any current “gender affirming” sex-ed curriculum.

The lack of patients’ mental health improvement and increasingly higher rates of detransition and regret aren’t mentioned either.

None of the biology, anatomy, and physiology, or developmental psychology texts from which I’ve taught have ever provided a shred of evidence justifying the omission or twisting of critical information when instructing students. At that point, you’re no longer a teacher, you’re a sleazy salesman for a pyramid scheme.

The misnamed “sex education” that the Department of Education describes as “safe and supported” is in reality temporal, shallow, and dangerous. As other nations ban transgender experiments on minors, President Joe Biden’s administration has put American children in danger via woke dictate, bastardizing health education into its antithesis.

Sex education in the U.S. is quickly becoming a sick joke, and permanent damage to American children is the punchline.

After he died last month in federal custody, Democrats are rallying around the death of an illegal alien who was convicted of murder more than two decades ago. Charles Leo Daniel, a Trinidad and Tobago citizen who illegally overstayed his U.S. visadied due to unknown circumstances on March 7 in the Northwest Immigration and Customs Enforcement (ICE) Processing Center in Tacoma, Washington.

Daniel was first jailed after he was convicted in 2003 of the brutal murder of his landlord roommate with a “bloody butcher knife.” Court documents say police arrived on the scene to find Daniel “covered in blood.”

Daniel claimed self-defense but the court determined that “testimony to be lacking in credibility” and “found the forensic evidence inconsistent with Daniel’s account of how he had stabbed” the victim, Raymond Lindsay. The court initially sentenced Daniel to “220 months prison and 24 to 48 months of community custody.” A per curiam decision issued in 2007 affirmed that sentence after concluding that “the court did not misapply the law of self-defense.”

After an immigration judge ruled in favor of expelling Daniel from the country in 2020, Daniel was transferred into the custody of the Office of Enforcement and Removal Operations, where he died.

Shortly after his death, researchers at the University of Washington quickly alleged that the circumstances of Daniel’s detention, which included “the second-longest stretch in solitary confinement of any person in ICE custody since 2018,” caused him suffering and may have played a role in his death. The UW activists demand that Congress send “written information requests of the agency’s Congressional liaison.”

“If members of Washington’s Congressional delegation have chosen not to make use of this tool to date, now is the time to start, in the interests of transparency, accountability, and supporting the leadership of Washington communities who are using every tool at our disposal in our effort to stop the abuse of our neighbors,” the “research update” concludes.

A few weeks later, a dozen Democrat Senators sent a letter to Department of Homeland Security Secretary Alejandro Mayorkas and Patrick J. Lechleitner, the ICE official performing the duties of the director, on March 29 demanding an end to the “misuse of solitary confinement in immigration detention.”

Sens. Elizabeth Warren and Dick Durbin, two of the signees, also spoke out against solitary confinement for those convicted of crimes connected to the Jan. 6, 2021 Capitol riot. They did not, however, ever send a formal letter demanding better treatment for detained Americans than for illegal border crossers.

Democrats’ letter to ICE does not mention Daniel’s name. It does, however, use the same language as UW to pressure ICE into reducing punishments for foreigners who break U.S. law and murder Americans.

On March 21, Rep. Pramila Jayapal also released a statement scolding ICE for “overreliance on detention” and even suggested that “nearly 67 percent of people detained in ICE custody have no criminal record and many more only have minor offenses such as traffic violations.” While mentioning Daniel by name, she did not mention Daniel’s criminal record atop his violation of U.S. immigration law. Instead, she offered sympathy to his family for the “unacceptable tragedy.”

“First and foremost, my heart goes out to Mr. Daniel’s family and loved ones. His death is an unacceptable tragedy and there must be accountability and a full investigation to understand exactly what happened at the Northwest Detention Center,” she said.

Democrats’ attention to Daniel’s death received amplification from The News Tribune. The pro-illegal migration group La Resistencia also saw their fact-free claims of “harassment” and “intimidation” amid protests outside of the Tacoma detention facility published in a positive light.

Neither article mentioned Daniel’s criminal history.

Texas on Wednesday defended its anti-illegal immigration law in oral arguments before a federal appeals court panel as the law remains on hold due to a legal challenge from the Biden administration. Abbott signed the legislation, SB 4, in December, which allows local police to arrest illegal immigrants and for judges to order them deported. However, the law has been on hold due to a challenge from the Biden administration, which says the law is unconstitutional, hurts international relations and impedes the federal government’s enforcement of immigration law. 

Texas has argued that the law is necessary due to the Biden administration’s alleged failure to secure the southern border and enforce immigration law, and on Wednesday it argued before the three-judge panel that the ongoing crisis at the border is unprecedented.

The court had previously blocked the law from going into effect, but it was then briefly allowed to go into effect by the U.S. Supreme Court before being kicked back down and blocked again by the Fifth Circuit.

It is one of a number of such measures being passed or moved forward by states across the U.S. Louisiana, Iowa and Tennessee are all states that have bills under consideration that would do either the same or similar to what Texas is seeking to do.

Illegal Immigrant Deported 7 Times Arrested for Murder, Authorities Say

An illegal immigrant who had been deported over a half-dozen times was charged with murder in Butler County, Ohio, according to local reports. Hamilton Police arrested 48-year-old Fermin Garcia-Gutierrez on unrelated charges on March 16, the Journal-News, an Ohio-based newspaper, reported. Authorities highlighted Garcia-Gutierrez’s record of seven deportations in a Friday press conference prior to the discovery of the murder, according to the Journal-News.

“It just so happens we ran into him and had an encounter with him,” Hamilton Police Chief Craig Bucheit told the Journal-News Wednesday. “Unbeknownst to us, he had committed this murder.”

Police received a 911 call Monday about the killing and interviewed Garcia-Gutierrez Tuesday, the Post-Journal reported. He was charged with aggravated murder, which can result in the death penalty, according to Cincinnati-based outlet WCPO.

Butler County Sheriff Richard Jones blasted President Joe Biden over the situation on the border in the Friday press conference, saying that 999 illegal immigrants had been housed in the county jail at a cost of over $1.8 million, according to the Journal-News.

Republicans, including former President Donald Trump, have highlighted crimes committed by illegal immigrants after the murder of nursing student Laken Riley. Riley’s alleged killer, Jose Antonio Ibarra, an immigrant from Venezuela who crossed the U.S.-Mexico border illegally, was arrested by University of Georgia police and charged with murdering the 22-year-old nursing student on Feb. 23.

According to data released by United States Customs and Border Protection, 849,469 illegal immigrants have been encountered to date in fiscal year 2024, following 2,045,838 encounters in fiscal year 2023, 2,206,436 encounters in fiscal year 2022, and 1,659,206 in fiscal year 2021.

Judge Denies Trump’s Bid to Toss Georgia Charges Based on First Amendment

The judge overseeing former President Donald Trump’s racketeering case in Georgia declined Thursday to dismiss the charges based on the First Amendment.

Trump’s attorneys argued in a December motion that the indictment “directly targets core protected political speech and activity,” urging Superior Court Judge Scott McAfee to dismiss the charges as violations of the First Amendment. But McAfee found that the state “alleged more than mere expressions of a political nature,” writing that the defendants did not find “any authority that the speech and conduct alleged is protected political speech.”dailycallerlogo

“Although the defendants characterize the relevant speech or actions as petitions to Congress regarding the validity of electors which must be afforded constitutional protection, at this stage the court must consider the method and manner of the criminal enterprise as alleged in the indictment,” the judge wrote of Trump and 14 co-defendants indicted in connection with trying to overturn the 2020 presidential election results in Georgia.

During a hearing on pretrial motions last week, Trump’s attorney told McAfee there was no “underlying basis” for the case other than protected speech. He said that even false statements are protected, pointing to a 2012 Supreme Court ruling in United States v. Alvarez.

McAfee wrote in his ruling that the allegations contained in the indictment “do not suggest that this prosecution comes solely because it believes the speech was inaccurate.”

“Instead, the indictment avers throughout that the defendants acted ‘willfully’ and ‘knowingly,’ and that they impacted matters of governmental concern,” the judge wrote. “These are not legal conclusions, but issues of fact.”

McAfee left open the possibility that Trump and the other 14 defendants would raise “similar as-applied challenges at the appropriate time after the establishment of a factual record.”

“President Trump and other defendants respectfully disagree with Judge McAfee’s order and will continue to evaluate their options regarding the First Amendment challenges,” Steve Sadow, Trump’s lead defense counsel, said in a written statement.

“It is significant that the court’s ruling made clear that defendants were not foreclosed from again raising their ‘as-applied challenges at the appropriate time after the establishment of a factual record,’” Sadow said.

University of Maryland President Darryll Pines has joined the ignoble line of educators and administrators enabling the growing anti-free speech movement on our campuses. Pines has defended the shouting down of Rep. Jamie Raskin (D., Md). as exercising free speech as hecklers. He is dead wrong, and the Board of Directors should address his inimical view of free speech in higher education.  As for Raskin, it is an ironic but telling moment from a member of Congress who has supported censorship and consistently opposed efforts to investigate the silencing of those with opposing views.

I have been highly critical of Rep. Raskin on a number of issues, particularly his efforts to thwart investigations into censorship.

Pines terminated the event after protesters repeatedly interrupted his speach as the Irving and Renee Milchberg Endowed Lecture, titled “Democracy, Autocracy and the Threat to Reason in the 21st Century.”

According to the Maryland Reporter, the protesters accused the Jewish legislator of being “complicit in genocide” and rebuffed his efforts to engage them in a dialogue on the issue. After efforts to resume his remarks, Pines finally ended the event early.

Rather than protect the right of Raskin to speak and others to hear his views, Pines offered only a mild criticism of the protesters as needing to be more civil but then insisted “what you saw play out actually was democracy and free speech and academic freedom.” He added that, “from our perspective as a university, these are the difficult conversations that we should be having.”

No it is not as difficult as you suggest. These protesters stopped the free exchange of ideas in a university event. They prevented opposing views from being spoken or heard. In so doing, they blocked the critical condition needed for higher education in allowing an exchange of ideas. Heckling is an effort to stop discussion, not to engage in discussion.

Clearly, the “difficult conversation” for Pines is to enforce university policies and protections for free speech. It takes courage and principle. It requires administrators to have the commitment to suspend or expel students who disrupt classes or events. They have every right to protest outside or to ask difficult questions. They do not have a right to prevent speech.

As for Raskin, he is now the victim of the anti-free speech movement that he has helped fuel in Congress. In my forthcoming book, The Indispensable Right: Free Speech in an Age of Rage, I discuss this pattern as the anti-free speech movement turns on politicians and professors who once supported them. Others spent years in conspicuous silence as others were targeted, but now have grown alarmed as their own views are declared “harmful” and “triggering.”

As discussed today in relation to a controversy at Tulane, universities continue enable this movement by failing to enforce policies at events or refusing to punish those responsible. Pines is not alone in his view that this is just an exercise of free speech. Academics and deans have said that there is no free speech protection for offensive or “disingenuous” speech.  CUNY Law Dean Mary Lu Bilek showed how far this trend has gone. When conservative law professor Josh Blackman was stopped from speaking about “the importance of free speech,”  Bilek insisted that disrupting the speech on free speech was free speech.

In the incident last year of a federal judge being shouted down at Stanford Law School, Dean Jenny Martinez later apologized and then released a letter with Stanford President Marc Tessier-Lavigne that reaffirmed the commitment to free speech, but did not commit to holding the students accountable for their disruption.

Dean Martinez later issued another letter with a strong defense of free speech and declared that all students (including the victims of the disruption) would be required to attend a free speech appreciation session. However, she declined any action against the students responsible for the disruption. That is a familiar pattern at universities.

The question is whether the Board of Regents for the Maryland system will call Pines to account for his view of free speech.

Alvin Bragg brought a bogus case against Donald Trump. And he knows it’s complete BS. But that didn’t stop him from serving the higher-ups.

Because that’s what Leftists do. But now Bragg showed some of his cards.

The NY AG and fathead minion of the Biden administration filed a shocking motion in court. He revealed to Joe Biden-donor Judge Juan Merchan that he wouldn’t object to a 30-day delay in his trial of Donald Trump. That trial date was set to begin on March 25.

Trump’s team requested a 90-day delay and for good reason. The prosecutors at the Southern District of New York finally produced over 30,000 pages of documents requested by the Trump defense lawyers. Thus, a 90-day extension seems reasonable to review all the materials. But why did Bragg okay the delay?

Bragg brought the case. He shouldn’t have needed any delay to prosecute his frivolous case. Yet he appears to use the new information as an excuse.

What could the prosecutors of the SDNY provide in a case that began as a misdemeanor where the statute of limitations expired? And then to have such a case elevated to a felony when there is as in the case of Letitia James, no hurt party?

“The Manhattan district attorney’s office, which accused Mr. Trump of covering up a sex scandal during and after the 2016 presidential campaign, said the delay would give Mr. Trump’s lawyers time to review a new batch of records. The office sought the records more than a year ago, but only recently received them from federal prosecutors, who years ago investigated the hush-money payments at the center of the case,” The New York Times reported.

“In response to the new records — tens of thousands of pages of them — Mr. Trump’s lawyers requested that the trial be delayed 90 days. Although the former president frequently requests such delays, prosecutors consenting to any postponement makes one far more likely,” The Times also reported.

What took so long?

The people out to get Trump have had plenty of time to review documents. The fact that the Trump team is just getting them says either (1) they have nothing, or (2) they fabricated “evidence”.

Why these documents are important 

Politico asked some of the same questions I did:

One mystery was why SDNY didn’t turn over all of these documents when Bragg asked for them in early 2023. Bragg only partially answers that question today. For instance, Bragg says that SDNY only recently obtained five FBI interview memos, so they can’t be blamed for failing to produce them a year ago. A sixth memo was in their possession then but outside the scope of Bragg’s subpoena.

While Bragg says his “review is ongoing,” he says the only materials he’s identified as relevant to the case are 172 pages of notes pertaining to lawyer MICHAEL COHEN’s meetings with special counsel ROBERT MUELLER and “fewer than an estimated 270 documents” from Cohen’s phones. Those records, Bragg claims, are mostly “inculpatory and corroborative of existing evidence” — in other words, bad news for Trump.

These documents will reveal nothing new to help Bragg. And the scenario reminds me of Trump’s former personal lawyer’s supposed bombshells. Each one yielded nothing, and ultimately Cohen ended up in prison.

Bragg brought this case on the legally dubious theory that Donald Trump falsely marked nondisclosure agreement settlement in October 2016 as for legal services. The crux of Bragg’s novel legal theory is that Trump tried to cover up an illegal campaign donation from Cohen.

I remind you that both the Justice Department and the Federal Election Commission investigated this matter and determined Trump didn’t commit any campaign finance violation. Candidates can pretty much do whatever they want with their own money, and Trump financed much of his own campaign.

Trump’s team requested these documents – including the 172 pages of witness statements. They contend that these documents will bolster their case and prove that Bragg invented a crime out of thin air.

Major Problems on the Horizon for Democrats

Democrats’ insanity against Trump and everyone connected to Trump created major problems. Here’s the timeline.

Judge Merchan is set to oversee the trial of Steve Bannon on charges relating to the Build the Wall campaign in May. Thus, any delay in the Trump trial means that trial can’t start until after the Bannon trial.

Trump is winning in all areas of his classified documents case. Judge Aileen Cannon likely won’t put the Mar-a-Lago case on the schedule until after the election. A Trump win will change the complexity of that case significantly.

As for Bragg’s non-case, CNN legal analyst Elie Honig commented:

“I think there’s now for the first time a real question about whether this case gets tried before the November election.”

Even Honig’s timeline is optimistic. Because my bet is with a Trump win, this case gets tossed on Nov 6.

EAST PALESTINE, Ohio — President Joe Biden plans to visit Baltimore this week following the devastating collapse of the Francis Scott Key Bridge. While the loss of life and devastation of crucial infrastructure certainly warrants a presidential visit, one can’t help but wonder why Biden lacked similar urgency when it came to East Palestine, Ohio.

In February 2023, 38 cars — several containing hazardous materials, notably vinyl chloride monomer — on a Norfolk Southern freight train derailed in the heart of East Palestine. Fearing these tankers might explode, representatives from Norfolk Southern, along with individuals from the village fire department and Ohio Environmental Protection Agency, opted to “vent and burn” the vinyl chloride. The burn released hazardous chemicals into the community’s air, waterways, and soil. Village residents experienced a slew of concerning health symptoms as a result of the now-unbreathable air and toxified environment. Thousands of people were forced to flee their homes, and local employers had no other option but to close their doors. 

This past September, more than eight months after the derailment, President Biden issued an executive order mobilizing federal agencies to oversee cleanup efforts, monitor environmental and public health consequences, and provide additional resources to members of the affected communities. Biden also called for Norfolk Southern to be held accountable for any wrongdoing it may have committed during the incident. Village residents remain unconvinced, however, that any of this will have a positive effect.

We are now a little over a year removed from the incident. While signs of progress bring cautious optimism for the village’s prospects, numerous questions and concerns remain. Chief among these is how the community continues to cope with the circumstances thrust upon it and, crucially, what preventative measures are being implemented to prevent a similar tragedy from recurring.

“We’re still on the path to recovery,” East Palestine Village Manager Chad Edwards told The Federalist. “Some people are still reporting symptoms from the chemicals, but it’s not a large number, which doesn’t make it any less concerning.”

The village draws its drinking water from an aquifer, so there was never any major concern about contamination, but air quality remains an area of focus. “It’s very important the people who were here at the time of the derailment aren’t forgotten about in 20 years,” Edwards said, continuing the conversation about health effects. “What I’m hearing from the experts at the EPA is that we don’t know if there will be long-term side effects from the air quality.”

But there are people in the village who are currently facing serious medical issues related to pollution from the controlled burn. Residents still experience health issues from airborne pollution, some people still have physical reactions when they enter homes exposed to chemicals from the burn, and the nearby Beavercreek Watershed has an abundance of signage warning people to “keep out.”

Chris Albright, an East Palestine resident, began experiencing “really bad headaches” about two weeks after village residents were allowed to move back into their homes following the controlled burn. “Anytime I got close to home, I would just get a horrible headache, and I never get headaches,” he told The Federalist.

Alongside these headaches, Albright was experiencing random bouts of vomiting and persistent fatigue. Ultimately, his physicians determined he was suffering from rapid-onset congestive heart failure. The chemicals released by the burn are believed to have greatly exacerbated Albright’s condition and contributed to his deteriorating health. 

“I’m not an obese guy; I’m very active,” said Albright, who has little faith in the “experts” from the government upon whom the community relies for information about air quality. “Because of this, I’ve been unable to work. I actually lost my health benefits at the end of [2023].”

Despite having a “Family Resource Center” in the village, Norfolk Southern, the entity responsible for the burn, has not provided Albright any assistance beyond hotel reimbursement. “I have not heard a word from Norfolk Southern,” he said. “I’ve never had anybody reach out and never received any correspondence other than how to get reimbursed for our hotel when we had to leave our house [because of the burn].”

When speaking with The Federalist, Village Manager Edwards noted that Norfolk Southern was “revamping” the community’s park, a project estimated to cost around $25 million. “I think they’ve done above and beyond what they’ve really had to do,” he said.

Experiences like Albright’s, life-altering circumstances with no assistance, inspired community members to act.

Chris Neifer, the superintendent of East Palestine City Schools, told The Federalist that shortly after the derailment and controlled burn, school leadership delivered various products to people throughout the village, set up community game nights, and “different things to keep kids’ minds off of not having to deal with the adult problems.”

“We had determined as a team that we were not going to be victims of this,” Neifer said.

Jami Wallace, a lifelong resident of East Palestine who said she has 47 family members living within one mile of the train derailment sight, turned to community organizing when she was told by a toxicologist that her family could become exposed to contaminated creek water through a basement leak. Structuring the East Palestine Unity Council (EPUC) after her union, Wallace created the organization so people invested in the community could raise awareness of specific issues they continue to struggle with and fill in the gaps where the government falls short.

The EPUC is a self-declared “oversight board” committed to ensuring “the right of the people to maintain clean air, water, and soil” that aims to represent “all members of the [East Paletine] community[] and surrounding areas affected by the derailment.”

Documents viewed by The Federalist that were sent to the Biden administration by the Government Accountability Project on behalf of the EPUC further detail village residents’ grievances. According to these organizations’ substantiated claims, the EPA refused to test residents’ property for contamination, only tested the polluted area for a small amount of “more than 100 other dangerous compounds that were formed by the burning,” misled the public about the levels of harmful chemicals in the area, and more.

The organization has already met with several federal officials, including members of the Biden administration. However, perhaps the village’s most committed advocate in government remains Ohio’s junior U.S. Sen. J.D. Vance, who visited the area almost immediately after the incident occurred and championed bipartisan rail safety legislation

During a full committee hearing on the National Transporation Safety Board’s (NTSB) Investigations Report last month, Vance got NTSB Chair Jennifer Homendy to state on the record that the controlled burn was entirely unnecessary and that Norfolk Southern contractors lacked sufficient evidence justifying the operation. 

During Vance and Homendy’s exchange, it was further established, based on previous reports, that following derailment, the vinyl polymers were decreasing in temperature (thus reducing the risk of an uncontrolled explosion); Norfolk Southern was not of the mentality that a chemical reaction resulting in an explosion was imminent, and on-site representatives of the company were properly informed that a controlled burn lacked sufficient scientific basis; and Norfolk Southern representatives disregarded available data and contradicted this expert feedback.

Norfolk Southern, in turn, relayed inaccurate information to the governor of Ohio, who was one of the people responsible for authorizing the controlled burn. Had the company’s representatives relayed accurate information, this whole ordeal could have been avoided. In March 2023, the state of Ohio and the Department of Justice filed separate suits against Norfolk Southern. 

“The fallout from this highly preventable incident may continue for years to come, and there’s still so much we don’t know about the long-term effects on our air, water and soil,” Ohio AG Dave Yost told The Washington Post.

Norfolk Southern did not respond to The Federalist’s multiple requests for comment.

Just under 50,000 voters in Wisconsin’s Democratic primary Tuesday cast ballots for an “uninstructed” delegation in a protest vote against how President Joe Biden is handling the war between Israel and Hamas. The approximately 48,000 votes, or about 8% of the total outcome, was more than 10 times as many as chose the “uninstructed” choice in 2020 while surpassing the general election margin separating Biden and former President Donald Trump, reports The Hill.

Meanwhile, only 2% of Republican voters in Wisconsin’s primary chose the “uninstructed” option.

“We had three weeks to pull off a presidential primary election,” the activist group Listen to Wisconsin said, celebrating the performance.

“Lots of tiring days and sleepless nights. But we would do it over again in a heartbeat,” the group said in a social media post. “Thank you, Wisconsin for making your voices heard today!”

In other states, protest votes have brought a total of 26 delegates, with Washington, Minnesota, and Michigan marking the strongest showings, but in Wisconsin, the “uninstructed” option did not result in any delegates, as that total did not go past the 15% support required.

Organizers in the movement set a goal of 20,000 votes, so the 48,000 cast more than doubled that target.

The votes come as critics call on Biden to back a full cease-fire in Gaza, which he is refusing to do, and after his criticism of the Israeli military action grows.

Progressive commentator Nina Turner applauded the vote, commenting on social media that Biden must “decide if loyalty to Netanyahu is worth delivering Trump the election in November. He must decide.”

The Biden administration has been pushing the Israeli government on civilian casualties and to let more humanitarian aid enter Gaza. The United Nations has warned that famine is beginning to set in in the region, with U.S. airdrops of aid falling too short of needs.

A planned pier in Gaza to deliver aid could take months, and according to the State Department, there are no plans for distributing the aid after the pier is finished.

When people couldn’t afford housing during the Great Depression, they built shantytowns from scrap construction supplies and named them “Hoovervilles,” after President Herbert Hoover. Today, Americans increasingly live out of their cars because they can’t afford housing. If history is any guide, will parking lots full of Americans soon be known as “Bidenvilles”?

The problem has gotten so bad that Sedona, Arizona, recently set aside a parking lot exclusively for these homeless workers. The city is even installing toilets and showers for the new occupants. Apparently, the City Council thought installing temporary utilities was cheaper than solving the area’s cost-of-living crisis.

And what a crisis it is.

The average home in the city sells for $930,000, while most of the housing available for rent is not apartments, but luxury homes targeted at wealthy people on vacation. With such a shortage of middle-class housing and with starter homes essentially nonexistent, low- and even middle-income blue-collar workers have nowhere to go at night but their back seat.

Much like America’s Great Depression in the 1930s, this marks a serious regression in our national standard of living. But shantytowns were not prevalent in the 1920s (a decade that began with a depression) or the 1910s. Nor were they ubiquitous following the Panic of 1907, which set off one of the worst recessions in American history. Indeed, Americans in the Great Depression faced such a cost-of-living crisis that many were forced to accept a standard of living below what their parents and even their grandparents had.

Fast-forward about 90 years, and countless families are in the same boat. Many young people today don’t think they’ll ever be able to achieve the American dream of homeownership that their parents and grandparents achieved. The worst inflation in 40 years, rising interest rates, and a collapse of real (inflation-adjusted) earnings mean a huge step backward financially. That inflation has pushed up rents so much that young Americans are moving back in with their parents at rates not seen since the Great Depression because they can’t make it on their own. Sometimes, they can’t even make it with multiple roommates.

But many people cannot move back in with family, so the car it is.

The housing problem is not limited to wealthy towns in Arizona, however. It is systemic. The monthly mortgage payment on a median-price home has doubled since January 2021, and rents are at record highs. Like the Great Depression, this disaster stems from impolitic public policy.

For the past several years, the government has spent, borrowed and created trillions of dollars it didn’t have. The predictable result of this profligacy was runaway inflation, followed by equally foreseeable interest rate increases. The deadly combination of high prices and high interest rates has frozen the housing market and reduced homeownership affordability metrics to near-record lows. In several major metropolitan areas, it takes more than 100% of the median household after-tax income to afford a median-price home. Since rents and virtually all other prices have risen so much faster than incomes over the past three years, even renting is unaffordable today, so many people have to go into debt to keep a roof over their heads. And for some, that’s a car roof.

This is the kind of story you might expect from a Third World country or somewhere behind the Iron Curtain during the Cold War, not the largest economy in the world—at least not outside of a depression like the one in the 1930s.

Hoover certainly deserved some blame for the Great Depression, but so did the progressives in Congress, who came from both parties and repeatedly voted to meddle in the economy instead of allowing it to recover from the initial downturn. Similarly, President Joe Biden deserves blame for constantly advocating runaway government spending. But today’s multitrillion-dollar deficits are also made possible by the big spenders in Congress, who come from both parties.

If this bipartisan prodigality of Washington continues, Bidenvilles will only become more widespread as the housing affordability crisis worsens.

FIRST ON THE DAILY SIGNAL—Documents reveal an organization backed by Obama White House alumni such as Valerie Jarrett and bankrolled by liberal dark money donors advocated using tax dollars to pay college students to get out the vote in the 2024 election, doing so before the Biden administration announced the same policy.

The Daily Signal obtained the documents through a public records request in which it sought documents from the Wisconsin Elections Commission related to President Joe Biden’s controversial executive order to promote voting. 

In January, an activist with ALL IN Campus Democracy Challenge, a project of the liberal group Civic Nation, contacted officials with the state of Wisconsin and its capital city, Madison, about a need to allow money from the Federal Work-Study Program to pay for students to engage in election-related work. By late February, the U.S. Department of Education and Vice President Kamala Harris announced that the Biden administration was doing exactly that. 

A new Wall Street Journal poll of voters in battleground states found former President Donald Trump tied with Biden in a two-way race in Wisconsin, which Trump lost to Biden in 2020 by only about 20,000 votes of over 3.2 million cast.

In a Jan. 18 email, Ryan Drysdale, director of impact and state networks for the ALL IN Campus Democracy Challenge, sent an email to Bonnie Chang, voter outreach coordinator in the Madison city clerk’s office, about U.S. Education Secretary Miguel Cardona’s plans to revise how taxpayer money may be used. 

“Lastly, as you may be aware, the secretary has been working on clarification about Federal Work-Study being eligible for supporting student workers with local election officials and feels confident another letter will come from the WH/Dept of Ed with guidelines,” Drysdale wrote to Chang, referring to the White House and the Department of Education. 

The Federal Work-Study Program, funded by the Department of Education, provides financial aid to eligible undergraduate and graduate students at colleges and universities. The youth vote helped stop an anticipated “red wave” for Republican candidates in 2022. It once was perceived as a core Democrat constituency, which is one reason the Biden administration has tried repeatedly to “forgive” student loan debt.  

ALL IN asserted that the youth vote was the deciding factor in 2022 elections in Pennsylvania, Michigan, Nevada, and Wisconsin. The initiative announced that 394 colleges and universities across 44 states and the District of Columbia were part of its first program recognizing “Most Engaged Campuses for College Student Voting.”

“I was invited to join a meeting with the secretary, the UW-Superior campus team and surrounding local election officials who are exploring both internship and FWS opportunities,” Drysdale wrote to Madison’s Chang, referring to Cardona, the University of Wisconsin in Superior, Wisconsin, and the Federal Work-Study Program. 

“There was a lot of excitement even without the FWS component,” he wrote. “They hope to use UWS [University of Wisconsin-Superior] as a case study for other [Wisconsin] institutions and local election officials to learn from. Happy to share more on a quick call if that would be helpful. There’s a big interest from partners and funders about FWS and these types of opportunities so we’ll be following these developments in WI.”

On Jan. 19, Chang forwarded Drysdale’s email about the Federal Work-Study Program, or FWS, to Madison City Attorney Michael Haas. She noted that University of Wisconsin-Madison officials said that “it’s in the federal language that FWS students are not able to work at the polls on Election Day nor engage in GOTV/voter engagement spaces.” GOTV is a reference to “get out the vote.”

That same day, Haas wrote to Wisconsin Elections Commission Administrator Meagan Wolfe. 

“If I understand correctly, there is a request to change the FWS rules regarding work as election inspectors, but I don’t think that has happened yet,” Haas said of Federal Work-Study rules. “In any event, the secretary of state is trying to help make it happen.”

The Wisconsin Secretary of State’s Office, which oversees elections in the state, didn’t reply to inquiries from The Daily Signal by publication time. 

The Daily Signal previously reported that Civic Nation’s board includes Jarrett, former senior adviser to President Barack Obama; Tina Tchenformer chief of staff to first lady Michelle Obama; and Cecilia Muñoz, former director of the Obama White House’s Domestic Policy Council. Funders of Civic Nation include left-leaning grant makers such as the Democracy Fund, established by eBay founder Pierre Omidyar; the Carnegie Corporation of New York; the Environmental Defense Fund; and the Joyce Foundation, which included Barack Obama on its board before he became president. Besides ALL IN, other groups run by Civic Nation include United State of Women and When We All Vote

Amanda Hollowell, When We All Vote’s national organizing director, was among activists who met Feb. 27 at a White House event with the vice president to talk about turning out voters. 

“We have been doing work to promote voter participation for students.  And, for example, we have—under the Federal Work-Study Program—[we] now allow students to get paid, through federal work-study, to register people and to be nonpartisan poll workers,” Harris told the gathering at the Eisenhower Executive Office Building. 

“As we know, this is important for a number of reasons,” she said. “One, to engage our young leaders in this process and activate them in terms of their ability to—to strengthen our communities. But also, this is the work that we need to do, knowing that so many poll workers have left this work for a variety of reasons that we will also discuss.”

The city of Madison played no role in pushing for a clarification of U.S. Education Department policy on allowing the program to pay students for election work, the city attorney told The Daily Signal. 

“City of Madison officials did not lobby the Biden administration to change FWS rules. We have not been involved in that issue except for receiving the email from Ryan Drysdale so I do not [know] details about the FWS regulations or how they changed as they do not affect the city’s operations,” Haas said. “The city of Madison hires a number of UW-Madison students as poll workers and pays them in the same way as other poll workers with city funds.”

The Daily Signal sought comment from ALL IN’s Drysdale and the press contact for Civic Nation. Neither responded. The Education Department referred The Daily Signal to a “Dear Colleague letter” to college administrators, dated Feb. 26, from Nasser H. Paydar, assistant secretary in the Office of Postsecondary Education.

In part, the letter says: “The department is today clarifying that FWS funds may be used for employment by a federal, state, local, or tribal public agency for civic engagement work that is not associated with a particular interest or group.” 

The documents released to The Daily Signal by the Wisconsin Elections Commission also showed consultation between state officials and the National Institute of Standards and Technology, an agency within the Commerce Department. NIST was putting together its strategic plan to comply with Biden’s executive order on getting out the vote, which it later made public.

The institute is one of at least four federal agencies to make such a strategic plan public. The Justice Department, however, has claimed presidential privilege to prevent public release of its own plan for complying with Biden’s order.

In a city of flacks, Ian Sams is prototypical. Quotable, punchy, and fast on social media, he stays ahead of the news cycle. Those traits are greatly valued by clients in this city where losing control of a narrative can allow a controversy to metastasize into a full fledge scandal. What is different is the client. Sams, a well–known Democratic operative, is not working for a Democratic campaign, but a Democratic president and speaks for the White House Counsel.

That position continues to raise eyebrows, as it did this week when Sams issued insulting and taunting postings after the House Oversight Committee asked the President to answer ten questions from its impeachment inquiry. Sams posted images of signs mocking the inquiry next to his title reading “White House spokesman for oversight and investigations. Deputy Assistant to the President & Senior Advisor to WH Counsel’s Office.”

The White House Counsel’s office has historically avoided engaging in political spin and attacks. It prides itself on representing the office of the Presidency, not the president as a person. President Biden has personal counsel to look after his interests as an individual. What is striking is that his personal counsel has shown far more circumspection and restraint in responding to such inquiries.

Sams has been previously questioned by the White House press corps over the accuracy of his statements and that fact that he is routinely cited as speaking for White House Counsel’s office on a variety of legal questions but lacks any law degree. He was also the subject of a complaint from the head of White House press corps over his giving them “marching orders” on how to control the allegations against the President.

Sams’s statements often are long on sarcasm and short on substance. Even normally favorable outlets like CNN have noted Sams’s refusal to address specific questions while lashing out at the Special Counsel or others.

Sams has a long resume as a political staffer. He graduated from the University of Alabama with a degree in political science, where he was president of the College Democrats. He went on to work with the Democratic Senatorial Campaign Committee (DSCC) in Washington, D. C. as well as Democratic candidates, including but not limited to Sen. Tim Kaine (Va.), Tom Carper (Del.), and Hillary Clinton. He also worked for the Democratic National Committee in Washington, D. C.

That is an impressive resume for any flack, and I do not fault Sams for his aggressive style or his clientele. Indeed, I do not even blame him for his work at the White House. I blame White House Counsel Ed Siskel, who has used Sams to materially change the role and function of his office in this corruption scandal. Siskel previously worked in the Obama Administration and was one of his students at the University of Chicago. His use of Sams has returned the office to an earlier, more partisan operation.

The White House Counsel’s office has been headed by some of Washington’s most revered legal figures from Lloyd Cutler to Boyden Gray. These were lawyers with strong Republican or Democratic alliances who were both aggressive and protective in support of their presidents. However, they maintained strict lines in offering objective (and sometimes unwelcomed) advice to presidents in the interest of their offices. They were adamant in maintaining space between the political and legal operations of the White House.

There have been White House counsels who lost that objectivity and separation to the great peril to themselves and their office. Nixon had John Ehrlichman, Chuck Colson, and John Dean — all of whom were convicted or pleaded guilty to criminal offenses.

The office under Siskel has returned to earlier models of partisan White House Counsel. The first such office holder, then called Special Counsel, was New York Judge Samuel Rosenman who made no pretense of any independent or apolitical role in working for Franklin Delano Roosevelt. He trained and was followed by Clark Clifford who was aggressively political.

Presidents have also routinely selected close friends or loyalists for the role. The office could be used as a counterfoil to the Attorney General, who often pursued conflicting institutional interests.

Yet, as the White House Counsel’s office grew, it took on greater ethical and reporting responsibilities. The culture changed to protecting the presidency as much as the president, including giving unwelcomed advice. That was the case in the final days of the Trump Administration when Pat Cipollone confronted the President on election fraud claims and actively pushed back on private counsel like Rudy Giuliani. During the impeachments, Cipollone was circumspect and restrained. He was rarely in the public eye and his office issued comparably few responses to media stories.

In past years, it was often difficult to get a statement on the record from the White House Counsel’s office, which routinely referred anything even remotely political to the Chief of Staff or the Press Secretary.

That has changed with Sams, who has issued statements from the White House Counsel’s office with the speed and the sarcasm of a DNC flack. This is often in response to requests for the legal position of the office to a major filing or legal claim.

He is unrelenting and, by all appearances, entirely unrestrained. Every day, there are Sams-I-am missives that border on the Seussian: “You do not like them. So, you say. Try them! Try them! And you may. Try them and you may, I say.”

I have previously raised concerns over the role of Sams in the impeachment inquiry. In my testimony in the first Biden impeachment hearing, I noted that the Biden White House was approaching a dangerous line in pushing false claims on the corruption scandal, including repeating President Biden’s past denials that he never spoke to his son or had knowledge of his son’s foreign dealings. It can lead to the same blurred lines that led to not just the impeachment articles but the criminal charges in the Nixon Administration.

Those concerns became magnified this month when the House sent the ten questions to the President to address glaring contradictions in his past public statements. Sams immediately responded on behalf of the White House Counsel:

“LOL. Comer knows 20+ witnesses have testified that POTUS did nothing wrong. He knows that the hundreds of thousands of pages of records he’s received have refuted his false allegations. This is a sad stunt at the end of a dead impeachment. Call it a day, pal.”

Again, it is the type of posting that one would expect from the DNC, not the WHC. Yet, Siskel clearly approves of this type of taunting, sarcastic response from an office that has fought to maintain its image of professionalism and prudence.

Sams, not Siskel, is now the face of the White House Counsel’s office. That is certainly welcomed by the Biden campaign, but it is often difficult to distinguish postings between the two operations. With an impeachment inquiry in the field, that aggressive media role can produce more than favorable media articles. It can become the basis for actual impeachment articles.

Biden family business associates testified before Congress today, and they did not hold back. It’s all part of the Biden Impeachment proceedings. The witnesses provided direct evidence of Joe Biden’s involvement in the influence-peddling scheme. From text messages to conference calls, Joe Biden used his position of power to line his pockets.
