Eric Holder’s Justice Department threatened Fox News Reporter James Rosen as a co-conspirator under the espionage act. Except Holder never really intended to charge Rosen. It was all a pretext to spy on his phone calls and emails to find out who in the government was leaking information to him.

The Obama administration also spied on the phone records of Associated Press journalists.

This week Joy Behar, of all people, outed James Clapper for spying on the Trump campaign. Clapper claimed Trump should be happy about this because his agent was really spying on Russians.

Antonio F. Branco was born in 1956 in Fort Bragg, California, and raised in the small California logging town of Point Arena. He joined the US Army MP Corps in 1975 and was honorably discharged in 1978.

Branco attended Woodland Hills college briefly before moving to the Northwest. His beginnings in cartooning came while working at a sawmill in Sedro-Woolley, Washington.

Former AG Eric Holder: Just When You Thought He Was Gone, He’s Back

Oh my goodness. Obama has been spouting off, talking about the lack of scandals during his administration.

Huh?

Perhaps Barry has a case of early onset dementia?

Columnist Jeff Jacoby at The Boston Globe clears up that whopper:

Barack Obama’s super-secret speech at MIT last month — the one that was so far off the record that no one was permitted to stream it, or talk about it to the press, or comment about it on social media — contained nothing that remotely justified such hugger-mugger.

With hundreds in the audience, of course the speech was surreptitiously recorded and leaked.

. . .

And he declared that his administration had been scandal-free.

“We didn’t have a scandal that embarrassed us,” Obama said. Sure, there were occasional mistakes and screw-ups, “but there wasn’t anything venal in eight years.”

Obama, his former aides, and his media devotees have been making this claim for years. With so much repetition, it has become a popular urban legend. But popularity isn’t truth. 

Jacoby goes on to list the Obama era scandals, and first on the list is — ta duh! — “Operation Fast and Furious”!

In a botched “gunwalking” sting, the Justice Department allowed thousands of guns to be sold to suspected smugglers, in the hope of tracing them to Mexican drug cartels. But the Obama administration lost track of the weapons, many of which later turned up at crime scenes in which scores of people were murdered. Among the dead: US Border Patrol Agent Brian Terry, killed by drug gangsters in 2010. Compounding the scandal was Attorney General Eric Holder’s refusal to turn over documents relating to the operation, a refusal for which he was held in contempt of Congress.

Yep. That scandal with Eric Holder right in the middle of it.

And we should all remember the DOJ case against the New Black Panther party, accused of thuggery and voter intimidation. Holder went easy on them and refused to prosecute, accusing Republicans of racism.

Blah blah blah.

If all else fails and you have no substantive argument, what’s the solution? Yell “RACISM!!!!”

And who can forget Holder began his tenure with the ever-popular “Nation of Cowards” speech?

AG Holder told the throng gathered at the justice Department concerning race and Black History Month:

Though this nation has proudly thought of itself as an ethnic melting pot, in things racial we have always been and continue to be, in too many ways, essentially a nation of cowards.

Just swell. Start a job as our nation’s top cop by calling America a “nation of cowards.”

But what would you expect from a former college radical? Obama was a member of the pot-smoking “Choom gang” — which might explain why he has no memory of any scandals during his tenure — and his buddy Eric H participated in his own anti-establishment, anarchist revelry.

As a freshman at Columbia University in 1970, future Attorney General Eric Holder participated in a five-day occupation of an abandoned Naval Reserve Officer Training Corps (ROTC) headquarters with a group of black students later described by the university’s Black Students’ Organization as “armed.”

Holder was then among the leaders of the Student Afro-American Society (SAAS), which demanded that the former ROTC office be renamed the “Malcolm X Lounge.” The change, the group insisted, was to be made “in honor of a man who recognized the importance of territory as a basis for nationhood.”

Black radicals from the same group also occupied the office of Dean of Freshman Henry Coleman until their demands were met. Holder has publicly acknowledged being a part of that action.

Holder has bragged about his involvement in the “rise of black consciousness” protests at Columbia.

And this is the guy BHO chose to be the United States Attorney General? Sheesh.

Even now Holder refuses to just go away and has been piping up and tweeting that Trump better not fire Mueller!

Well, to ensure a fair and accurate accounting, it should be noted that, unlike Elvis, most of Obama’s boys (and girls) never left the building.  Eric (the Red) Holder, of course, relocated to the People’s Republic of California, the only state in the U.S. that recognizes no extradition treaty with the federal government. But even the California Assembly, otherwise known as the Golden State Politburo, eventually gave Holder the boot, although the Senate retained his so-called “valuable services” apparently for the sole purpose of ramrodding Cali’s ongoing legal subversion against the Trump administration.

I, for one, wish that Obama and gang would leave “the building” and stay gone. Maybe they could all accompany Rep. Hank Johnson to Guam?

The Mainstream Media is hungering for another big Trump-bashing story. The Trump-Russia Collusion scandal turned out to be a non-starter, nothing but lefty wishful thinking gone viral. And all the apologies from the Progressive PR Arm — aka MSM? Uh…no. Crickets.

Now they’re running like a bunch of crazed worker ants that just discovered an untended picnic basket full of honey and other sweet stuff. The big data-mining scandal is now all the rage.

But seriously? Is there anyone on the planet who didn’t understand if you sign up for one of the Facebook apps, you have to agree to share your information (that would be data) with them. Hello? Anyone home McFly?

Obama and his team did that very data-mining thingy and were lauded by everyone in Hollywood and the press.

Nancy Pelosi can chalk up another sound bite to the Really Stupid Comments Hall of Fame. Pelosi waxed ignorant in response to the $1,000 bonuses paid out to American workers post Trump tax cut.

The botoxed Left Coast Lefty explained:

In terms of the bonus that corporate America received, versus the crumbs that they are giving to workers to kind of put the schmooze on, is so pathetic. It’s so pathetic.

I think it’s insignificant.

In the words of my dear dad, “IS SHE NUTS??” (rhetorical question)

Rep. Pelosi herself is worth between $29 million (per wikipedia) and $193 million (per Investment Watch), with The Atlantic citing a cool $74 million. I guess if I had $74 million I would consider $1,000 crumbs.

But to us normals, Nan, $1,000 is almost a month’s rent/mortgage. That would pay my electricity bill for the year. I’ve got news for you Your Royal Frozen-Faceness, $1,000 is a very big deal.

And just a few short years ago, in 2011, the very same Rich Representative proudly praised Obama:

Today is a victory for all Americans – for the security of our middle class, for the health of our seniors, and for economic growth and job creation.

The American people spoke out clearly and, thanks to President Obama’s leadership, 160 million Americans will continue to receive their payroll tax cut – nearly $40 per paycheck in the pockets of the average family.

I salute the work of the unified House Democratic caucus on behalf of the American people.

Let’s consider that. $40 per paycheck, on average, multiplied by 26 paychecks, is $1,040. So a savings of $1,040 for an entire year is cause for celebration when Obama is king…uh..president. But $1,000 bonuses PLUS increases in paychecks over the course of the year, is crumbs under President Trump.

I see how you roll.

National Review summed up Pelosi’s meager kingdom (I kid):

But she also happens to be one of the body’s wealthiest members: In Washington, she lives in a multimillion-dollar Georgetown condo; she owns a 16-acre vineyard in Napa Valley and a 3,700 square-foot house in San Francisco’s tony Pacific Heights, according to her May 2015 financial disclosure statements.

So every time Representative Pelosi bad mouths Trump and anyone else successful, think pot and kettle. Also remember, the modus operandi of The Left: nurture and feed a mentality of envy, thereby causing division and a deep desire to see whomever Progressives paint as “greedy fat cats” stripped of their lawfully acquired wealth, which should then be redistributed at the government’s whim.

That’s the battle cry of Pelosi and Bernie and good old Fauxcahontas. They yell “SQUIRREL!!!” (or wealthy) and paint every conservative policy as a money-grubbing, greedy ploy. Well sorry, Nan. You can’t fool us normals, us deplorables. $1,000 plus larger paychecks is something to be thankful for.

Could you just please go back to your vineyard and prep for your next Botox appointment? Drink some wine? Let the grownups who understand solid economics carry on the serious work as public servants.

The Left has been crying and whining since the election. They called good Americans “Deplorables.” They staged a sit in to protest gun violence, and simply looked like a bunch of petulant children in dire need of a whoopin’.

Maxine Waters screams incessantly (and usually on MSNBC, that wholly ‘impartial and objective’ channel…not) “Impeach him!”

Many of the Dems boycotted the inauguration in January 2017.

The Democrats that actually attended sat there grimacing and pouting, once again looking like petulant, spoiled brats. The Congressional Black Caucus attempted to “resist” by wearing “kente cloth” in protest to Trump’s s-hole countries comment. For the most part, the Dems sat on their hands rather than applaud the low African American unemployment, low Hispanic unemployment, and high rate of economic growth in America. 

What The Left is broadcasting loud and clear is a hatred of Trump that supersedes any other emotion or motive — including love for America and Americans.

It looks like we might not have corrupt campaign funding to kick around anymore. The 2020 presidential field is filling up with billionaire celebrities who can fund their own campaign corruption. And that’s not to mention the free publicity they’ll get.

Oprah gave a speech at the Golden Globes setting off speculation she wants to be president. Her celebrity colleagues went wild. Presumably she’ll run as a Democrat.

The speech made by the U.S. president in his maiden address on the U.N. arena in the prevailing serious circumstances, in which the situation on the Korean Peninsula has been rendered tense as never before and is inching closer to a touch-and-go state, is arousing worldwide concern.

Shaping the general idea of what he would say, I expected he would make stereotyped, prepared remarks a little different from what he used to utter in his office on the spur of the moment as he had to speak on the world’s biggest official diplomatic stage.

But, far from making remarks of any persuasive power that can be viewed to be helpful to defusing tension, he made unprecedented rude nonsense one has never heard from any of his predecessors.

A frightened dog barks louder.

I’d like to advise Trump to exercise prudence in selecting words and to be considerate of whom he speaks to when making a speech in front of the world.

The mentally deranged behavior of the U.S. president openly expressing on the U.N. arena the unethical will to “totally destroy” a sovereign state, beyond the boundary of threats of regime change or overturn of social system, makes even those with normal thinking faculty think about discretion and composure.

His remarks remind me of such words as “political layman” and “political heretic” which were in vogue in reference to Trump during his presidential election campaign.

After taking office Trump has rendered the world restless through threats and blackmail against all countries in the world. He is unfit to hold the prerogative of supreme command of a country, and he is surely a rogue and a gangster fond of playing with fire, rather than a politician.

His remarks which described the U.S. option through straightforward expression of his will have convinced me, rather than frightening or stopping me, that the path I chose is correct and that it is the one I have to follow to the last.

Now that Trump has denied the existence of and insulted me and my country in front of the eyes of the world and made the most ferocious declaration of a war in history that he would destroy the D.P.R.K. [Democratic People’s Republic of Korea], we will consider with seriousness exercising of a corresponding, highest level of hard-line countermeasure in history.

Action is the best option in treating the dotard who, hard of hearing, is uttering only what he wants to say.

As a man representing the D.P.R.K. and on behalf of the dignity and honor of my state and people and on my own, I will make the man holding the prerogative of the supreme command in the U.S. pay dearly for his speech calling for totally destroying the D.P.R.K.

This is not a rhetorical expression loved by Trump.

I am now thinking hard about what response he could have expected when he allowed such eccentric words to trip off his tongue.

Whatever Trump might have expected, he will face results beyond his expectation.

I will surely and definitely tame the mentally deranged U.S. dotard with fire.

Every time President Trump scores a great success — such as his address to a joint session of Congress, his trip to Saudi Arabia and Israel, or his recent speech in Poland — another damaging leak lands on the front page of The New York Times or the Washington Post.

Is this a coincidence?

Not according to my sources in Washington. They tell me that Trump’s enemies in the Deep State — mostly Obama holdovers and Hillary supporters in the bureaucracy — have been saving up the leaks and timing them in a deliberate effort to upstage the president.

This time around, the leak was about Trump’s oldest son Donald Jr. According to a front-page story in The Times, the younger Trump met with a Russian lawyer who promised to give him damaging information on Hillary.

The Times naturally interpreted the meeting as an example of collusion between the Trump campaign and the Kremlin.

Nonsense, say members of President Trump’s legal team. The meeting had all the markings of a set-up.

It appears to have been arranged by Fusion GPS, an American firm retained by Hillary’s campaign to develop opposition research on Trump. Fusion GPS was behind the now-discredited dossier concocted by a British intelligence agent to smear Trump. 

In any case, the leak dominated the media’s coverage of Trump’s speech in Warsaw, where he received a rapturous welcome and talked about God and family and the value of Western civilization. Trump’s critics on the Left took him to task for his emphasis on Western civilization. They complained it reminded them of a time when the West held sway over lesser peoples around the world.

I guess they think it’s more “civilized” to indulge in illegal leaks that harm our political system and damage our national security.

Sanctuary cities? That’s a constitutional ‘hell no’

You may not have heard of the “Nullification Crisis” that President Andrew Jackson faced in 1832. But there are many unfortunate similarities between it and what is happening today on immigration. From the unjustified obstruction of immigration law by some activist federal judges to the defiance of the federal government on sanctuary policies by governors and city mayors such as Ed Murray of Seattle, there are some interesting parallels — and lessons.

I was reminded of the Nullification Crisis recently on a tour of James Madison’s home, Montpelier, which is close to the University of Virginia in Charlottesville, Virginia. One of the docents related how President Jackson had visited Madison in the midst of his reelection campaign to get his advice. This crisis was about high tariffs which, before the implementation of the income tax in 1913 through the Sixteenth Amendment, was one of the main sources of income for the federal government.High tariff rates were resented throughout the South, particularly in South Carolina. While they benefited manufacturers in the northern states, they hurt the mostly agricultural southern states. Led by John Calhoun, South Carolina and other states asserted that they had the final authority to declare federal laws unconstitutional and thus null and void within their states. While Jackson was a moderate on tariffs and respectful of the rights states retained in our federal system, he was scornful of the nullification theory. He considered it an unconstitutional, “abominable doctrine” that “will dissolve the Union.”

In 1832, the nullifiers took control of the South Carolina government and passed the infamous “Ordinance of Nullification.” They expressed the same type of virulent hostility and contempt for (and defiance of) the Jackson administration and the tariff system that we are seeing today towards the Trump administration over enforcement of federal immigration law, including provisions against certain sanctuary policies. Those states and cities are pushing the same concept of nullification of federal law, although they are doing it in federal court.

As one would expect of Andrew Jackson, he reacted strongly to this threat from South Carolina, including issuing a Nullification Proclamation on Dec. 10, 1832. Nullification was “incompatible with the existence of the Union, contradicted expressly by the letter of the Constitution, unauthorized by its spirit, inconsistent with every principle on which it was founded, and destructive of the great object for which it was formed,” He wrote. The crisis was resolved by a compromise bill on tariffs that Congress passed in 1833 after passing the Force Bill, which gave the president the power to use state militias and federal forces against the nullifiers.

The similarity between these events and what is happening today are eerie. While there are many areas over which the states and the federal government share responsibility — or where the Tenth Amendment gives responsibility to the states — immigration is not one of them. Section 8 of Article I gives Congress exclusive authority to “establish a uniform Rule of Naturalization,” just as Section 8 gives Congress the exclusive authority to establish and collect all “Imposts and Excises” or tariffs. The states have no authority in these areas at all. They can no more dispute the immigration rules established by Congress than they could dispute the tariffs imposed by Congress back in 1832.

This makes perfect sense. Any other rule would produce chaos. Think of the enormous problems that would be caused by border states such as Texas or California deciding that they would ignore federal law and apply their own immigration rules to individuals coming across the Mexican border into the United States — or if states decided that they would impose their own tariffs on foreign goods coming into their states in addition to those imposed by the federal government. In fact, it was that kind of behavior that was restricting trade under the Articles of Confederation between states such as Virginia and Maryland that helped lead to the call for a constitutional convention.

When it comes to immigration and the entry of aliens into the U.S., Congress delegated to the president the extremely broad authority under 8 U.S.C. §1182 (f) to suspend the entry of any aliens or class of aliens into the U.S. if he believes it “would be detrimental to the interests of the United States.” As five dissenting judges at the Ninth Circuit Court of Appeals recently pointed out, there are a long series of decisions by the U.S. Supreme Court upholding the authority of prior presidents under this provision and severely limiting the ability of the courts to review the president’s decision.

Unfortunately, at the urging of certain states, the courts have in large part ignored the Constitution, federal law, and prior precedents. They are instead substituting their judgment for that of the president, and enjoining the president’s executive order by implementing a temporary halt to entry from certain terrorist safe havens. In essence, states such as Hawaii and Washington are turning to activist federal judges to nullify the exclusive authority of the federal government over immigration and the security of our national border — and those judges are complying.

The sanctuary policies implemented by cities such as San Francisco and Seattle also seek to nullify federal immigration law and obstruct its enforcement. 8 U.S.C. §1373 prohibits states and local jurisdictions from preventing their law enforcement officials from exchanging information with federal officials on the citizenship status of individuals they have arrested or detained. The Supreme Court upheld this provision in 2012 in Arizona v. United States.

Quite appropriately, Attorney General Jeff Sessions has announced that he will not award any discretionary federal grants from the Justice Department to cities that violate §1373. Seattle has filed suit, claiming that the federal government has no right to cut off its access to discretionary funding. The city also makes the meritless claims that its policy does not violate federal immigration law.

Sanctuary cities are claiming that Sessions is trying to force them to enforce federal immigration law and that the loss of federal funds would violate the holding in NFIB v. Sebelius (2012). This is the Supreme Court decision that upheld Obamacare but found that the Medicaid portion of Obamacare, which required states to significantly expand their Medicaid coverage or risk losing all Medicaid funding, violated the Spending Clause of the Constitution. The federal government was “commandeering” the states by compelling them to “enact or administer a federal regulatory program.”

But Sessions is simply trying to get states to not obstruct federal enforcement. That includes abiding by the ban contained in Section 1373. Sanctuary cities are trying to prevent federal officials from finding out about criminal alien murderers, rapists, and other violent criminals that these cities would apparently rather release than have picked up and deported so they cannot further victimize Americans. Section 1373 doesn’t force local law enforcement officials to notify federal officials when they detain an illegal alien; It simply says that local governments can’t ban law enforcement officials from doing so.

The spurious legal argument that §1373 violates the anti-commandeering principle was raised by the City of New York in a lawsuit against the federal government only 11 days after the provision became federal law. New York also had a policy in place that forbade city officials from transmitting information on the immigration status of any individual to federal immigration authorities. In City of New York v. U.S. (1999), the Second Circuit Court of Appeals threw out the city’s case because the federal law was constitutional and well within congressional authority on immigration.

As the court pointed out, §1373 does not compel “state and local governments to enact or administer any federal regulatory program. Nor has it affirmatively conscripted states, localities, or their employees into the federal government’s service.” The only thing the provision does is prohibit state and local governmental entities or officials from “directly restricting the voluntary exchange of immigration information with the INS.” A contrary holding would cause chaos: “If Congress may not forbid states from outlawing even voluntary cooperation with federal programs by state and local officials, states will at times have the power to frustrate effectuation of some programs.”

We can only hope that the current nullification crisis will also be resolved once and for all when all of the lawsuits being filed by the states to prevent the enforcement of federal immigration law reach the Supreme Court.

That is clearly what is happening here: sanctuary states and cities want to “frustrate effectuation” of federal enforcement of our immigration laws. The absence of such cooperation, as the Second Circuit said, would force federal officials to “resort to legal processes in every routine or trivial matter, often a practical impossibility.” This was the same type of resistance exhibited by local governments to Brown v. Board of Education: “a refusal by local government to cooperate until under a court order to do so.”

Furthermore, refusing to award sanctuary cities funds that have to be applied for and that are entirely discretionary within the judgement of the attorney general does not come anywhere close to “commandeering” a “State’s legislative or administrative apparatus for federal purposes,” which was the key factor in the NFIB decision. The Supreme Court said that there is no violation of the Spending Clause “when a State has a legitimate choice whether to accept the federal conditions in exchange for federal funds.”

States can make their own decisions on whether to apply for a portion of the $4.1 billion the Justice Department has available to local jurisdictions for improving their law enforcement programs. In fact, this situation raises even fewer concerns than a federal law that the Supreme Court upheld in South Dakota v. Dole (1987). That law provided that states would lose five percent of their federal highway funds if they did not raise the drinking age to 21. This was “relatively mild encouragement” compared to the Medicaid expansion in Obamacare, where the Court described the potential loss of all Medicaid funding as a “gun to the head.”

Similarly, when it comes to sanctuary cities, the Justice Department isn’t threatening the cutoff of any major entitlement funds such as Medicaid or even state highway funds. What’s at stake are discretionary grants that the states may or may not decide to apply for, and which the Justice Department may or may not choose to grant.

The Nullification Crisis was resolved when South Carolina rescinded its nullification ordinance after President Jackson issued his Nullification Proclamation. We can only hope that the current nullification crisis will also be resolved once and for all when all of the lawsuits being filed by the states to prevent the enforcement of federal immigration law reach the Supreme Court.

‘Circuits’ or ‘Circuses’? Here’s why we desperately need judicial reform at the circuit court level

With Supreme Court decisions erroneously regarded as the supreme law of the land instead of the Constitution, everyone on the Right is clamoring to ensure that Trump makes the best Supreme Court pick(s) possible. But given that well under one percent of all federal civil and criminal cases make it to the Supreme Court, decisions coming out of the 13 federal courts of appeals ostensibly (and again, erroneously) serve as “the law of the land” for many critical social and political issues, as we so painfully witnessed with last week’s “9th Circus” ruling.

That is why it is at least as an important to fill the federal circuits with originalist’ as it is for the Supreme Court. However, if Trump is going to leave his mark on the judiciary, that would require taking bold measures to overturn established traditions so that each appeals court nominee would be more in the mold of Clarence Thomas than even a Neil Gorsuch, much less a John Roberts or Anthony Kennedy.

Why the U.S. Court of Appeals is so vital

For those paying attention to how a mere district judge in one bad circuit can violate the national sovereignty, you need no tutorial on the importance of the lower courts.

In 2015, 54,244 cases were filed in the 12 regional courts of appeals (not including the specialized appeals court for the Federal Circuit) out of a total of 361,689 that began at the district level. At the same time, only about 80 cases were granted full review by the Supreme Court. In other words, the federal courts of appeals are ostensibly the court of last resort for most federal cases. And given that the Left has successfully redefined the Constitution, almost every political issue has become a federal case.partyof-deceit-spin-and-lies

Even though many of the major cases broadly affecting public policy are granted review by the high court, many languish in the lower courts for years and never make it to the Supreme Court. Moreover, the Supreme Court is clearly influenced by the jurisprudential momentum of the lower courts. Given that most of the circuits are full of post-constitutionalists who make Anthony Kennedy look like James Madison, it creates a peer pressure in the legal community to move away from the Constitution as written.

Keep in mind that most of the major cases of consequence pending before the Supreme Court have been appealed by conservatives because of bad lower court decisions.

Remember, gay marriage didn’t happen in a vacuum with the Obergefell case. Almost every district court and all but one of the circuits redefined marriage in one of the most anti-constitutional opinions of all time. We are witnessing a similar trend with lower courts chipping away at the “plenary power doctrine” on immigration in recent years.

Furthermore, justices will rarely take up a case expeditiously when there is no split decision among at least two circuit courts. Given that the lower courts are in such bad shape — with such a dearth of originalist — conservatives can rarely win in even one circuit on such bedrock issues as voter ID, religious conscience, and an array of immigration issues. The lower courts tee up the contours and the dynamics of the cases that reach the high court. Therefore, if we fail to change the personnel and the procedures of the lower courts, another two solid originalist on the Supreme Court (assuming one of the liberals dies or resigns from office) would have only a limited effect.

Keep in mind that most of the major cases of consequence pending before the Supreme Court have been appealed by conservatives because of bad lower court decisions. The tyranny begins and usually ends in the circuits. Given that Republicans have control of the federal government and most state governments, we will only be playing defense in the lower courts because that is where the Left will plant their flag, even more so than during the Obama era.

Where the circuits stand: An anti-constitutional circus

You could probably count on your fingers the number of true originalist (à la Clarence Thomas) on the circuit courts. While it’s arduous to game out the “ideology” of each judge and circuit, here is my preliminary attempt at an overview of the circuits.

First, we will begin with this infographic detailing the number of Republican appointees and Democrat appointees by circuit among active judges (not including semi-retired “senior judges”). The graphic also shows the strong influence of Obama’s eight years on the appeals courts and the immediate vacancies that can be filled by Trump.

U.S. Court of Appeals Judges

A few observations stand out.

1. Among active judges, Democrats now have an outright majority on nine of the 13 circuits.

And as we will explain in a moment, the courts are in worse shape than this topline number would suggest because almost every Democrat-appointee is a post-constitutionalist while only half the GOP-appointees are conservatives and only relatively small number are true originalist. Just consider how two GOP-appointed judges were already involved in the immigration ruling, one of the most radical and harmful decisions of all-time.

2. There are 20 vacancies that Trump can and should fill immediately.

But Obama’s presidency was so strategic that it will take a long time to swing back a single circuit. Only 10 of those 20 are Democrat vacancies that would tilt the balance of a seat and most are not in circuits that will fundamentally alter the balance of most three-judge panels.

3. The all-important D.C. Circuit is now 7-4 majority Democrat appointees, with four judges appointed by Obama alone.

The D.C. Circuit is the second most influential court in the land on constitutional issues. Worse, while there are some solid senior judges, Janice Rogers Brown is the only real originalist left among the active judges, with Brett Kavanaugh a mostly reliable conservative. The D.C. Circuit is going to be a dumpster fire for the indefinite future. Moreover, if you drill down into the district level, the District Court for the District of Columbia has an 11-0 Democrat majority among active judges!

Does Congress not realize it has the complete power to rein in rogue courts?

By the middle of the year, when all the current vacancies take effect, there will be 90 Democrat appointees, 69 GOP appointees, and 20 vacancies among active seats on the appeals courts. However, the circuit courts are really in much worse shape than even the top line numbers would suggest.

Remember, almost all of the cases in the appeals courts are decided by a randomly selected three-judge panel, which also includes the senior judges (although their caseload is reduced in varying degrees). While it is possible to request a full en banc review of a case by the full circuit, those reviews are relatively rare in most circuits. Due to the clear Democrat majority on nine of the circuits and the lack of originalist on most of those panels, the legal Left is almost always assured a favorable panel for whatever they are looking to do: redefine marriage, infringe upon religious liberty, throw out abortion regulations, block photo ID, etc.

On the other hand, we’d be lucky to find 15 originalist on the appeals courts who are every bit as conservative as the 90 Democrat appointees — and a number of Republican appointees — are liberal.

Now let’s take a look at the four circuits where there is a supposed GOP majority:

7th Circuit

This is the easiest one to game out. The 6-3 GOP majority is extremely deceiving. This circuit is home to the infamous Richard Posner, a Reagan appointee who quite literally believes that the Constitution as adopted is outdated and should be disregarded. He wrote the 7th Circuit’s tyrannical gay marriage opinion, among many other bad decisions.

Only two of the nine active judges can be considered reliable originalist across the board: Michael Kanne and Dianne Sykes. While many conservative legal theorists have respected Frank Easterbrook for many years, he has shown that he doesn’t believe in an individual right to bear arms. The rest of the Republican appointees range from progressive to unreliable. Thus liberals can pretty much rely on a favorable three-judge panel for almost anything they want.not-okay

6th Circuit

The 9-5 majority of GOP appointees is very misleading if one thinks this is an originalist-dominated circuit.

First, Judge Helene White, although appointed by Bush, is really a liberal Democrat who was selected by Michigan’s two Democrat senators as part of a deal. Jeffrey Sutton, another W appointee, wrote the court’s opinion upholding Obamacare. Out of the seven remaining GOP appointees, only Alice Batchelder could be counted among the most reliable originalist with a few others leaning conservative, such as Raymond Kethledge. Another conservative, Danny Boggs, just retired, so at best his vacancy will be a wash.

Thus, between the liberal active judges and a number of other liberal senior judges in this circuit, it’s hit or miss for conservatives in terms of getting a reliable three-judge panel. In fact, the far Left recently got a three-judge panel to say that transgenderism is settled law and helped promote Jill Stein’s crazy recount in Michigan!

5th and 8th Circuits

The only two circuits that could remotely be considered conservative are the 5th and 8th circuits. However, even the fifth is not as good as its numbers would suggest. The panel certainly has its share of solid judges, with Edith Jones, Priscilla Owen, Jennifer Elrod, and Jerry Smith. But last year, conservatives couldn’t even get voter ID past the full panel because a few GOP appointees joined with the Left.

The 8th Circuit is probably the best panel in the country. However, that makes the three vacancies on the court somewhat moot because they’d be better served on other courts.

The balance of power will not shift very soon

As you can see, although there is much hype surrounding the more than 100 vacancies on the court, they will not swing the balance in terms of the circuits. Only 20 of the vacancies are on appeals courts, of which only 10 are Democrat seats, and many of them are on circuits that are irremediably broken or on the 8th Circuit, which is already good.

Want to take back our sovereignty? Start by breaking up the Ninth Circuit

Moreover, the prognosis for the future is grim. Many Democrat judges will view Trump as anathema that they will not retire under his watch. A quick glance at the vacancy list shows that all five of the circuit court judges who retired since Trump won the election were Republican, as were most of the district court retirees. Thus the trend is not indicative of a host of opportunities to flip the balance of the circuits. Which is one more reason why we need wholesale judicial reform in addition to filling vacancies.

Trump must act soon to fill vacancies and demand originalist in the mold of Thomas

Nonetheless, it is important that Trump not wait the traditional six months or so to start the process of filling lower court vacancies. While I don’t believe it will fundamentally alter the balance of the courts, the better judges who are in the circuits make it more likely we will get lucky and have a decent three-judge panel for random, important cases.

However, if Trump is to make his appointments meaningful, he would have to depart from longstanding tradition that gives home state senators major input on nominees and allows them to potentially scuttle the nomination.

One of the reasons why we have many liberal judges from Republican presidents — such as Judge Robart, a W appointee — is because Democrat senators can “blue slip” any nominee from their state they dislike. Under Senate tradition, the Judiciary Committee will refuse to hold a hearing on any nominee that is officially opposed by the home state senators. This is why it’s so hard to get even a marginally conservative judge approved from blue states, much less someone in the mold of Clarence Thomas.

Even in red states with two GOP senators, the judicial nominees often reflect a legal mirror image of their political views, which are moderate at best. And in states with senators from opposing parties, Republicans have often cut deals to approve only those nominees who are acceptable to their home state Democrat senator.

The problem of home state RINOS and Democrats is further exacerbated by the fact that tradition tends to kick-em-out-of-officebind the president to maintaining state continuity in seats within a circuit court. According to CRS, just 13 percent of circuit court appointments since the Kennedy administration have changed state representation from the vacant seat. And it is downright mandated by law that every state has at least one judge on the given circuit court and that every nominee must at least reside within the circuit at the time of the appointment.

Trump would have to expend as much political capital trying to ‘appoint better judges’ in a meaningful way as he would by pursuing judicial reform.

Consequently, if a president wants to fill a vacant seat from a state with a Democrat senator, he would be constrained by tradition from filling it with someone from a state with two Republicans, thereby avoiding a blue slip problem.

To begin with, it’s so hard to find Clarence Thomases in this profession. The limitation of state allocation rules and blue slip obstruction are killers. This is why despite swearing every time we will do a better job “appointing better judges,” we wind up with more Kennedys and Roberts on the lower courts. It’s also why outside of the geographical areas of the fifth and eighth circuits, it’s hard to appoint a string of reliable conservatives. There are three vacancies from the 3rd Circuit, for example, but it will be very hard to fill them with originalist given the geographical problem.

As such, Trump would have to expend as much political capital trying to “appoint better judges” in a meaningful way as he would by pursuing judicial reform. Yet the latter would actually solve the problem in the long run.

It’s quite evident that we still need judicial reform, but in the meantime Trump would be wise to fill the vacancies aggressively on circuit courts and make it clear to Senate Republicans that they are to promote originalist with the same gusto that Obama used to confirm anti-constitutionalists.

President Donald Trump and newly approved Secretary of State Rex Tillerson are facing their first major disagreement after the president rejected former deputy national security adviser Elliott Abrams as Tillerson’s number two man at the State Department.

“Tillerson fought the president and went back to try to salvage it,” a source told The New York Post, claiming that Trump’s chief strategist Steve Bannon “did not want Abrams.”

Trump overruled Tillerson on Abrams after meeting with the two men at the Oval Office on Tuesday. Sources said the Tuesday meeting mostly concerned a foreign policy talk between Trump and Tillerson, and some time after that, the president changed his mind on Abrams.

During Trump’s 2016 campaign, Abrams who served in foreign policy positions for Ronald Reagan and George W. Bush, often criticized Trump and questioned his fitness for office.

Abrams, a senior fellow for Middle Eastern Studies at the Council on Foreign Relations and a regular contributor to The Weekly Standard, told Politico last March that he was in a quandry because he could not vote for either Trump or Hillary Clinton.

“1972 was the first time I was old enough to vote for president, and I did not vote,” Abrams said “Couldn’t vote for McGovern for foreign policy reasons, nor for Nixon because of Watergate. I may be in the same boat in 2016, unable to vote for Trump or Clinton.”

Abrams also outlined his concerns in a May piece, “When You Can’t Stand Your Candidate” for The Weekly Standard. The Post’s source said that some of Abrams’ writings also became an issue, even though they had not posed a problem earlier in the selection process.

“The White House leaked the fact that Trump was meeting with Tillerson and Abrams Tuesday, and that Abrams was Tillerson’s choice,” another source told The Post. “After the meeting the White House let people know the meeting went well, and it was a done deal. Then, with no warning, the White House pulls the plug. Tillerson must be furious.”

The argument appears to be the first major disagreement between Tillerson and Trump, who has also rejected personnel backed by Secretary of Defense James Mattis. Neither the White House or the State Department commented to The Post.

However, sources who have spoken with Trump told The New York Times that Trump is becoming more focused on whether people supported or opposed him during the campaign. In addition to Tillerson, Abrams was backed by Trump son-in-law and senior adviser Jared Kushner, Arkansas GOP Sen. Tom Cotton, and members of the pro-Israel lobbying group Aipac.

Sen. Rand Paul, R-Kentucky, however, has been saying for days that he would not vote to confirm Abrams and in fact would join others in filibustering his nomination because of his role in the Iran-Contra affair, the Iraq War, and other serious foreign policy issues.

President-elect Donald Trump announced Wednesday Sprint and a new company, One Web, will add 8,000 jobs in the United States. During brief remarks from his Mar-a-Lago estate in Palm Beach, Fla., Trump spoke about the news to assembled reporters.

“I was just called by the head people at Sprint. They are going to be bringing 5,000 jobs back to the United States,” Trump said. “They are taking them from other countries. They are bringing them back to the United States.

“Also, One Web, a new company, is going to be hiring 3,000 people. That’s very exciting.”

Trump also recently announced an American job-creating deal with SoftBank Corp., which owns Sprint. Trump said Wednesday that SoftBank CEO Masayoshi Son helped broker the deal regarding Sprint.

“A terrific guy. We appreciate it,” Trump said of him.

On the eve of a meeting between Trump and business leaders of the tech industry earlier this month, IBM announced plans to hire 25,000 people in the U.S. and invest $1 billion over the next four years.

Trump Takes The Lead In Major National Poll

Leftists are simply getting sick and tired of Hillary Clinton. What the media used to call “strong enthusiasm” for Hillary has plummeted since the FBI’s announcement of the continuing email investigation.

What does that mean? Trump is now up in the polls. A new ABC/Washington Post tracking poll shows 46 percent of likely voters support Donald Trump compared to 45 percent for Clinton. Libertarian candidate Gary Johnson now has 3 percent support (a new low) while Green Party candidate Jill Stein is at 2 percent.

The poll is actually even closer than one percent. Taking it to the decimal, as ABC reports, Trump has a zero-point-seven percent advantage.

These results are a two-point switch for the candidates since one day earlier and a dramatic change from one week ago. On Oct. 23, Clinton enjoyed a 50 percent lead over Trump’s 38 percent.

When asked how enthusiastic voters were about their candidate, Clinton fares much worse. On Oct. 22, 52 percent of Clinton supporters were enthusiastic about their candidate compared to 49 percent of Trump supporters. Now, 53 percent of Trump supporters are enthusiastic and only 45 percent of Clinton voters feel that way.

This poll is unique also because they asked a significantly larger number of Democrats than Republicans. “Partisan divisions are 38-28-29 percent Democrats-Republicans-independents.”

Nationally, there are a few more self-identified Democrats than Republicans, but the numbers hardly break that far to the left. And Independent voters are impossible to measure, since there is no “independent” presidential candidate.”

This is a close race, but vote preference even one week out is not necessarily indicative of election results. In the 2012 race, Romney was ahead of Obama by one point and President Obama went on to win by four percentage points.Happy Happy Joy Joy

Trump says there is a great danger of increased terrorism by allowing so many Muslim refugees into the country. He also said that they will take jobs away from American citizens, which in the long run will hurt the economy. For these comments, the liberal media and politicians claim that Trump is full of hate and is insensitive for those comments.

I have friends in Great Britain who have told me that the issue of refugees and the huge number of immigrants pouring into their country had a large part for the people of Great Britain voting for Brexit. They voted to leave the European Union in hopes that they could stop the influx of refugees and immigrants because of the disastrous effects they cause.

A recent Pew Research Center report supports Trump’s fears and warnings. They polled people in a number of European countries, all of which have been experiencing the effects of welcoming refugee and their responses should be a warning for America.

Forty percent of the people in Spain agreed while Hungary, who has been flooded with thousands of refugees, had an 76% affirmative response. Our military needs to start protecting America instead of other countries, many of who vow our destruction. This plan only leaves the cost of materials for the wall, drastically reducing the high cost that liberals claim as being unreasonable. I see this as a win-win-win solution. Then we need to shut all of our ports of entry and refuse to take any Middle Eastern refugee. That’s not being un-American or insensitive, it’s being responsible and protective of our country, our economy, our safety and our people.

WASHINGTON – Businessman Donald Trump has told several top Republicans that he will swear off the possibility of an independent bid and commit to running his presidential campaign under the party’s banner, according to several sources. Such a move could endear Trump further to Republican voters who have remained skeptical about his allegiance to a political party he joined relatively recently. Trump had drawn sharp criticism from GOP leaders concerned that a third party bid would effectively guarantee a Democratic win in the general election.

“I know you don’t need any advice, but I’m going to give you some. You will do better in the Republican primaries if you just swear off the third party, because a lot of Republicans will never vote for someone who, like Ross Perot, will hand the election to a Democrat,” influential radio host Hugh Hewitt told Trump during an interview in early August.

“I’ve never heard it put so strongly,” Trump responded. “When you said it the way you said it, that’s very interesting, so I’ll be thinking about that.”

Michael Cohen, a top Trump aide, did not go so far as to confirm that the businessman would take the step of forsaking a run as an independent. But he did tell The Huffington Post that Trump never had “any intent” of campaigning as anything other than a Republican. “He just wanted to ensure that the establishment would treat him as fair as they would treat any of the other candidates,” Cohen said. “And I believe, right now, they are treating him fairly. It is my personal belief that the RNC is treating Mr. Trump the same as the other candidates, and he will live up to his agreement not to run as an independent.”

Trump, for his part, has long said that he was holding out the possibility of an independent run as leverage. But according to sources, he has since determined that the threat was harmful to his current chances.

A spokesman for the Republican National Committee did not return a request for comment.

A top Republican source, however, cautioned that any decision Trump will reportedly make should be considered a loose commitment at best, since he is known for his political impulsiveness. A stray insult from a fellow Republican could, theoretically, change his calculus.

“[Fox News Chairman and CEO Roger] Ailes thought he had a deal, too.  Then Trump called Megyn Kelly a bimbo, again,” noted one GOP operative, referencing the supposed truce between the network chief and Trump. Asked specifically if Trump would be making a formal announcement, Cohen replied, “Only Mr. Trump can sign that oath. And when he does, you can rest assured, he will live by it.”

During an interview with Hewitt on Wednesday after this story was published, Trump was asked about it  whether he would forgo an independent run. “It’s not something I want to do and at some point I will actually totally commit,” he said, in reference to formally running as a Republican.  “I didn’t think it was appropriate to commit during the debate,” he went on. “You know, I was a little surprised they even asked me at the debate but that was OK. But at some point, look, I want to run, I’m leading in the polls by a lot, I want to run as a Republican.  I want to get the nomination and I want to beat the Democrats.”

donald-trump2Donald Trump has catapulted to the lead in the race for the Republican presidential nomination by focusing on two popular issues:

  • Proposing the building of a wall along the Mexican border to stem the overwhelming influx of illegal immigration,
  • Attacking the Stalinesque doctrine of “political correctness” that increasingly inhibits freedom of expression in the U.S.

His approach has been very effective so far. But it’s time for Trump to open up a new offensive front.

  1. If I had his ear, as I have once or twice in the past, I would advise Trump to say, as the future president, he would refuse to raise the debt limit to force Washington to live within its means like every American family and business is forced to do. He should say that $18 trillion is too much, and that continued borrowing by the federal government is completely unsustainable. The only way to dig out of this hole is to stop borrowing, and, as president, he will not request or approve any future hike in the debt limit.
  2. He should also allay fears on Wall Street that such an action will result in a default by ensuring that Washington, under his leadership, will continue to service the existing debt.
  3. And, lastly, he should characterize this action as a great opportunity to return to constitutionally limited government by cutting government spending and programs that never should have been started in the first place.Spiraling

In 2008, I gave this same advice to a Republican presidential candidate Herman Cain. He used it in a debate and established himself as a frontrunner jfkuntil questions about his personal life forced him to retire from the race. Imagine, however, the power of Donald Trump’s voice on this critical issue in 2015. He is already the unchallenged frontrunner in the GOP race. His every utterance grabs the attention of the media. And, this proposal is radical. It is as anti-establishment as his positions on illegal immigration and political correctness. I dare say that this third major pillar in his campaign to “Make America Great, Again” would make him next to unbeatable.

I’ve been working on this anti-debt campaign since 2011, shortly after the Republicans swept into power in the House of Representatives. I called it the “No More Red Ink Campaign.” It has generated more than 1 million letters to Republican lawmakers in Washington so far. I pointed out that Republican approval was essential to Barack Obama’s plans to continue borrowing and spending without restraint. All Republicans in Congress had to do – even in just one of the two houses they control – was to say no to more borrowing. Instead, they have provided Obama all of the resources he needed to launch Obamacare, fund Planned Parenthood, grow anti-business regulatory departments like the Environmental Protection Agency, push Common Core through the Department of Education and so on.

Donald Trump, with the power of his platform, could make this issue a focus of national attention, propelling his candidacy forward injusticewith a new offensive front that would leave his competitors staggering. And, the neat thing about it? It’s the right thing to do. It makes perfect sense. It’s like a magic bullet politically. It solves the seemingly unsolvable problem of runaway growth of government, which inevitably brings with it restrictions in personal freedom and subjugates the legitimate powers of the states to Washington.

I am persuaded that, if framed properly, this issue would make the Trump campaign unstoppable. He would not only increase his support among Republican voters but win over many disillusioned Democrats the way Ronald Reagan did in 1980 and 1984.

Trump has been successful to date in this campaign because he has been bold. This is no time for him to stop. It’s time for him to expand his base by claiming the high moral ground on other big issues.Default

Like it or not, America’s spiraling, out-of-control debt is not only an issue the next president will have to deal with, it also represents a great opportunity for leadership in restoring the country’s heritage of constitutionally limited government. And it’s something the president can do singlehandedly – forcing Congress to make deep cuts in overspending, over-regulation and social engineering.

Republican presidential candidate Donald Trump was dumped from a prime speaking role to an important gathering of conservative activists on Friday for his criticism of Fox News anchor Megyn Kelly after a combustible debate performance.  Trump was scheduled to deliver the keynote address on Saturday night at a conference in Atlanta organized by RedState, an influential conservative group.

Trump’s campaign fired back at RedState chief Erick Erickson twice after the GOP front-runner was dumped from RedState’s schedule. In the second statement, issued Saturday morning, Trump’s team said:

“Not only is Erick a total loser, he has a history of supporting establishment losers in failed campaigns so it is an honor to be uninvited from his event. Mr. Trump is an outsider and does not fit his agenda.

“Many of the 900 people that wanted to hear Mr. Trump speak tonight have been calling and emailing — they are very angry at Erickson and the others that are trying to be so politically correct. To them Mr. Trump says, We will catch you at another time soon.'”TMSHorsey0617_1434644296235_20064964_ver1_0_640_480

Erickson said he disinvited Trump from the event because of what he described as “demeaning” remarks about Kelly, who was one of three moderators during the first major Republican debate on Thursday night in Cleveland. “While I have tried to give him great latitude, his remark about Megyn Kelly was a bridge too far,” Erickson said.  Erickson said he had invited Kelly, one of Fox’s highest profile anchors, to attend his conference in Trump’s place.In an initial response to Erickson, Trump’s team labeled the move as “just another example of weakness through being politically correct.  For all of the people who were looking forward to Mr. Trump coming, we will miss you. Blame Erick Erickson, your weak and pathetic leader.”

During the debate, Kelly asked Trump to respond to derogatory statements he had made in the past about women, calling them “fat pigs” for example. Trump tried to wave off the question and dismissed Kelly during a raucous debate performance.

“And honestly Megyn, if you don’t like it, I’m sorry,” Trump said. “I’ve been very nice to you, although I could probably maybe not be, based on the way you have treated me. But I wouldn’t do that.”

Erickson said in a Facebook statement that in a CNN interview Trump said of Kelly: “You could see there was blood coming out of her eyes. Blood coming out of her wherever.”  “His comment was inappropriate,” said Erickson.

“It is unfortunate to have to disinvite him. But I just don’t want someone on stage who gets a hostile question from a lady and his first inclination is to imply it was hormonal. It just was wrong,” he said.

“He is not a professional politician and is known for being a blunt talker. But there are even lines blunt talkers and unprofessional politicians should not cross. Decency is one of those lines.”

A variety of Republican presidential candidates have been speaking at the Red State gathering in Atlanta and Trump was scheduled for a prominent appearance.

Shortly before Erickson’s statement, Trump’s campaign had just put out a media advisory with the schedule for Trump’s appearance.

The New York billionaire has been riding high in the polls in recent weeks as Republican search for their nominee to face the Democrats’ choice in the November 2016 election.

Carly Fiorina, the business executive who is the only woman running for the Republican nomination and who spoke to Red State on Friday, applauded Trump’s dumping.

“I stand with @megynkelly,” she tweeted.
