Uncertainty, Disarray Cloud Biden Border Policy as New Rules Take Hold

The Biden administration began implementing a sweeping policy shift at the U.S.-Mexico border on Friday as a COVID-era order that had allowed the swift expulsion of many migrants expired and new asylum restrictions took effect amid confusion and uncertainty. Several last-minute court actions added to questions about how President Joe Biden’s reworked border strategy will play out, with advocates filing a legal challenge to the new asylum regulation as it was enacted.

Facing concerns that the end of a 3-year-old order – known as Title 42 – could further strain U.S. border facilities, cities and towns, U.S. officials were keeping a close eye on the movements of migrants that had already reached record numbers in recent days.

“We continue to encounter high levels of non-citizens at the border, but we did not see a substantial increase overnight or an influx at midnight,” when Title 42 expired, U.S. Department of Homeland Security (DHS) official Blas Nunez-Neto told reporters on Friday.

Seeking to discourage migrants from traveling to the border, the Mexican government said its national migration institute has ordered its offices not to issue immigration documents or other permits enabling travel within the country, creating another obstacle for migrants. Though a chaotic race to U.S. border ports of entry on Thursday appeared to have given way to relative calm on Friday, there was a sense of confusion among some migrants.

At the U.S. border fence dividing El Paso, Texas, from Mexico’s Ciudad Juarez, hundreds of migrants who had slept there overnight formed a single file line to be brought into the U.S. by authorities and put on buses. Texas National Guard, state troopers and border agents patrolled the area. Immigration advocates represented by the American Civil Liberties Union filed a legal challenge against the new asylum bars, claiming they violate U.S. and international laws.

Advocates argue the new regulation, put in place by Biden’s Democratic administration to curb illegal crossings, resembles restrictions imposed by his Republican predecessor, Donald Trump, that they had successfully blocked in court. U.S. Homeland Security Secretary Alejandro Mayorkas defended the Biden regulation, saying it aims to encourage migrants to enter using legal pathways. “It’s going to be a tough transition,” he told MSNBC.

U.S. asylum officers hurried to figure out the logistics of what would be required to apply the new asylum regulation. Returns of some migrants to Mexico – Cubans, Haitians, Nicaraguans and Venezuelans – were due to begin on Friday under the new border provisions, a homeland security official said.

SCRAMBLE AHEAD OF THE CHANGES

In chaotic scenes on Thursday, migrants scrambled to enter the country before the new rule went into effect. The regulation presumes most migrants are ineligible for asylum if they passed through other countries without first seeking protection elsewhere, or if they failed to use legal pathways for U.S. entry, which Biden has expanded.

Tens of thousands of migrants this week waded through rivers, climbed walls and embankments onto U.S. territory. In San Diego, a Colombian man, who was among asylum seekers taken to a hotel for processing, said he and his wife crossed on foot east of Tijuana and spent four nights outside. He was granted an asylum hearing in 60 days and paroled.

“We didn’t have anywhere else to go,” said the man, who described himself as a former Colombian air force member who had been threatened by armed groups in his homeland.

Around 25,000 migrants were being held in U.S. Customs and Border Protection facilities near the border on Friday, down slightly from record highs earlier in the week, according to the National Border Patrol Council, a union for agents. About 10,000 migrants per day were reported crossing illegally this week.

A 17-year-old Honduran boy died after being found unconscious in a Florida shelter on Wednesday, according to the U.S. Department of Health and Human Services. Unaccompanied children are exempt from the new regulation, and advocates have warned that parents might send their children across the border alone.

COVID EMERGENCY ENDS, ASYLUM BAN BEGINS

Trump first implemented Title 42 in March 2020 as COVID swept the globe, with U.S. health officials saying it was needed to curb the spread of the virus in detention facilities. The order allowed American authorities to quickly expel migrants to Mexico or other countries without a chance to request asylum.

Some Democrats and immigration advocates say Biden’s new regulation is too harsh. The measure also counters previous statements Biden made in 2020 on the campaign trail, when he said he thought it was “wrong” for people not to be able to seek asylum on U.S. soil.

Biden, who campaigned on reversing Trump’s policies and is now running for re-election in 2024, kept the order in place until now.

Migrants have been expelled more than 2.7 million times under Title 42, although the total includes many repeat crossers.

Mexico has generally only accepted certain nationalities – its own citizens, migrants from northern Central America and more recently migrants from Venezuela, Cuba, Haiti and Nicaragua. So, during the same period, around 2.8 million migrants ineligible for expulsion were allowed into the United States under a process known as Title 8 to pursue their immigration claims in court, which can take months or years.

Republicans fault Biden for easing Trump’s more restrictive policies, while the Biden administration has blamed Republicans for blocking legislation to reform the immigration system.

Trump Surges to 3-Point Lead over Clinton in L.A. Times Tracking Poll

The result is still within the poll’s margin of error. The “Daybreak” poll methodology is described as follows:

The USC Dornsife/L.A. Times Presidential Election “Daybreak” Poll asks more than 400 people each day about their voting intentions. The poll is part of the Understanding America Study (UAS) at the University of Southern California’s Dornsife Center for Economic and Social Research.

Each day’s poll respondents are a subset of the UAS election panel, roughly 3000 U.S. citizens who were randomly recruited from among all households in the United States. Respondents are asked three predictive questions: What is the percent chance that (1) you will vote in the presidential election? (2) you will vote for Clinton, Trump, or someone else? and (3) Clinton, Trump or someone else will win?

Tuesday’s poll had 2,665 respondents.

Trump’s largest lead in the poll has been 7.3 points, recorded on July 28 during the height of the Democratic National Convention in Philadelphia. From there, Trump fell steadily for over two weeks, hitting a low of 41.6% as Clinton hit a high of 46.3% on Aug. 14. The poll results narrowed after that, but the results for the past two days show an unusually large shift in Trump’s direction.

The improvement in Trump’s numbers follows a weekend in which Clinton referred to half of Trump’s supporters as a “basket of deplorables,” and appeared to collapse at the 9/11 Memorial in New York City, raising serious concerns about her health.

The Obama administration has decided to implement a “surge” in Syrian refugees, fast-tracking the arrival of those fleeing civil war in that country to make good on its commitment of bringing 10,000 by the end of fiscal 2016.

The “surge” is needed because the administration has delivered only 1,411 in the first six-and-a-half months of the year. The Obama administration’s scripted answer for anyone who questioned its ability to screen Syrian “refugees” was that they are the “most thoroughly vetted” of all immigrants, going through an arduous process that takes 18 to 24 months to complete.Bull

But that process was taking longer than expected and making it impossible for Obama to make good on his promise to the United Nations to admit at least 10,000 Syrians in fiscal 2016. To fulfill its promise, the administration has now decided to expedite the process, cutting the screening period from 18-24 months down to three months.Oh good

Administration officials have set up special screening centers in Jordan, where they will be interviewing potential Syrian refugees at a rate of 600 per day. To realize the goal of 10,000 Syrian refugees coming to the U.S. by Sept. 30, the government will need to deliver 8,589 by that date, or an average of 358 per week.Do you want

FBI Director James Comey has testified before Congress that even with the longer 18-24 months of vetting, it was impossible to verify the identities of the vast majority of Syrian refugees.

The top states for Syrian refugee resettlement over the first six months of the fiscal year have been Michigan with 173, California with 138, Pennsylvania with 126 and Illinois with 98. But those numbers are now expected to balloon quickly. Michigan alone is in line to receive at least 5,000 Syrians this year. Just in the last 10 days, Missouri has received 16 Syrians, Ohio has received 14, Arizona 12, Illinois 11, Pennsylvania nine, Michigan seven and Indiana five. Michigan is receiving the largest number this year even though GOP Gov. Rick Snyder has informed Obama he doesn’t want any Syrian refugees, citing the security risks.

By expediting the vetting period, the administration hopes to increase by nearly 10-fold the number of Syrians it brings to the U.S. in the second half of the fiscal year, which ends Sept. 30.

Gina Kassem, the regional refugee coordinator at the U.S. embassy in Amman, Jordan, told the Associated Press that while the 10,000 target applies to Syrian refugees living around the world, the majority of those being resettled in America will be coming from refugee camps in Jordan. And the number of Syrians delivered to the United States could go above the target of 10,000.

More than two dozen mostly GOP governors informed Obama after the Paris terror attacks last November they didn’t want any Syrian refugees delivered to their states, but the administration said the states have no authority to stop the program from being carried out.Bull

Former Rep. Michele Bachmann, whose home district in Minnesota has been flooded with Somali refugees over the past 20 years, was one of the first lawmakers to warn of the security risks associated with the importation of refugees from jihadist hotbeds in the Middle East and Africa. Dozens of refugees have been arrested for providing material support to overseas terrorists over the past few years.

“President Obama is doing everything within his power to advance an Islamic invasion of the U.S., primarily made up of Muslims emanating from global terror hotspots,” Bachmann told WND.

“We on the House Intelligence Committee warned a year ago that Syria is incapable of vetting people for terrorism detection,” Bachmann said. “It is impossible because Syria has no database of records for the U.S. to peruse, and the U.S. has no embedded human intelligence in Syria.”

ISIS, meanwhile, has accumulated a cache of fake passports. They have used these passports to infiltrate Europe, and critics of the administration like Bachmann warn they will duplicate the same successful strategy to infiltrate the United States.

“We also know ISIS captured actual Syrian passports and the actual machines used to create Syrian passports,” Bachmann said. “The terrorists have the means within their control to create legitimate passports for fellow terrorists.

“This should be sufficient information to stop any migration to the U.S. from Islamic terror dominated nations.”

ISIS operatives have bragged they have already embedded 4,000 refugee terrorists in Europe.

“The same will be true for the U.S.,” Bachmann told WND. “We U.S. taxpayers are paying dearly for our own destruction.

“Why isn’t Obama singling out persecuted Christians for a ‘surge’ mission of mercy?” she asked.

“Christians are the true Middle East victims of Islamic genocide. Instead, Obama chooses likely terrorist aggressors to bring to America,” she said.

Also troubling is the fact that most Syrian Muslims hate Jews and the state of Israel, Bachmann said.

“They are people who are dedicated to overthrowing American laws in favor of 7th century Islamic laws of oppression,” she added. “They seek to destroy Judaism and Christianity. They seek to destroy America. Europe is our preview, and Europe’s fate, under Obama will be our own.

Many of them have been fast-tracked and some in Congress have openly worried about the risks of a Syrian traveling from Canada to the U.S. through the porous northern border to carry out terror attacks.
