With Fact-Checks Like These, How Does Truth Stand a Chance?

Below is my column in The Hill on the controversial role played by the ABC moderators in the presidential debate. Three false claims in the debate continue to be repeated in what is now our post-truth political environment. (ABC later challenged another claim by Harris on the deployment of U.S. troops).

Here is the column:

“You are entitled to your opinion. But you are not entitled to your own facts.”

That famous line from Sen. Daniel Patrick Moynihan (D-N.Y.) remains a virtual mantra for politicians and pundits. Yet, judging from the presidential debate between former President Donald Trump and Vice President Kamala Harris, we have officially entered the post-truth political era. ABC News has been widely criticized for the bias of the two moderators Linsey Davis and David Muir. Even liberal outlets acknowledged that the two journalists seemed inclined to “fact check” only Trump. In the meantime, they allowed clearly false statements from Harris to go unchallenged.

Three of the unchecked claims are being widely disseminated by supporters, including some in the media. Here are three legal “facts” that are being repeated despite being clearly untrue.

Crime is down under the Biden-Harris administration. “

One of the most notable slap downs by ABC followed Trump commenting that crime rates have drastically risen during the Biden-Harris administration. Muir immediately balked and declared: “As you know, the FBI says overall violent crime is coming down in this country.”

Harris and her allies have been repeating the claim by ABC. But the actual statistics show that Trump was right. The Justice Department’s released survey found that, under the Biden administration, there has been a significant increase in crime. Violent crime was up 37 percent from 2020 to 2023, rape is up 42 percent, robbery is up 63 percent, and stranger violence is up 61 percent. Other reports had shown startling increases such as a doubling of carjackings in D.C. in 2023.

Harris has not supported transgender operations for undocumented migrants.”

Some of the greatest mocking in the media concerned Trump’s statement that Harris has supported transgender conversion treatment for undocumented persons. New Yorker staff writer Susan Glasser immediately wrote “What the hell was he talking about? No one knows, which was, of course, exactly Harris’s point.” On CNN, Wolf Blitzer declared how “outlandish” it was for Trump to make such a claim.

But it’s true.

In 2019, Harris told the ACLU that she not only supported such operations but actively worked for at least one such procedure to take place. When it was reported by Andrew Kaczynski on CNN, host Erin Burnett was gobsmacked by the notion of taxpayer-funded gender transition surgeries for detained migrants. “She actually supported that?” Burnett exclaimed. Even the New York Times later admitted that the “wildest sounding attack line” from Trump was “basically true.”

Harris does not support the right to abortion in the final three months of a pregnancy.  

Trump also hit Harris on her no-limits position on abortion rights, allowing women the right to abort a baby up to the moment of birth. Trump said Harris supports laws allowing abortions in “the seventh month, the eighth month, [and] the ninth month,” to which Harris retorted: “C’mon,” “no,” and “that’s not true.” The hosts again said that Trump was making up his criticism of late-term abortions, including the risk of babies being born but allowed to die.

But in fact, many states, including Minnesota under Gov. Tim Walz (D), protect the right of a woman to abort a baby into the ninth month. While it is often said that this is left to the mother and her doctor, the law gives the decision to the mother.

Late-term abortions are relatively rare, but they do occur. A Centers for Disease Control and Prevention report estimated in 2019 that about 4,882 abortions were performed that year at least 21 weeks or later into pregnancy.

More than a dozen states, in fact, allow on-demand abortions after a baby is viable and can even survive outside of the womb. Nine of those states permit abortions throughout the entirety of pregnancy. Harris has supported these state laws and certainly did not answer the question on what limits she would support, other than saying that she supports Roe v. Wade.

Clearly, many late-term abortions occur to protect the life of the mother. However, you can have (as both Trump and Harris support) exceptions to protect the life of the mother without allowing abortions up to the moment of birth.

To be sure, Trump did not help himself with his wilder claims. These included debunked accounts of Haitian migrants eating people’s pets in Ohio, which Ohio’s Republican governor, Mike Dewine, has denied.

The issue is not fact-checking, but the failure to do so equally and accurately. ABC actually disseminated false information under the mantle of fact-checking, and that’s a real problem.

Moderator Linsey Davis admitted later that ABC did not want a repeat of what had happened in the last debate, wherein Trump was given free rein and the moderators limited themselves to asking questions and enforcing time limits. CNN was praised in that debate across the political spectrum for being even-handed.

What is most striking about this election is that none of this seems to matter. Indeed, even the debate did not matter. While Trump can legitimately object to a three-against-one debate format, Harris’s victory was clearly not dependent on bad calls by the refs. However, there has been little overall movement in the polls, even though 67 million people were watching.

The era of post-truth politics is evident in Harris repeating false claims about Trump’s support for “Project 2025” and debunked claims regarding his comments about an extreme-right Charlottesville rally in 2017. Leading Democrats continue to make these false claims, in some cases despite knowing that they are false.

On the other side, Trump is making promises he has to know can never be fulfilled. For example, he has pledged to make flag-burning a federal crime with a penalty of two years’ incarceration. The Supreme Court, including conservatives like the late Justice Antonin Scalia, has ruled that flag burning is protected speech under the First Amendment. Neither a president nor Congress can change the meaning of the Constitution without amending it.

With the help of the media, we have reduced our election to a political Slurpee. It’s all sugar rush and no nutritional value. We now have pundits supporting the idea of no further debates and even arguing that Harris shouldn’t give any interviews because it’s too risky.

Rep. James Clyburn (D-S.C.) explained that Harris should avoid one-on-one media interviews because “sometimes, you drill down into a question until there’s a word that’s uttered that can be used in a negative way.” I suppose, as president, she will need to insist on meeting foreign leaders only in CNN town hall events.

If you do not say anything, there are no facts to check. The election then becomes a vote over whether you are for or against “joy.”

What is clear from the ABC debate is that citizens are on their own in the election to find actual facts and substance in the super-sized Slurpee of the 2024 election.

It’s no secret many on the left love to politicize tragedies, but the reaction from some to Monday’s deadly shooting at a Christian school in Nashville has reached a whole new level of malevolent. Local authorities have identified the shooter as Audrey Hale, a 28-year-old woman who pretended to be male and had reportedly attended the school years prior. After entering the Covenant School shortly after 10 a.m., the shooter killed six people before being gunned down and killed by police. Among the victims are three 9-year-old children and three school staff members.

Nashville Police Chief John Drake characterized the shooting as a “targeted attack” and said authorities discovered “a manifesto” and detailed maps of the school showing points of entry. Drake also confirmed “there is some theory” to the idea that Hale’s transgender identity contributed to her decision to target the school but that authorities are still investigating the motive. Police said Hale was considering “another location” to target, but after “a threat assessment by the suspect [and] too much security, [she] decided not to.”

Immediately following the attack, leftists began using the horrific tragedy as an opportunity to promote their radical agenda and spew insensitive remarks.

Joe Biden

During moments of crisis, Americans should be able to count on their president to put aside politics and bring the country together. But not when that president is Joe Biden. After talking about how much he loves chocolate chip ice cream on Monday, Biden used the Nashville shooting to push for more gun control.

“The shooter … reportedly had two assault weapons and a pistol. … So, I call on Congress again to pass my assault weapons ban,” Biden said.

Karine Jean-Pierre

During her remarks in Monday’s White House press briefing, Press Secretary Karine Jean-Pierre not only used the shooting to call for increased gun control, but appeared to blame the tragedy on Republicans.

“How many more children have to be murdered before Republicans in Congress will step up and act to pass the assault-weapons ban?” she asked.

Terry Moran

ABC News Senior National Correspondent Terry Moran wasted no time in seemingly tying the shooting to Tennessee Republicans, who recently passed legislation protecting minors from experimental transgender surgeries, wrong-sex hormones, and drag shows. After providing viewers with details on the shooting, Moran immediately segued into discussing the legislation Tennessee Gov. Bill Lee approved earlier this month.

Mike Wise

Washington Post contributor and former New York Times columnist Mike Wise went out of his way to thank a Twitter user, who referred to Tennessee as “an intolerant state that brainwashes children through religious indoctrination.”

“This is as deep and real as it gets. Thank you,” Wise wrote.

Rep. Don Beyer

The Virginia Democrat blasted Republicans with an unserious and bad-faith attack, saying the GOP thinks drag shows pose a greater physical danger to children than guns do.

Benjamin Ryan

In a now-deleted tweet, independent reporter and NBC News contributor Benjamin Ryan attempted to correlate the shooting with the fact that The Daily Wire, a conservative news outlet, is based in Nashville.

“Nashville is home to the Daily Wire, a hub of anti-trans activity by @MattWalshBlog, @BenShapiro, and @MichaelJKnowles,” Ryan wrote.

Anna Skinner

Newsweek Senior Writer Anna Skinner spent her Monday afternoon writing an article titled, “Tennessee Republicans’ Ban on Drag Shows Mocked After Mass Shooting,” in which she spun the news to be about bashing Tennessee Republicans and lamented that so-called “assault weapons” are still legal in the state.

“Tennessee Republican legislators are getting slammed after at least three children and three adults were killed in a mass shooting at a Nashville private school on Monday,” Skinner wrote. “Twitter users assailed state GOP officials in the wake of the bloodshed.”

Kyle Griffin

MSNBC Executive Producer Kyle Griffin published a tweet evoking similar absurdity.

Hayes Brown

MSNBC Opinion Writer Hayes Brown took a page from Griffin’s playbook and politicize the tragedy. In his column, Hayes bizarrely argued that “much of [America’s] gun policy is presaged on the idea that guns are cool,” and “[t]hat was the unspoken understanding behind the rapid spread of the AR-15.”

Republicans “think that their toys, their totems of masculinity, their props for playing the hero, are more important than the lives lost,” he wrote.

While now titled, “The gap between GOP gun rights fantasy and Nashville’s reality,” the article originally displayed the headline, “6 are dead in Nashville. Let’s revisit how much the Tennessee GOP loves guns.”

Josephine Harvey

In a so-called “news” article titled, “Gun-Loving GOP Congressman From Nashville Torched For Response To School Shooting,” Huffington Post Senior Reporter Josephine Harvey attempted to create a controversy surrounding GOP Rep. Andy Ogles — who represents the district that includes the Covenant School — by bringing up a 2021 Christmas photo of Ogles’ family holding firearms.

In her article, Harvey claimed the picture is a “gun-glorifying Christmas photo” and went on to cite tweets from leftists attacking Ogles for posting it on Facebook well over a year ago.

ABC News Suspends Reporter On Eve Of Project Veritas Exposure

ABC News has suspended a reporter involved in an upcoming Project Veritas video the evening before the project is set to be released. Project Veritas, a conservative watchdog group, plans to release a video Wednesday exposing bias at ABC News, founder James O’Keefe tweeted. Veteran reporter David Wright was suspended Tuesday evening ahead of the project’s release, according to a person with direct knowledge of the situation.

“Any action that damages our reputation for fairness and impartiality or gives the appearance of compromising it harms ABC News and the individuals involved,” a statement given to the Daily Caller from an ABC News spokesman reads. “David Wright has been suspended, and to avoid any possible appearance of bias, he will be reassigned away from political coverage when he returns.”

They have previously received insider videos exposing network biases in numerous networks, including CNN and ABC News. The watchdog group has also aired videos of a Democratic Vermont Sen. Bernie Sanders’ staffer promoting violence against his political opponents.

The upcoming Project Veritas video “will expose ABC News’ agenda to mislead voters and push their own narratives,” O’Keefe tweeted.

Nolte: ABC Fails to Fact-Check Hunter Biden’s Claim of ‘Not One Cent’ from Chinese Govt. Deal

ABC News allowed Hunter Biden to get away with the claim he did not make “one cent” from his company’s mega-deal with a Chinese bank that is a subsidiary of the Chinese government — when its own past reporting has said just the opposite.

During the sit-down interview, ABC’s Amy Robach set up the segment about Hunter’s China deal with the background on President Trump’s desire to look into Hunter’s shady $1.5 billion — with a “B” — deal with the Chinese bank (starts at around 5:03)::

ROBACH: Also on Trump’s list of accusations against Hunter Biden: that Hunter flew on Air Force Two with his father during an official government trip to China in 2013, leveraging that connection for financial gain in an investment deal with Chinese businessman Jonathan Li.

What Robach’s question omitted is that the deal was not just with an individual businessman but with the Bank of China — a subsidiary of the Chinese government itself.

She then asks Hunter directly:

ROBACH: The president has repeatedly said you have received $1.5 billion, despite no experience and for no apparent reason. Obviously fact checkers have said that that is not true.

HUNTER: This literally has no basis in fact in any way.

ROBACH: Have you received any money from that business dealing?

HUNTER: No.

ROBACH: At all?

HUNTER: Not one cent.

ROBACH: Definitely not 1.5 billion.

HUNTER: It’s crazy. They feel as though they have the license to go out and say whatever they want.

Hunter is then allowed to trash Trump and his family as liars while Robach, who has just lauded fact checkers and their fact checking,  says nothing about the fact that — and this is important — according to her own network’s reporting,  and Hunter’s own attorney, Hunter has a ten percent stake in BHR, the company that made that mammoth $1.5 billion China deal.

Just a few months ago, ABC aired an in-depth report on Hunter’s shady business dealings that included this nugget (starts at about the 2:00 minute mark):

This video shows Chinese diplomats greeting Vice President Biden as he arrives in Beijing in December of 2013. Right by his side? His son Hunter. Less than two weeks later, Hunter’s firm had new business, creating an investment fund in China, involving the government controlled Bank of China, with reports they hopes to raise $1.5 billion. Hunter still plays a role in the fund. His lawyer says his stake is worth about half a million dollars.

Where was Robach’s followup question? Where was her oh-so-vital fact checking? Why did she let him get away with saying “not one cent” when her own network reported just a few months ago that he had equity in the firm that made a massive $1.5 billion deal?

Obviously, Hunter is playing a semantic game with that “not one cent” comment. Hunter’s attorney appears to do the same in a statement he released just two days ago, on October 13, 2019:

Hunter neither played a role in the formation or licensure of the company, nor owned any equity in it while his father was Vice President. He served only as a member of its board of directors, which he joined based on his interest in seeking ways to bring Chinese capital to international markets. It was an unpaid position.

To date, Hunter has not received any compensation for being on BHR’s board of directors. He has not received any return on his investment; there have been no distributions to BHR shareholders since Hunter obtained his equity interest.

So Hunter hasn’t “received” “one cent” because there has been no payout to investors. There was no direct commission for that deal, which dum-dums would obviously suspect like he’s a bottom-run sales rep. But here’s the rub, according to no less than FactCheck.org: Hunter might not have been paid “one cent” yet, but he is still could be looking at an eventual payoff that hits the $20 million mark:

[Hunter’s lawyer George] Mesires told the New York Times that while Hunter Biden now has a 10% stake in BHR, which he acquired through a company he created named Skaneateles LLC, “there have been no distributions to the shareholders since Hunter has been an equity owner.”

But that doesn’t mean Biden won’t eventually make millions from the deal. Steven Kaplan, who conducts research on issues in private equity, venture capital, entrepreneurial finance, corporate governance and corporate finance at the University of Chicago Booth School of Business, told us that a private equity fund with $2 billion under management will typically generate fees over its life of hundreds of millions of dollars.

“It is difficult to imagine, if not incomprehensible, that a 10% stake in those economics is worth only $420K,” Kaplan told us via email. “The distinction they appear to be making is they capitalized the management company with $4.2 M even if the fund manages $2 B.  The value of that management company is likely far in excess of $4.2 M if they are managing $2 B.”

Kaplan pointed to two large publicly traded private equity firms for reference, both of which have a market value of about 10% of the assets under their management. Using that as a rough guide, that would put the value of Hunter Biden’s share closer to $20 million, he said.

Basically, it looks as though Hunter claiming not have made one cent off the China deal is like a CEO claiming he was not paid one cent to run a company because his compensation came from stocks or bars of gold or pearls or the gift of a home. But the fact is this: any deal that increases the value of the company that Hunter Biden has a stake in — and a $1.5 billion deal with a bank owned by one of the world’s biggest economies does just that — is a deal where Hunter Biden has a financial interest.

Maybe ABC will reveal Hunter’s semantic dishonesty when the rest of the interview airs later tonight. Maybe Robach will ask him what he has “earned” or “gained” as a result of the deal, rather than “received.” If not, it is a gross dereliction of duty on the network’s part. And all of this comes just one day after ABC was caught presenting 2014 video from a Kentucky gun range as video of  Turkish military operation against the Kurds.
