First major victim of Harry Reid’s tyrannous Senate majority could be separation of church and state

Whereas before 60 votes were required to end debate on a nominee, now only a simply majority of 51 senators can silence opponents and force a final vote for or against confirmation.

The 60-vote threshold forced supporters and opponents of a nomination to temper their views, thus encouraging reasonable compromise rather than straight-up all-or-nothing votes that can enable a majority to tyrannize a minority. That’s the theory anyway.

Here’s the first example

Late last week, Senate Democrats confirmed Cornelia Pillard to the D.C. Circuit Court of Appeals. “That makes two additional Obama nominees on the court with the lightest workload, and it gives leftists a 6-4 advantage on the court that hears most challenges to executive actions,” according to the Patriot Post.

Pillard, a tenured Georgetown University law professor, is a former Clinton administration Department of Justice political appointee. She is, according to National Review Online’s Patrick Brennan, “probably the most extreme of President Obama’s” many federal judicial nominees.

How extreme is she?

In 2011, Pillard said of a case then before the Supreme Court that the idea that “the Constitution requires deference to Church decisions about who qualifies as a minister … seems like a real stretch.”

The Supremes unanimously disagreed with Pillard and affirmed that the government has no power to tell churches who they can and cannot hire as ministers.

If Pillard’s view prevailed, there would be no such thing as separation of church and state, nor would the First Amendment’s guarantee of religious freedom be anything other than mere words.

Pillard now has power

Pillard is now part of a liberal majority of the appeals court with the most influence on what is commonly referred to as the second most important court in the country.

This comes at a time when, as today’s Washington Examiner editorial points out, liberals are assaulting the traditional understanding of religious freedom on many fronts.

Sooner or later, Pillard’s panel will have to decide a case whose outcome could determine which side wins the liberal war on the First Amendment.

Congressman Charlie Rangel has a solution for bypassing gridlock in Washington D.C.: executive orders for “everything.”

In an interview last night with NY1, the congressman praised Senate Majority Leader Harry Reid’s decision to push through the so-called “nuclear option” to end filibusters on most presidential nominees. But he lamented the fact the work-around could not be used for legislation, suggesting the president turn to the executive orders–like the kind used to end the deportation many people who’d entered the country illegally as children.

“You know, the DREAM Act for the kids that came over here and didn’t know their home town, the president did that by executive order. What I did is I’ve taken out the language that he used and I’m gonna see why we can’t use executive orders for everything. What’s he gonna do? Make the Republicans angry? They’re gonna get annoyed? They’re not gonna cooperate?”

He went on to slam the Republican Party for refusing to cooperate–accusing them of acting against the interests of their own constituents.

“A police officer once told me when I was a kid that the worst criminal to deal with is one that doesn’t mind dying,” he said. “And if you take a look at what these Tea Party people have done–recognizing that there’s more sick and poor white folks then there is–but they still are resisting everything that the president wants to do so they can destroy the people in their district in terms of education and jobs, the Congress, the Republican name. And when we had the debt ceiling crisis, they were really prepared to let the United States of America fiscal policy to go in the tubes. How can you talk with people like this?”

He also defended the Affordable Care Act, arguing that far too much attention has been paid to the disastrous roll-out.

“They’re concentrating on the small misjudgments that have been made and nobody’s speaking for the 40 and 50 million people that have dreamed and hoped and prayed for that they could be included and insured. Not having insurance not only destroys your life, it destroys your fiscal life. It breaks up marriages. You cannot functions anywhere unless you have good health,” he argued, agreeing the president never should have apologized.

“I’d forget the apology,” he said. “The president should have said, ‘There’ll be a little quirks here, but we’ll take care of the quirks.’”

Senate Democrats Go Nuclear and Blow Up Tradition

They did it. Senate Democrats invoked  the nuclear option and blew up over 220 years of legislative history in the  United States. The Democrats changed the rules of the Senate to allow  Presidential appointments to executive and judicial positions with a simple  majority vote. Instead of the original 60 vote threshold, now the Senate will  only need 51 votes to approve these appointments. It may not seem like a major  change – but it is – Senator John McCain (R-AZ) may have said it best, “This  changes everything, this changes everything.”

Funny enough, the same Democrats that today “broke the rules, to change the  rules,” once fought tooth and nail to stop Republicans from doing the very same.  In 2005 the Republicans threatened the nuclear option because of Democrats  filibustering President George W. Bush’s judicial appointments. The key word  there is threatened. In the end, a bipartisan group of Senators brokered an  agreement and the nuclear option was left untouched.

“My Republican colleagues claim that nominees are entitled to an up-down  vote. That claim ignores history, including recent history.”

“Some in this chamber want to throw out 214 years of Senate history in the  quest for absolute power … They think they’re wiser than our founding fathers. I  doubt that that’s true.”

The nuclear option, “simply put, would be the end of the United States  Senate.”

What is Reid saying now?

“These nominees deserve at least an up-or-down vote. But Republican  filibusters deny them a fair vote and deny the president his team.”

To remain relevant and effective as an institution, the Senate must evolve  to meet the challenges of a modern era.”

“It’s time to change the Senate before this institution becomes  obsolete.”

The Senate Democrats betrayed the American people yet again when they voted  for the nuclear option. Our system is designed to give the minority more power  than its numbers would ordinarily give it. Why? Because our founding fathers  knew the corrupting influence of power. They knew that the majority could not be  trusted with its “full share” of power – they would persecute and ignore the  minority’s beliefs and desires.

HReidMiddleSenate Democrats chose to value themselves more  than they values our nation, and they should be punished for that. It’s my  sincerest hope that this, along with the many other failings, shortcomings and  scandals that the Democrats have been a part of, be seared into the brains of  voters for years to come.

Again, I think John McCain’s reaction to the day’s events are just about  perfect.

“This changes everything, this changes everything… (This) puts on a chill  on the entire United States Senate.”

“I have reached to them. I spent an hour in Harry Reid’s office. Come on.  I reached out until my arms ache… They are governed by these hard over, newer  members of Democratic senators who have never been a minority, who are primarily  driving this issue and they succeeded and  they will pay a very, very heavy price for it.

I hope so Senator McCain, I sincerely do.
