Built to Fail: How Democrat Power Obeys All the Wrong Laws

Joe Biden and most other Democrat leaders embody the Peter Principle: the idea that people in a hierarchy rise to their level of incompetence—and then stay there. Biden’s incompetence is not a fluke.

Biden happens when career advancement is based not on results, but on politics, connections, and staying quiet until it’s your turn. Biden has spent five decades moving up by saying very little, doing even less, and being just bland enough to pose little threat to the hierarchy. When Biden’s flaws were placed at the top of the heap, they were no longer hidden and sadly became national policy.

But while Biden drifted in senility, his party remained razor-sharp in their dedication to Gerson’s Law: “The left always sides with evil.”

Hamas? The Left blames Israel. A black cop shoots a white criminal. Crickets? A criminal illegal alien kills a mother of five? They focus on “compassion for migrants.” There’s a perverse consistency to it: if a situation involves a moral choice, they’ll find the most depraved side possible—and throw a parade for it. Why? Because evil has marketing appeal. It wears victimhood like armor and cloaks power-grabs in the language of “justice.” The Left doesn’t ignore morality. They invert it.

Look at their other leaders. Pelosi made a fortune on the stock market. And let’s not forget that she demanded her hairdresser open her shop during covid. And what of Adam Schiff, Eric Swalwell, AOC, and the many others.

Even the media operates by a set of laws.

Brandolini’s Law explains why Democrat lies spread faster than the truth can catch them. This law has been codified by the media industrial complex.

It takes seconds to scream “Russia!” or “Nazis!”, but years to unspool the facts. And by then, the lie has already hardened. The same law powered COVID hysteria and the “fine people hoax”, to name a few. The truth behind these rarely get airtime—because lies aren’t just useful, they’re policy. And the worst part? It works, at least for a while, because Hanlon’s Razor gives them cover: “Never attribute to malice that which can be explained by stupidity.”

Americans give them the benefit of the doubt. “They must mean well.” “They’re just misinformed.” No. That might’ve flown ten years ago. But after watching COVID lockdowns weaponized, CRT injected into schools, and the DOJ chase parents like terrorists, it’s clear: this isn’t incompetence. This is intent.

The government

Meanwhile, the government grows more complex and bloated, following Gall’s Law: “A complex system that works is invariably found to have evolved from a simple system that worked.” But Democrats don’t build from simple foundations. They skip to complexity—mandates, regulations, acronyms, alphabet agencies—none of which are accountable or efficient. The result? Nothing works. Healthcare collapses, education erodes, and immigration becomes a sieve. But it doesn’t matter—because bureaucracy was never meant to fix. It was meant to control.

That brings us to Pournelle’s Iron Law of Bureaucracy: any bureaucratic organization will inevitably be taken over by people more devoted to the institution than its goals. Think teachers’ unions. Think the CDC. Think the DOJ. They no longer care if children learn, if public health improves, or if laws are applied evenly. They care about their funding, their power, their narrative. And anything that threatens that gets silenced.

And just when you think they can’t sink lower, they rely on Sutton’s Law: “Go where the money is.” DEI grift, climate subsidies, COVID funds—Democrats never met a crisis they couldn’t monetize. Follow the money, and you’ll find consultants, activists, and NGOs feeding from the trough while the rest of the country drowns in inflation and fentanyl.

Which leads us to Cynical Law of Government: If the government were in charge of the Sahara, there’d be a sand shortage. And here we are—in a country with vast energy reserves, watching gas prices rise because Biden killed pipelines and begged dictators for oil. He’s not solving problems. He’s manufacturing them—and blaming you for noticing.

Leftist society (minions) are culpable

Let’s not forget Cunningham’s Law: “The best way to get the right answer on the internet is not to ask a question, but to post the wrong one.” Democrats abuse this too. They troll. They lie. Then they wait for “fact-checkers” to come to their defense, turning truth into a battlefield where silence is safest.

Even cultural decay follows a formula. Remember Cicero’s Dictum? A nation can survive fools, even ambitious ones—but not the traitor within. Today’s Left undermines America from within—open borders, selective law enforcement, and policies that punish productivity and reward grievance. That’s not a bug. It’s the point.

We were told Biden was the “moderate.” That was the cover story. The real plan was always the bureaucracy. The unelected, the activists behind the scenes. The Deep State isn’t shadowy anymore—it’s openly posting job listings for “disinformation czars” while censoring dissidents. At scale.

And all of it—all of it—runs on the broken logic of Goodhart’s Law: “When a measure becomes a target, it ceases to be a good measure.” Equity scores, climate targets, test score benchmarks—all twisted into quotas, lies, and metrics manipulated to justify power, not truth. A black student graduates unable to read? Don’t fix the system—just eliminate standards.

We’re watching a regime that obeys laws—just the wrong ones. Not laws of justice, fairness, or logic—but the dark, cynical laws that reward failure, elevate frauds, and mask decay as “progress.”

Biden didn’t invent this system. He’s just the mascot of its end stage. And as the walls crack, the only surprise is how long it held up. Because eventually, Reality wins—no matter how many narratives you write to deny it.

While violent riots erupted in Los Angeles following ICE raids, the liberal media and Democratic leaders have either downplayed the destruction or outright justified the lawlessness. Former Democratic strategist Dan Turrentine didn’t hold back in his criticism, stating that his own party has “lost its mind” for tolerating attacks on federal officers and property. “You simply cannot do this,” Turrentine declared on The Morning Meeting, condemning the Democratic Party’s refusal to uphold law and order.

Despite clear footage of rioters hurling rocks at ICE agents, setting cars ablaze, and assaulting law enforcement, Democratic Rep. Maxine Waters shamelessly claimed there was “no violence” in Los Angeles. Her denial flies in the face of reality, as Los Angeles Police Chief Jim McConnell confirmed officers were targeted with “commercial-grade fireworks” capable of killing them. Video evidence further exposed a helmet-clad agitator smashing the windshields of federal vehicles—yet the left continues to peddle the myth of “peaceful protests.”

Governor Gavin Newsom and Mayor Karen Bass hesitated to act, seemingly more concerned with appeasing their far-left base than protecting citizens. Turrentine accused them of sympathizing with the rioters, stating, “They didn’t really see a problem with it… because it’s in the name of what we believe.” This reckless mindset has turned Los Angeles into a war zone, with Democrats enabling chaos rather than enforcing the law.

Meanwhile, President Donald Trump took decisive action, deploying the National Guard to restore order—a move met with hysterical backlash from Democrats. Newsom whined on social media, calling the deployment an overreach, even as his own city burned. Assistant Secretary of Homeland Security Tricia McLaughlin rightly called out Democratic leaders like Hakeem Jeffries and Mayor Bass for fueling violence with their anti-ICE rhetoric. “Make no mistake, Democrat politicians… are contributing to the surge in assaults of our ICE officers through their repeated vilification,” she stated.

The liberal media, ever eager to spin the narrative, has ignored the truth: Democrats’ open-border policies and demonization of law enforcement have consequences. While they cry foul over Trump’s strong leadership, Americans see the results—swift action versus dangerous inaction. The choice is clear: safety and security under Trump, or chaos and lawlessness under the left.

Always Ready, Always There: Democrats Mobilize Against the National Guard Deployment

Below is my column in Fox.com on the deployment of National Guard in Los Angeles. Another round of court challenges is unfolding, but the escalation is likely to continue on both sides. While the Guard’s motto is “Always Ready, Always There!” California Democrats do not want them between rioters and federal law enforcement.

Here is the column:

Gov. Gavin Newsom was in his element this week. After scenes of burning cars and attacks on ICE personnel, Newsom declared that this was all “an illegal act, an immoral act, an unconstitutional act.” No, he was not speaking of the attacks on law enforcement or property. He was referring to President Donald Trump’s call to deploy the National Guard to protect federal officers.

Newsom is planning to challenge the deployment as cities like Glendale are cancelling contracts to house detainees and reaffirming that local police will not assist the federal government.

Trump has the authority under Section 12406 of Title 10 of the U.S. Code to deploy the National Guard if the president is “unable with the regular forces to execute the laws of the United States.” The Administration is saying that that is precisely what is unfolding in California, where mobs attack vehicles and trap federal personnel.

Most critics are challenging the deployment on policy grounds, arguing that it is an unnecessary escalation. However, even critics like Berkeley Law Dean Erwin have admitted that “Unfortunately, President Trump likely has the legal authority to do this.”

There is a fair debate over whether this is needed at this time, but the President is allowed to reach a different conclusion. Trump wants the violence to end now as opposed to escalating as it did in the Rodney King riots or the later riots after the George Floyd killings, causing billions in property damage and many deaths.

Courts will be asked to halt the order because it did not technically go through Newsom to formally call out the National Guard.

Section 12406 grants Trump the authority to call out the Guard and employs a mandatory term for governors, who “shall” issue the President’s order. In the memo, Trump also instructed federal officials “to coordinate with the Governors of the States and the National Guard Bureau.” Newsom is clearly refusing to issue the orders or coordinate the deployment.

Even if such challenges are successful, Trump can clearly flood the zone with federal authority. Indeed, the obstruction could escalate the matter further, prompting Trump to consider using the Insurrection Act, which would allow troops to participate directly in civilian law enforcement. In 1958, President Eisenhower used the Insurrection Act to deploy troops to Arkansas to enforce the Supreme Court’s orders ending racial segregation in schools.

The Trump Administration has already claimed that these riots “constitute a form of rebellion against the authority of the Government of the United States.” In support of such a claim, the Administration could cite many of the Democratic leaders now denouncing the claim.

After January 6th, liberal politicians and professors insisted that the riot was an “insurrection” and, in claiming that Trump and dozens of Republicans could be removed from ballots under the 14th Amendment. Liberal professors insisted that Trump’s use of the word “fight” and questioning the results of an election did qualify as an insurrection. They argued that you merely need to show “an assemblage of people” who are “resisting law” and “using force or intimidation” for “a public purpose.” The involvement of inciteful language from politicians only reinforced these claims. Sound familiar?

Democrats are using this order to deflect from their own escalation of the tensions for months. From Minnesota Gov. Tim Walz calling ICE officers “Gestapo” to others calling them “fascists” and “Nazis,” Democratic leaders have been ignoring objections that they are fueling the violent and criminal responses. It did not matter. It was viewed as good politics.

While Newsom and figures like Sen. Cory Booker (D., N.J.) have called these “peaceful” protests, rocks, and Molotov cocktails have been thrown at police as vehicles were torched. Police had to use tear gas, “flash bang” grenades, and rubber bullets to quell these “peaceful” protesters.

There appears little interest in de-escalation on either side. For the Trump Administration, images of rioters riding in celebration around burning cars with Mexican flags are only likely to reinforce the support of the majority of Americans for the enforcement of immigration laws.

For Democrats, they have gone “all in” on opposing ICE and these enforcement operations despite support from roughly 30 percent of the public.

Some democrats are now playing directly to the mob. A Los Angeles City Council member, Eunisses Hernandez, reportedly urged anti-law enforcement protesters to “escalate” their tactics against ICE officers: “They know how quickly we mobilize, that’s why they’re changing tactics. Because community defense works and our resistance has slowed them down before… and if they’re escalating their tactics then so are we. When they show up, we gotta show up even stronger.”

So, L.A. officials are maintaining the sanctuary status of the city, barring the cooperation of local police, and calling on citizens to escalate their resistance after a weekend of violent attacks. Others have posted the locations of ICE facilities to allow better tracking of operations while cities like Glendale are closing facilities.

In Washington, Jeffries has pledged to unmask the identities of individual ICE officers who have been covering their faces to protect themselves and their families from growing threats.

While Democrats have not succeeded in making a convincing political case for opposing immigration enforcement, they may be making a stronger case for federal deployment in increasingly hostile blue cities.

Well, well, well—another day, another mask ripped clean off the smug face of “objective journalism.” ABC News has officially suspended senior correspondent Terry Moran after he let loose on X (formerly Twitter), calling Stephen Miller and Donald Trump “world-class haters” in a post so drenched in bile it made Keith Olbermann look subtle. The tweet got deleted—of course—but not before screenshots lit up conservative circles like a Fourth of July sparkler. Now ABC is scrambling to pretend it has standards. Spoiler alert: it doesn’t.

Moran’s Meltdown in His Own Words

Let’s recap the meltdown. Moran wrote that Stephen Miller wasn’t known for brains but for “bile,” describing him as “richly endowed with the capacity for hatred” and someone who “eats his hate.” He went on to say Trump was also a world-class hater, but only because it fuels his “own glorification.” This wasn’t analysis—it was a tantrum. And it came just hours after the third straight night of violent riots in Los Angeles, where Trump had just deployed the National Guard to restore order. The timing? Not subtle.

ABC Plays Damage Control—Too Little, Too Late

After backlash from all sides, including the White House and a furious online conservative base, ABC News issued a very corporate statement saying Moran had “violated our standards” and was being suspended pending further evaluation. Now they want you to believe they care about “objectivity.” Please. ABC calling itself neutral is like Hunter Biden calling himself sober—technically possible, but hard to swallow. This isn’t the first time ABC has had to clean up after its own, either. Just last year they paid $15 million to settle a defamation suit with Trump over a George Stephanopoulos interview. At this point, “We stand for impartiality” is the most laughable line in their brand guide.

The White House Fires Back—And Rightly So

Press Secretary Karoline Leavitt jumped into the fray, calling the post “unhinged and unacceptable,” and demanded ABC explain how they’d hold Moran accountable. Vice President J.D. Vance called Moran’s rant “a vile smear dripping with hatred,” and said it proves why Americans can’t trust ABC’s Trump coverage. And Stephen Miller himself? He summed it up best: “Terry pulled off his mask.” That’s the point. This wasn’t just a reporter having a moment. It was a veteran journalist admitting what so many of us already knew—these people don’t report on Trump. They despise him. And they despise you, too.

Journalists or Activists? Pick One

Let’s be honest: Terry Moran didn’t get caught in a gotcha moment. He gave a confession. He said the quiet part out loud. For years, people like him have lectured the rest of us from their media ivory towers, pretending they’re just telling the truth while pushing narratives straight from the DNC playbook. The only thing more dangerous than dishonest journalism is dishonest journalism wrapped in fake neutrality. And Moran wrapped his hatred in both. His post didn’t just attack two public figures—it confirmed decades of conservative skepticism about the press.

The Real “Hate” Is Coming from Inside the Newsroom

The irony here is almost too perfect. While cities burn from “peaceful protests,” and while the Left defends lawlessness in the name of equity, the same media talking heads accuse Trump and his team of being the real threat to democracy. This is what projection looks like. Moran accused others of feeding on hate—but the bile in his tweet says otherwise. If you want to know what fuels the corporate press, just read Moran’s late-night poetry slam. He wasn’t giving policy commentary. He was lashing out because he’s losing control of the narrative—and he knows it.

What Happens Next?

Will ABC quietly reinstate Moran after a week of “reflection”? Probably. Will the rest of the media rally around him, pretending this is a free speech issue? Almost certainly. But make no mistake—this moment matters. Every time a media figure exposes their disdain for half the country, it pushes more Americans out of the mainstream media bubble and into platforms like ours. The more they rant, the more they reveal. And that’s why we’ll keep watching. Keep calling it out. And keep fighting back.

The U.S. Supreme Court Friday permitted billionaire Elon Musk’s Department of Government Efficiency, a key player in President Donald Trump’s drive to slash the federal workforce, broad access to personal information on millions of Americans in Social Security Administration data systems while a legal challenge plays out.

At the request of the Justice Department, the justices put on hold Maryland-based U.S. District Judge Ellen Hollander’s order that had largely blocked DOGE’s access to “personally identifiable information” in data such as medical and financial records while litigation proceeds in a lower court.

Hollander found that allowing DOGE unfettered access likely would violate a federal privacy law.

Is DEI DOA? Supreme Court Unanimously Rejects Added Burden for Whites in Discrimination Lawsuits

Yesterday, the Supreme Court handed down three major cases with unanimous decisions. One, Ames v. Ohio Department of Youth Services, raises additional questions over diversity, equity, and inclusion (DEI) programs that have been widely used in higher education and businesses. There is no reason to believe that DEI measures are DOA, but the decision is likely to accelerate challenges based on reverse discrimination after the Court rejected the imposition of an added burden for members of any “majority group” including straight, white males.

The immediate question before the Court was a circuit split over the standard that applies to a member of a “majority” group who claims that he or she was treated unfairly based on majority characteristics. The Sixth Circuit, along with four other circuits, held that such litigants must shoulder additional pleading burdens under Title VII of the Civil Rights Act.

Many of us have long argued that this long-standing rule was itself discriminatory and at odds with both constitutional and statutory authority. It was a bizarre interpretation of a law that barred employees from discriminating based on “race, color, religion, sex, and national origin.”  That would ordinarily require a plaintiff to support a claim of disparate treatment by showing that she applied for a position for which she was qualified but was rejected under circumstances giving rise to an inference of unlawful discrimination. However, judges began to add their own burden of white, male or straight litigants in requiring them to show additional “background circumstances” that show the defendant is an “unusual employer” that discriminates against majority groups.

In this case, Marlean Ames, a heterosexual woman, claimed that she was demoted at the Ohio Department of Youth Services after Ginine Trim, a gay woman, replaced her supervisor. Trim hired a younger gay man allegedly based on sexual orientation. Both the district court and the Sixth Circuit dismissed the complaint because Ames failed to identify any other “background circumstances” that demonstrated her employer discriminated against heterosexual women. Justice Ketanji Brown Jackson wrote for a unanimous Supreme Court that reversed the Sixth Circuit and rejected the “additional circumstances” test as at odds with the plain text of Title VII.

“As a textual matter, Title VII’s disparate-treatment provision draws no distinctions between majority-group plaintiffs and minority-group plaintiffs. Rather, the provision makes it unlawful “to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin.” The “law’s focus on individuals rather than groups [is] anything but academic.” Bostock v. Clayton County (2020). By establishing the same protections for every “individual”—without regard to that individual’s membership in a minority or majority group—Congress left no room for courts to impose special requirements on majority-group plaintiffs alone.”

Justice Thomas, joined by Justice Gorsuch, filed a concurrence that chastised lower courts and “judges creating a textual legal rules and frameworks.”

The opinion has broader implications for businesses and higher education where DEI has been used to brush aside such reverse discrimination claims. Often such claims are mocked as suggesting that members of a majority group are “victims.” While not imposing this specific “add-on,” these controversies involve much of the same bias against reverse discrimination claims. Litigants complain that they often face greater demand and resistance to their claims as opposed to employees who are part of minority groups.

Various legal groups insisted that the Sixth Circuit was correct and that majority-group litigants should shoulder an added burden, including the NAACP Legal Defense and Educational Fund, National Women’s Law Center, Latino Justice, National Employment Law Project and Asian American Legal Defense and Education Fund.  The views of these groups could not garner a single vote on the Court.

The Ames decision is a welcome development in bringing greater uniformity in the treatment of discrimination claims. It is also a shot across the bow of businesses and universities that have used DEI to dismiss the countervailing interests and claims of majority-group employees.

Former colleagues of one of President Donald Trump’s judicial nominees praise him as the “the most brilliant attorney” they’ve ever “had the opportunity to work with.”

Trump nominated Joshua Divine to the U.S. District Court for the Eastern and Western Districts of Missouri on May 6.  Divine serves as Missouri’s solicitor general, but his resume also includes clerking for Supreme Court Justice Clarence Thomas, working as general counsel for Sen. Josh Hawley, R-Mo., and being an involved member of the conservative Federalist Society.

“He is an accomplished attorney with an incredible acumen for the law. He has an indisputable fidelity to the law, and so he will give the law its full faith and credit, and he will also look at the text, history, and tradition of the United States Constitution and determine constitutional issues,” Missouri Attorney General Andrew Bailey told The Daily Signal.

“There is no one in the United States of America more qualified to take the pitch than Josh Divine,” said Bailey, who appointed Divine as his solicitor general in December 2022.  

In his current role, Divine has led the fight to protect mothers and babies from the abortion pill and promulgated a rule to prevent children from undergoing irreversible transgender medical interventions.

Divine joined forces with counterparts in Idaho and Kansas to file a lawsuit against the Food and Drug Administration, arguing it should roll back its decision to allow telehealth prescriptions for mifepristone. The Trump Department of Justice dismissed the case, saying it was filed in the wrong court, but nothing is stopping the plaintiffs from filing again in the correct court, said U.S. District Court Judge Matthew Kacsmaryk of the Northern District of Texas. 

“He shares my vision for the state of Missouri, which is that we should be the safest state in the nation for children,” Bailey said in a phone interview. 

Divine appeared at a hearing on Wednesday morning before the Senate Judiciary Committee, along with four others among Trump’s 11 newest judicial nominees. A left-leaning legal commentary site called Balls and Strikes criticized Divine for writing in 2010 for his college newspaper that Christians are “obliged ethically to impose their beliefs on others.” 

But Divine’s colleagues see his conservative convictions and strong Christian faith as an asset.

Andrew Nussbaum, who clerked alongside Divine for Chief Judge William H. Pryor Jr. on the 11th U.S. Circuit Court of Appeals, said he bonded with Divine “over a shared faith and worldview that sets God, family, and country at the center of a vision for justice in American society.”

“Since our clerkship, I’ve followed Josh’s career closely, applauding his victories for Missouri’s children in Noe v. Parson and for the rule of law in his defeat of the federal government’s illegal attempts at student-loan cancellation,” Nussbaum said. 

In Noe v. Parson, the Cole County, Missouri, Circuit Court sided with Divine to uphold a Missouri law that protects children from gender-transition procedures. 

In 2023, Divine lost his ability to walk in a snowboarding accident that almost cost him his life. He regained his ability to walk, and Hawley says that fortitude will serve him well as a judge.

“Josh fought to regain his ability to walk, just as he has fought for Missourians in court, day in and day out, and you’ll see here in a moment when he walks to the table that he has now fully regained his ability,” Hawley said at the Wednesday hearing. “We thank the Lord for that, but we also look at his tenacity and the character that it displays.” 

Nussbaum shares Divine’s passion for endurance sports, and he was shocked when Divine nearly died two years ago while snowboarding.

“But Josh responded to that accident as you would expect him to: He worked harder than anyone else at physical therapy and was back in the courtroom mere weeks after being in the [intensive care unit],” Nussbaum said. 

No obstacle could stop Divine from achieving at the highest level, Bailey said. 

“I think that’s a testament not only to his physical ability,” the Missouri AG said, “but his mental acumen and just dedication to doing the right things for the right reasons.” 

According to Bailey, Divine’s nomination bodes well for Trump’s future judicial picks. 

“I think it proves that if you fight for the rule of law and the principles that put this country first and put our Constitution first as our national identity—those are great attributes for judicial appointment,” Bailey told The Daily Signal. 

If members of the Senate Judiciary Committee vote to advance Divine’s nomination, it will then move to a vote by the entire Senate. If confirmed, Trump will issue a judicial commission to make the appointment official.

Marc Elias Moves to Thwart Trump DOJ’s Litigation Over Alleged Voter Inaccuracies

Democrat election lawyer Marc Elias moved this week to intervene in a Trump Justice Department lawsuit filed last week against North Carolina for the state’s alleged inaccurate voter registration rolls. 

The Justice Department’s lawsuit alleges North Carolina’s Board of Elections used a state voter registration form that failed to require voters to provide identifying information such as a driver’s license or the last four digits of a Social Security number, as required under the federal Help America Vote Act. 

The Justice Department said that the litigation advances President Donald Trump’s Executive Order 14248, “Preserving and Protecting the Integrity of American Elections,” to ensure enforcement of existing federal election laws.

The North Carolina Alliance for Retired Americans hired Elias’ firm, the Elias Law Group, for a motion to intervene in the case, the Carolina Journal reported. Elias has been a staple in election litigation cases, representing Democrat candidates and liberal interest groups for about two decades, notably representing Hillary Clinton’s 2016 presidential campaign.

The North Carolina Board of Elections has had a new 3-2 Republican majority since May and is potentially less likely to defend the legal challenge by a Republican administration.

Elias’ motion notes that before the 2024 election, the Republican National Committee filed a lawsuit similar to the Justice Department’s suit against the state and that the losing GOP candidate in a state Supreme Court race made similar complaints. 

“Now, the federal government has joined the fray, echoing the alarmist tone of these past suits,” the motion says.

Four lawyers from Washington-based Elias Law Group are listed on the motion as well as one from the Chapel Hill, North Carolina-based law firm of Patterson Harkavy.

But the motion says the government’s lawsuit doesn’t identify a single voter who was registered in a way that was noncompliant with the Help America Vote Act. 

“Despite its paltry allegations, the federal government asks this court to force North Carolina to engage in a herculean data-collection process, contacting every single voter in the state whose registration file appears to be missing information and then collecting that information,” the lawyers for the retirement alliance argued in the motion. “The inevitable consequence of the federal government’s lawsuit is clear: Voters who cannot be contacted stand to be kicked off the rolls, even if they complied with HAVA [Help America Vote Act] when they registered or never had to comply with HAVA at all.”

In filing the lawsuit last week, Assistant Attorney General Harmeet Dhillon of the Justice Department’s Civil Rights Division, said in a public statement: “Accurate voter registration rolls are critical to ensure that elections in North Carolina are conducted fairly, accurately, and without fraud. … The Department of Justice will not hesitate to file suit against jurisdictions that maintain inaccurate voter registration rolls in violation of federal voting laws.”

The Justice Department lawsuit says the state “failed to maintain accurate lists in North Carolina’s computerized statewide voter registration” database in violation of Section 303(a)(5) of the federal law, which requires a Social Security number, driver’s license, or other identification. 

The federal lawsuit notes the Help America Vote Act says, “States are encouraged to use the unique identifier to share information with other governmental offices for purposes such as death certificates, court and tax records, etc., to assure proper maintenance of voter records, file integrity, and protection of voter rights.”

The refusal by a majority on the U.S. Supreme Court (SCOTUS) to shut down leftists’ lower court judicial coup against President Trump has drawn sharp rebukes from conservatives across America. These critics (correctly) argue that the high court’s unwillingness to stop (and at times, its willingness to participate in) this effort both subverts the power of the executive branch and undermines the will of the more than 77 million Americans who voted for the president in the 2024 election. But it’s not just judicial commentators and everyday citizens who are getting fed up with the justices’ political gamesmanship.

Last week, a three-judge panel on the Fifth Circuit Court of Appeals issued an order “expedit[ing] to the next available randomly designated regular oral argument panel” the case known as A.A.R.P. v. Trump. The matter centers around Trump’s use of the Alien Enemies Act to deport Venezuelan Tren de Aragua gang members.

The order came as part of the lower court’s compliance with a May 16 SCOTUS decision, in which a majority (7-2) on SCOTUS remanded the case back to the Fifth Circuit. As described by Fox News, the ruling — in which Associate Justices Samuel Alito and Clarence Thomas dissented — “revolved around the alleged illegal immigrants not having enough time to reasonably file a challenge to their deportations.”

While the Fifth Circuit panel’s order followed the Supreme Court’s instructions, it also included a multi-page concurring opinion from Judge James Ho. In addition to arguing that the identified Tren de Aragua members “should not be allowed to proceed in this appeal,” the Trump appointee excoriated the high court for the “disrespect” it has shown “the district judge as well as the President and other officials” in the case.

“As an inferior court, we’re duty-bound to follow Supreme Court rulings — whether we agree with them or not. … So, I concur in our order today expediting our consideration of this matter, as directed by the Supreme Court,” Ho wrote. “But I write to state my sincere concerns about how the district judge as well as the President and other officials have been treated in this case. I worry that the disrespect they have been shown will not inspire continued respect for the judiciary, without which we cannot long function.”

Ho went on to note that it “is not the role of the judiciary to check the excesses of the other branches, any more than it’s our role to check the excesses of any other American citizen” — an apparent rebuke to recent remarks by Chief Justice John Roberts. While speaking at an event in his hometown of Buffalo, New York, earlier this month, the Bush appointee tacitly endorsed the concept of judicial supremacy, claiming the courts can unilaterally “strike down … acts of Congress or acts of the president” they believe to be unlawful or unfavorable.

“Judges do not roam the countryside looking for opportunities to chastise government officials for their mistakes,” Ho wrote. “Rather, our job is simply to decide those legal disputes over which Congress has given us jurisdiction.”

Much like Alito did in his dissenting opinion in SCOTUS’s May 16 decision, Ho ardently defended District Court Judge James Wesley Hendrix’s handling of petitioners’ requests for emergency relief, saying he “conducted himself in a reasonable and indeed admirable manner” and “any criticism of [him] is unwarranted and unfortunate.” He further echoed Alito’s criticisms of the Supreme Court’s characterization of Hendrix’s declination to immediately abide by petitioners’ late-night requests as “misleading.”

“We seem to have forgotten that this is a district court — not a Denny’s. This is the first time I’ve ever heard anyone suggest that district judges have a duty to check their dockets at all hours of the night, just in case a party decides to file a motion,” Ho wrote. “If this is going to become the norm, then we should say so. … If this is not to become the norm, then we should admit that this is special treatment being afforded to certain favored litigants like members of Tren de Aragua —and we should stop pretending that Lady Justice is blindfolded.”

The Fifth Circuit judge concluded his fiery opinion by underscoring that Trump deserves the same level of respect all presidents before him have been afforded. He specifically pointed to former President Obama’s attack on the Supreme Court during his 2010 State of the Union address and former President Bill Clinton’s inability to practice law before the high court as examples of presidents who — despite having disagreements with court rulings — were entitled to said respect.

“Yet I doubt that any court would deny any of those Presidents the right to express their views in any pending case to which they are a party, before issuing any ruling. Our current President deserves the same respect,” Ho wrote.

Whether Roberts and his colleagues take Ho’s criticisms seriously remains to be seen. But what is certain is that the longer the high court continues to entertain leftists’ judicial coup, the more credibility it loses with the American people.

Trump’s Global Reset: Economic Might, Cultural Renewal, and the End of Intervention

While President Trump visited Saudi Arabia, the Left predicted America would fall into the ocean. Headlines were prepped to paint him as escaping the doom he supposedly created stateside. Yet, while the President was abroad, some rather unexpected things happened.

For instance, 17 Mexican cartel members surrendered to the FBI in San Diego.

You remember that war the President declared on narco-traffickers, branding them as terrorist organizations? Well, it turns out when you call a spade a spade, things start to happen. Cartels are starting to realize that this administration means business. Trump doesn’t just make noise; he sets traps, and those traps are catching monsters.​

Meanwhile, ICE continued its crackdown on illegal immigration, plucking dangerous criminals off American streets. Funny, isn’t it? The Democrats’ old trope that “illegals commit fewer crimes than citizens” hasn’t been heard much lately. You’d think a few hardened criminals getting cuffed would be newsworthy. But alas, it’s crickets from the mainstream media.​

On the subject of immigration, Democrats showed their true colors when they resoundingly rejected Trump’s offer to bring South African farmers to America.

These farmers face racially driven violence in their homeland, with the South African government practically endorsing the extermination of white landowners. The silence from Leftists was deafening—not a word about DEI when it comes to protecting white South Africans. Makes you wonder if their moral compass only points one direction.​


The Market Surge No One Saw Coming

And then there’s the economy. Trump’s visit to Saudi Arabia wasn’t the catastrophe the media predicted. In fact, the stock market rebounded, erasing all losses for the year and surging ahead. Bloomberg even called it “a rally no one is comfortable with.”​

Comfortable? I’m downright cozy. In fact, I predicted it. Trump’s tariff strategy worked exactly as intended—forcing renegotiation of trade deals, revitalizing American manufacturing, and giving our economy a much-needed boost. Yet Leftists insist on cheering against prosperity. It’s like hoping the pilot crashes the plane because you don’t like his haircut.

Remember when Eric “I sleep with Chinese spies” Swalwell’s tweet? 

“Your 401K just became a 201K. And the f’g moron who did that to you is golfing for the weekend in Miami. Let that sink in”

I chuckle when I see these tweets that Democrats wish they could forget ever happened. It’s like they can’t take a strategy to the end, or perhaps they like the public sodomy Trump eventually levels on them.​


Global Diplomacy Through Economic Strength

Trump’s tariff policies not only bolstered American markets but sent a message globally: the U.S. is back in the driver’s seat. And it’s not just rhetoric—Trump’s economic strategy is pulling entire regions out of turmoil.

Just last week, he opened up markets in Congo and Rwanda, committing billions in American investments while negotiating ceasefires in those regions. No more USAID checks funding coups and communist enclaves. Trump’s plan is straight-up capitalism, planting the seeds of economic growth instead of war.​

And it’s working. These emerging markets are diversifying global GDP. Instead of China using American money to build outposts of communism, Trump’s deals are spreading capitalism. It’s like exporting freedom disguised as commerce. American influence, backed by real economic growth, not just military might.​


Black America and the Left’s Legacy of Intervention

This shift in strategy isn’t just global—it’s deeply personal for Black America. Trump understands the damage of intervention because he’s seen it firsthand. While Blacks of the past lived through Democrat hell—oppressed in every walk of life—we built strong, thriving communities. Segregation that Democrats meant for punishment backfired. We built businesses, banks, schools, and entire communities. We didn’t just survive; we thrived.​

But then the interventionists hit. They decided to make Blacks their project, not to improve Black culture but to manage it. Programs like The Negro Project weren’t about uplift; they were about control. Under the guise of “help,” Black communities were funneled into government dependency, erasing decades of self-made progress.​

Trump’s policies flip that narrative. He’s not interested in making Black America dependent—he wants it empowered. By bringing jobs back to the U.S. and cutting bureaucratic red tape, Trump is fueling Black entrepreneurship and dismantling the dependency state the Left has cultivated for decades. The model isn’t government handouts; it’s government getting out of the way.​


Diplomacy Redefined: Trump in Saudi Arabia

When Trump landed in Saudi Arabia, it wasn’t just a diplomatic visit—it was a paradigm shift. The Saudis didn’t just roll out the red carpet; they rolled out the kingdom. Trump’s speech there wasn’t just another political moment—it was historic. For the first time in modern history, Muslims felt genuinely heard. Trump essentially said, “We may not agree with all you do, but we’ll find ways to work together.“​

And it worked. Middle Eastern leaders are starting to rethink their strategies, not because of pressure or military threat, but because Trump is offering something more enticing—commerce over conflict. The ripple effect of this can’t be overstated. Even Dubai, one of the wealthiest cities in the Muslim world, has adopted Western sensibilities. Capitalism and cultural respect are thriving side by side.​


The Bigger Picture: Peace Through Strength

What did you notice most about Trump’s visit to Saudi Arabia?

For me, it was the profound respect he commanded. It wasn’t just diplomatic courtesy; it was genuine admiration. The Saudis recognize strength when they see it. And in President Trump, they saw a leader unafraid to shake the status quo—not just for America, but for the world.​

Trump’s philosophy is simple: Strength through commerce, peace through economic leverage. Instead of blowing nations to pieces, he’s introducing them to prosperity. It’s a radical shift from the endless wars and nation-building that marked past administrations.​


A New World Order, Built on Capitalism and Respect

We are witnessing the redefinition of American influence—not through war, but through economic sovereignty. And the world is taking notice. Trump’s model is forcing countries to compete, innovate, and trade, not war. And in doing so, he’s bringing back something America hasn’t truly felt in decades: global respect.

A Judge of Her Peers? Judge Dugan Assigned a Judge Previously Rebuked for Political Comments

Five years ago, I wrote about a federal judge who, in my view, had discarded any resemblance of judicial restraint and judgment in a public screed against Republicans, Donald Trump, and the Supreme Court. The Wisconsin judge represented the final death of irony: a jurist who failed to see the conflict in lashing out at what he called judicial bias in a political diatribe that would have made MSNBC’s Lawrence O’Donnell blush.

His name is Lynn Adelman.

I was wrong in 2020. Irony is very much alive.

This week, a judge was randomly selected to preside at the trial of Milwaukee County Circuit Judge Hannah Dugan. A critic of Trump’s immigration policies, Dugan is accused of obstructing federal law enforcement and facilitating the escape of an unlawful immigrant.

The judge assigned to the Dugan case? You guessed it. Lynn Adelman, 85.

A judge is expected to come to a case like this one without the burden of his own baggage. Judge Adelman is carrying more baggage than Amtrak in Wisconsin.

The selection of Adelman shows how political commentary by judges undermines the legitimacy of the court system. Now, in a case that has divided the nation, the public will have to rely on a judge who discarded his own obligations as a judge to lash out at conservatives, Trump, and conservative jurists.

Adelman was a long-standing Democratic politician who tried repeatedly and unsuccessfully to run for Congress during his 20-year tenure in the Wisconsin Senate. For critics, Adelman never set aside his political agenda after President Bill Clinton nominated him for the federal bench. Adelman was sharply rebuked for ignoring controlling Supreme Court precedent to rule in favor of a Democratic challenge over voting identification rules just before a critical election.  Adelman blocked the law before the election despite a Supreme Court case issued years earlier in Crawford v. Marion County Election Board, 553 U.S. 181 (2008), rejecting a similar challenge.

The United States Court of Appeals for the Seventh Circuit issued a stinging reversal, explaining to Adelman that in “our hierarchical judicial system, a district court cannot declare a statute unconstitutional just because he thinks (with or without the support of a political scientist) that the dissent was right and the majority wrong.”

Adelman, however, was apparently undeterred. In 2020, he wrote a law review article for Harvard Law & Policy Review, titled “The Roberts Court’s Assault on Democracy.”

Adelman attacked what he described as a “hard-right majority” that is “actively participating in undermining American democracy.” He also struck out at Trump as “an autocrat… disinclined to buck the wealthy individuals and corporations who control his party.”

Adelman was later admonished by the Civility Committee for the Seventh Circuit Court of Appeals for his public political attacks as “inconsistent with a judge’s duty to promote public confidence in the integrity and impartiality of the judiciary and as reflecting adversely on the judge’s impartiality.”

The costs of such extrajudicial commentary became vividly clear this week. Judge Dugan is being called a “hero” by Democratic politicians and pundits for helping an individual evade federal arrest. At least one judge has pledged to do the same in her courtroom. On the other side, many are appalled by Dugan’s conduct as fundamentally at odds with the role of a jurist in either the state or federal system.

There are weighty issues in the case and the public has a right to expect a fair trial with a judge who will not be swayed by his own political viewpoints. Dugan already had the advantage of a trial before a jury taken from one of the most liberal districts in the country. She will now have a judge who was himself sanctioned for political statements and reversed for ignoring controlling precedent.

This problem is growing within our courts, including at the Supreme Court. I recently wrote about public commentary by Justices Sonia Sotomayor and Elena Kagan that created distractions this month in cases before the Supreme Court.  The public has a right to expect more from jurists. The price of the ticket to the bench is to set aside one’s political agenda and political commentary. When you don that robe, you must discard your politics. Some, however, seem to cling to both the bias and the bench.

The message for the public could not be worse this week. In a case involving a Democratic judge accused of discarding basic judicial principles, a random selection produced a Democratic judge reversed for discarding basic judicial principles.

For conservatives, these cases reaffirm a view of a dual-track legal system. Lawfare has been raging in blue cities like New York where President Trump faced judges denounced for their political associations or past commentary. In Washington, Trump was assigned a federal judge who previously appeared to lament that Trump was not a criminal defendant in her courtroom. She was then randomly assigned Trump’s case after he was charged by Special Counsel Jack Smith.

We have the greatest legal system in the world, but it cannot survive long without the faith and support of the public. That is why judicial ethics rules bar not just conflicts of interest but the appearance of a conflict of interest. The perception of political bias robs our courts of their inherent legitimacy and authority for citizens.

Just as Adelman lashed out at most of the Supreme Court as lacking credibility, he can hardly expect conservatives and Republicans to find him a credible choice in the Dugan case. That is why I was wrong five years ago. Irony is not entirely dead. It is just uniformly ignored.

On Sunday it was revealed to the public that President Joe Biden had been diagnosed with a “more aggressive form” of prostate cancer that has metastasized to the bone. Dr. Zeke Emanuel said Monday on MSNBC that it’s more likely Biden “had it while he was president.” That means that on top of the obvious cognitive impairment, Biden may have also been suffering from an aggressive cancer, further calling into question who was actually making key decisions during his administration.

Appointment of Justice Ketanji Brown Jackson

Biden nominated Ketanji Brown Jackson to fill the Supreme Court seat left vacant after Justice Stephen Breyer stepped down in 2022. Prior to taking office, Biden made nominating a black woman to the Supreme Court a top priority, as pointed out by The Federalist’s Jordan Boyd. Jackson had notable shortcomings — including the inability to define what a woman is because she is “not a biologist.”

Pardons And Commutations, Oh My!

Biden gave preemptive pardons to former Rep. Liz Cheney, Dr. Anthony Fauci, Gen. Mark Milley, Adam Schiff and others who sat on the Select Committee to Investigate the January 6th Attack on the United States Capitol as well as to the “police officers from the D.C. Metropolitan Police Department or the U.S. Capitol Police who testified before” the committee, according to The Lawfare Institute.

Biden also issued pardons to his brother, James Biden, James’ wife Sara, his other brother Francis T. Biden, and his sister Valerie T. Owens along with her husband John T. Owens.

As noted by The Federalist’s Beth Brelje, “To be pardoned for a crime, there must be a crime. None of the people on this list have been charged for the awful ways they harmed people in their official capacities.”

Biden also announced in December that he was granting 39 pardons and 1,499 commutations in what his administration described as the “largest single-day grant of clemency in modern history.”

Weeks before that set of pardons and commutations, Biden quietly commuted the sentences of two Chinese spies. In one case, Yanjun Xu was convicted in 2022 for “conspiracy to commit economic espionage; conspiracy to commit trade secret theft; attempted economic espionage by theft or fraud; attempted theft of trade secrets by taking or deception.”

But Biden’s commutation said “it is in the national interest that the term of imprisonment related to the aforesaid conviction not be served in its entirety.”

The Deadly Afghanistan Withdrawal

On August 26,2021, thirteen U.S. service members were killed during what has now become known as the botched Afghanistan withdrawal. The same withdrawal also left thousands of Americans, U.S. allies and their families stranded. A report from the State Department later confirmed that Biden’s execution of the withdrawal “posed significant challenges for the Department.”

Biden rushed the withdrawal which “compounded the difficulties the Department faced in mitigating the loss of the military’s key enablers,” the report found. Biden’s lack of planning “had serious consequences for the viability of the Afghan government and its security.”

Notably, Biden also left billions of dollars of U.S. military equipment behind for U.S. enemies to use while allowing hundreds of Afghans on the Pentagon’s watchlist to enter the U.S. without proper vetting.

Open Borders

Biden allowed millions of illegal aliens to flood the country — and made it easier for them to do so. As explained by Tristan Justice in these pages, Biden stopped construction of the border wall, “expanded the ‘illegal’ Deferred Action for Childhood Arrivals (DACA) program,” reversed “Trump-era executive orders that enforced immigration law,” issued a deportation moratorium, lost track of thousands of children illegally in the country, resurrected an Obama-era parole program for illegals and more.

Despite the urgent need for border security, Biden falsely claimed he lacked the authority to secure the border and said he had “done all I can do.”

As The Federalist’s John Daniel Davidson pointed out, “A secure border was always within reach” during the Biden years but “Biden and the Democrats sold out their fellow Americans, threw open the borders, and then pretended they had no choice in the matter.”

COVID

Biden issued an announcement about a purported vaccine mandate for private companies employing 100 people or more just months after taking office. Biden also, as reported by Boyd, encouraged businesses “to adopt vaccine mandated and plotted a vaccine passport program that would deny Americans work or access to society based on their Covid-19 vaccination status.” The Biden administration also required all federal employees and contractors to get the vaccine or lose their jobs.

In a bold and unapologetic move, Republican Congresswoman Nancy Mace took a stand against privacy violations and sexual exploitation during a House Oversight Subcommittee hearing on “surveillance in private spaces.” Mace displayed a nude image of herself—allegedly taken without her consent by her ex-fiancé, Patrick Bryant—to highlight the dangers of covert recording and the lack of legal protections for victims.

Mace, a fierce advocate for women’s rights and a survivor of sexual assault, did not hold back in her condemnation of Bryant’s alleged actions. “Today I will show my naked body on one of the videos predator and rapist Patrick Bryant took of me and many other women. Without our knowledge. Without our permission. And without our consent,” she declared in a pre-hearing post on X. During the hearing, she reinforced her claims, stating Bryant had recorded nude women and even filmed “rape,” calling his behavior “creepy” and “criminal.”

Bryant, however, vehemently denied the accusations, telling Fits News“I categorically deny the false and outrageous claims made by Nancy Mace. I have never raped anyone. I have never hidden cameras. I have never harmed any woman. These accusations are not just false. They are malicious and deeply personal. My mistake was loving and trusting someone who later weaponized our relationship.”

Despite Bryant’s denials, Mace’s decision to publicly confront her alleged abuser underscores the urgent need for stronger federal and state laws to protect victims of non-consensual recording and sexual exploitation. “Today I exposed a monster whose victims deserve justice,” she asserted. “The victims also deserve stronger federal and state laws to protect them.”

While Mace’s courage should be applauded, the liberal media has largely downplayed the significance of her testimony, instead focusing on trivial political narratives. This is yet another example of the mainstream press ignoring real issues that affect women while pushing their own agenda. Where is the outrage from the so-called “feminist” left? Where are the headlines demanding justice for Mace and other victims?

In stark contrast to the left’s silence, President Donald Trump has consistently championed law and order, advocating for stronger protections against sexual predators and standing with survivors. His administration prioritized justice for victims, unlike the current weak-on-crime policies that allow predators to operate with impunity.

The Committee on Ways and Means, Committee on Energy and Commerce, and Committee on Agriculture are set to meet this week for markups on the reconciliation bill.
Most notably, on the table before the Ways and Means committee is a 389-page measure, which includes an expansion of the 2017 Trump tax cuts, including no tax on tips, no tax on Social Security, and no tax on overtime.

Comey’s Recent Behavior Confirms He’s Our Worst FBI Director

James B. Comey posted on Instagram a photo of seashells arranged to read “86 47,” which could be interpreted as a threat against the 47th president. Comey has since denied that he intended violence; nonetheless the Secret Service is reportedly investigating. This posting may have been a lapse of judgment on Comey’s part or something more nefarious.

Comey’s conduct in this instance, however, fits well with his previous anti-Trump behavior and demonstrably poor judgment. His judgment has been a serious concern for many of us who were proud to serve in the FBI and care about the bureau’s credibility and reputation. In his book and elsewhere, he described the sole origin of the FBI’s counterintelligence investigation of Trump’s first presidential campaign as based on a report “from an allied ambassador” of an encounter in London between a Trump adviser and “a Russian agent.”

That’s Comey’s characterization of George Papadopoulos’ meeting with Joseph Mifsud, a pan-European academic. Mifsud told the then-Trump aide the Russians had “dirt” on Hillary Clinton. Comey has piously huffed that it would have been “dereliction” not to proceed with a counterintelligence investigation based on that report. But to proceed with such an intrusive investigation on so little was an abuse.

A secondhand rumor should never be enough to justify opening a counterintelligence investigation of any American, much less a presidential candidate. This off-handed conversation initiated a counterintelligence case that disrupted Trump’s first term as president. Like directors before him, Comey should have said, “We need more probable cause” before moving forward with an investigation.

In the encounter Comey cited, there was no mention of emails. Only after the WikiLeaks disclosures was an assumption made by both Australian High Commissioner Alexander Downer, Comey’s “allied ambassador,” and Papadopoulos, that the “dirt” was in Hillary’s emails.

Comey’s indignant complaints about Trump are an effort to distract from the dangerous and faulty decisions made on his watch. His initiation of the counterintelligence investigation against Trump was an error of historical proportions.

Comey has tried to justify the spying — electronic surveillance — of Carter Page, a U.S. citizen, by writing that a federal judge granted “permission.” We now know the FISA Court was seriously misled by Comey’s FBI.

Comey grossly usurped the prosecutor’s role in virtually declining prosecution in the Clinton email investigation. That usurpation was spelled out in Deputy AG Rod Rosenstein’s memo justifying Comey’s firing. Comey also had further muddied the waters by announcing the reopening of the Clinton email investigation just days before the 2016 election.

Comey tried to deflect from his responsibility in the Russian collusion fiasco by claiming it all happened “seven layers below” him. That is simply not true. The deputy assistant director for counterintelligence, Peter Strzok, drafted and signed out the communication initiating that probe. Strzok’s texts demonstrate he answered to Andrew McCabe, who was deputy director and Comey’s direct report. It was McCabe who set up the interview to entrap General Michael Flynn, and it was Strzok who conducted the interview. These people were not seven layers down from Comey. They were his inner circle, mere steps away from him on the seventh floor of the J. Edgar Hoover Building.

It was Comey himself who wrote a memo of his initial conversation with President-elect Trump and then leaked it. He, and only he, did that. What was he thinking? Here was the FBI director trying to incriminate the president.

Throwing everyone else under the bus, Comey claimed that FBI procedures failed him. But it was Comey who signed three of the four applications for FISA coverage on Carter Page. And it was Comey who set the tone by declining to brief the Congressional Gang of Eight about this significant counterintelligence investigation. When Comey served as FBI director, he led the investigation of one or more American citizens without sufficient basis. The lack of justification for initiating these investigations is what truly matters.

The former FBI director may or may not be charged for this seashell threat on the president’s life, but James Comey will be condemned by history as the worst FBI director for the damage he has done to the FBI and our country.

The Red Line: Democratic Officials Claim a Dangerous License for Illegality

Across the country, a new defense is being heard in state and federal courtrooms. From Democratic members of Congress to judges to city council members, officials claim that their official duties include obstructing the official functions of the federal government. It is a type of liberal license that excuses most any crime in the name of combating what Minn. Gov. Tim Walz called the “modern-day Gestapo” of the Immigration and Customs Enforcement (ICE).

The latest claimant of this license is Rep. LaMonica McIver (D-NJ), who was charged with assaulting, resisting, and impeding law enforcement officers during a protest at Delaney Hall ICE detention facility in Newark, New Jersey. McIver is shown on video forcing her way into an ICE facility and striking and shoving agents in her path.

This was not a major incursion, but these state and federal officials joined a mob in briefly overwhelming security and breaching the fence barrier after a bus was allowed through the entrance. Federal officials were able to quickly force back the incursion.

McIver and House Democrats insisted that McIver’s forcing her way into the facility might be trespass and assault for other citizens, but she was merely exercising “legislative oversight.” Rep. Alexandria Ocacio-Cortez (D., N.Y.) declared “You lay a finger on someone – on Bonnie Watson Coleman or any of the representatives that were there – you lay a finger on them, we’re going to have a problem.”

Rep. Eric Swallwell (D., Cal.) promised more such actions: “I promise you there’s gonna be more un-noticed visits by my colleagues where they show up and they better be let in.”

Minority Leader Hakeem Jeffries (D., N.Y.) even ominously warned the federal government that Democrats would bring down the house if it tried to charge McIver: “It’s a red line. They know better than to go down that road.”

Well, the red line was crossed in a big way after Acting U.S. Attorney for the District of New Jersey Alina Habba charged McIver with a felony under Title 18, United States Code, Section 111(a)(1). The ACLU called the charge “authoritarianism” and insisted that these state and federal politicians “have every right to exercise their legally authorized oversight responsibilities for expanded immigration detention in New Jersey.”

The problem with the oversight claim is that McIver’s status as a member of Congress does not allow her access into closed federal facilities. Congress can subpoena the Executive Branch or secure court orders for access. However, members do not have immunity from criminal laws in unilaterally forcing their way into any federal office or agency. If that were the case, Rep. Alexandria Ocacio-Cortez would not have posted images of herself crying at the fence of an immigrant facility, she could have climbed over the fence in the name of oversight.

Conversely, Republicans in the Biden Administration could have simply pushed their way into the Justice Department to seek the files on the influence-peddling scandal.

Yet, the point of the claim is less of a real criminal defense and more of a political excuse.

It is the same claim being heard this week from Worcester City Councilor Etel Haxhiaj who was shown in a video shoving and obstructing ICE officers attempting to arrest a woman on immigration charges. Two other individuals (including a Democratic candidate for a school board) were arrested, but not Haxhiaj who claimed that she was merely protecting “a constituent.” After the melee, the city manager issued an order preventing city police from assisting in any way in the carrying out of such civil immigration enforcement efforts by the federal government.

Even judges are claiming the same license. In Wisconsin, Judge Hannah Dugan has been charged with obstructing a federal arrest of an illegal immigrant who appeared in her courtroom. Dugan heard about agents waiting outside in the hallway to arrest the man and went outside to confront the agents. She told them to speak to the Chief Judge and that they needed a different warrant. The agents complied and the Chief Judge confirmed that they could conduct the arrest. In the interim, however, Dugan led the man out a non-public door and facilitated his escape (he was arrested after a chase down a public street).

Judge Duggan also claimed that she was carrying out her duties even though her hearing was over, the charges were not part of state matter, and the arrest was being carried out outside of her courtroom. She was declared “a hero” by Democratic politicians and pundits.

As Democratic leaders like Walz engage in rage rhetoric and paint Republicans (and federal law enforcement) as Nazis, political violence is on the rise across the country. Many of the people burning Teslas and engaging in such crimes claim the same type of license that the ends justify the means. That includes affluent professionals who are now shoplifting from Whole Foods as a “protest” against Jeff Bezos meeting with Trump.

When the Administration sought to investigate those burning Teslas and dealerships, Rep. Dan Goldman (D., N.Y.) denounced it as a “political weaponization” of the legal system. The comments suggest that such arson is somehow a form of political expression on the left.

House Minority Leader Jeffries was correct that a “red line” was crossed but not the one that he was thinking of in threatening consequences for any charges. The red line is the one separating political expression and criminal conduct.

Border Czar stressed repeatedly to political leaders that they can protest and refuse to help but “you can‘t cross the line” into obstruction and interference with their operations.

If oversight means that members can force their way into any federal facilities, we would have 535 roaming inspectors general who could wander at will through the executive branch.

Rep. McIver would be better to claim a different type of oversight, in allowing her passion to briefly overwhelm her judgment in rushing into the facility.

In the end, however, McIver and Duggan may have a license of a different kind.

Both have the advantage of being charged in liberal districts where they would appear before sympathetic jurors.  They need to just convince a single jury to engage in “jury nullification,” to vote based on the cause, not the crime, in the case.

Donald Trump and House Republicans have been hard at work crafting a bill that aligns with many of the former president’s priorities. They’ve faced plenty of hurdles along the way, with negotiations proving to be quite challenging. On Sunday night, however, the bill passed a critical House vote, giving it a new lease on life.

The vote was quite close, following a disruption caused by four conservative members of the House. These lawmakers had thrown a wrench in the works on Friday morning, but by Sunday night, the bill managed to clear the House Budget Committee. Speaker Mike Johnson of Louisiana made an unexpected appearance just before the vote, expressing optimism that the night would end on a positive note.

The bill passed the committee with a vote of 17 to 16, with four Republicans opting to vote “present.” This move allowed the bill to advance, but it still faces further negotiation. The four conservatives who had issues with the bill’s details were Reps. Chip Roy, Ralph Norman, Josh Brecheen, and Andrew Clyde. They did not block the bill’s progress on Sunday night, however.

Their “present” votes were part of a strategy to keep discussions moving forward. As the bill advances through the House Budget Committee, it remains largely a procedural step. Lawmakers have indicated that changes will likely be introduced as amendments when the bill reaches the House Rules Committee.

Interestingly, two of the fiscal hawks on the Budget Committee, Reps. Chip Roy and Ralph Norman, also serve on the Rules Committee. Norman expressed enthusiasm about the bill’s progress, stating, “In an effort to move this bill forward, I’m excited about the changes we’ve made. And I will vote present.”

Trump’s vision for the bill includes enacting his campaign promises, focusing on tax cuts, immigration, energy, defense, and addressing the debt limit. While there’s still work to be done, Sunday night marked a significant win for Johnson. House Republicans are working tirelessly to pass what they call the One Big Beautiful Bill Act.

This legislation represents what some see as a once-in-a-generation chance to provide tangible relief for Americans. The proposed changes include historic tax relief, significant investments in border security, and substantial spending cuts. Additionally, the bill aims to restore American energy dominance and strengthen Medicaid and SNAP for those who need them.

Data released Tuesday shows that egg prices dropped 12.7 percent last month — the “biggest monthly decline since 1984.” The report follows weeks of President Donald Trump telling Americans that egg prices were falling — welcome news after the cost of eggs rose for 17 out of the past 19 months, according to CNN. But the left-wing legacy outlet is scrambling to process the eggcellent news.

CNN’s David Goldman wrote Tuesday that “For months, President Donald Trump has falsely claimed that egg prices are tumbling. It wasn’t true then, but it’s true now.”

“Despite Agriculture Secretary Brooke Rollins’ far more conservative estimate that egg prices would normalize in the summer, Trump last month said, ‘as you know, the cost of eggs has come down like 93, 94% since we took office.’ Those percentage declines Trump stated are not close to accurate – but we now know that consumer egg prices were, indeed, falling sharply when Trump made those remarks (the Consumer Price Index data wasn’t out yet to confirm or deny Trump’s claims).”

CNN admits egg prices “were, indeed, falling sharply when Trump made those remarks,” but a few sentences later bizarrely still claims the “timing of his claim” was wrong.

Translation: Trump said something that turned out to be true (egg prices fell), but because we didn’t have the same data at the exact moment Trump said it, he was wrong.

That’s one of the propaganda press’ favorite things to do: dismiss or discredit the truth but then claim credit for discovering it themselves later and grant permission to everyone else to acknowledge it. Goldman’s piece is hardly an outlier. It’s the norm. Take the propaganda press’ coverage of Joe Biden’s cognitive decline. CNN’s Jake Tapper and Axios’ Alex Thompson are awaiting the release of their new book Original Sin: President Biden’s Decline, Its Cover-Up, and His Disastrous Choice to Run Again, which details Biden’s decline over four years. The excerpts released thus far read more like a confessional of sins long known to anyone with a set of eyes and ears.

But the book and discussions amongst the left are all happening well after Tapper and the legacy media themselves engaged in the cover-up. The media decided that Biden wasn’t cognitively declining and essentially painted anyone who questioned the narrative as a far-right “conspiracy theorist” not acting “in good faith.”

The examples are endless. But now that Tapper, Thompson, and the rest of them can make a few bucks off telling the truth, they’re willing to do it.

Or take the coverage of masks during Covid. The New York Times’ Zach Montague said in September 2020 it was a “dangerous assertion” to state that wearing masks during the pandemic had “little to no medical value.” Fast forward just over two years when Bret Stephens, writing for The Times, declared, “The Mask Mandates Did Nothing. Will Any Lessons Be Learned?” Stephens highlighted a report that found there was “no evidence” masks made “any difference.”

To be clear, it was a “dangerous assertion” to say masks did nothing until the propaganda press decided it was okay to make that same assertion. As the Federalist’s Elle Purnell wrote, outlets like the New York Times “played a significant role in defending the officially sanctioned [Covid] narrative” and “chok[ed] dissent.”

And then, of course, there’s the alternative — where something is true until the media says it no longer is, like the case of the propaganda press running cover for Kamala Harris’ devastating management of the border as vice president. 

As The Federalist’s Jordan Boyd wrote last year, “Years after acknowledging and even praising President Joe Biden for naming Vice President Kamala Harris ‘border czar,’ corporate media claimed the presumptive 2024 Democrat nominee was never charged with overseeing the logistics of the record-breaking invasion.”

In each case, one pattern remains the same: The truth never changed, only the media’s willingness to acknowledge it. Whether it’s egg prices, Biden’s cognitive decline, mask mandates, or who was in charge of the southern border, the facts don’t seem to matter to the propaganda press.

US attorney for Massachusetts says interference with ICE operations is ‘disturbing,’ threatens arrests

The top federal prosecutor in Massachusetts is threatening arrests for those who obstruct Immigration and Customs Enforcement (ICE) operations, calling recent interference in her state “disturbing.” 

The warning from Leah Foley, the U.S. attorney for the District of Massachusetts, comes days after a tense video emerged of a crowd reacting to an ICE operation in Worcester. 

“The interference with ICE operations around Massachusetts has been disturbing, to say the least. This conduct poses significant public and officer safety risks. It is conduct that should be vilified rather than glorified,” Foley said in a statement. 

“I will not stand idly by if any public official, public safety officer, organization or private citizen acts in a manner that criminally obstructs or impedes ICE operations. The United States Attorney’s Office, along with our federal partners, will investigate any violations of federal law and pursue charges that are warranted by such activity,” she added.

Footage captured last week showed the ICE arrest in Worcester being disrupted by a crowd of about 25 people in what police said was a “chaotic incident.” 

“District Councilor for the City of Worcester [Etel] Haxhiaj pulled a political stunt and incited chaos by trying to obstruct law enforcement. ICE officers and local police regained control of the situation and ICE arrested Ferreira de Oliveira,” said Tricia McLaughlin, Department of Homeland Security (DHS) assistant secretary. “The previous administration’s open border policies allowed this criminal to illegally enter our country in August of 2022. Thanks to President Trump and Secretary Noem this criminal is off our streets.”

DHS went on to describe Oliveira as a “violent criminal alien.” The agency said she was arrested by local police for assault and battery with a dangerous weapon and assault and battery on a pregnant woman. 

The video showed a group of residents chanting “Don’t take the mother!” and “No warrant!” after a woman was led into an SUV by uniformed ICE and U.S. Customs and Border Protection agents. Before the vehicle can pull away, other women are seen placing their hands on the front hood of an SUV and screaming in protest.

At one point, a CBP agent and a bystander started shoving each other as he tried to move her away from the SUV. The vehicle eventually left the area after the Worcester Police Department arrived and declared the scene an unlawful assembly, threatening arrests.

How Trump Energy Department is Clawing Back $15 Billion from Biden ‘Green New Scam’

The Biden administration issued billions in taxpayer-funded green grants–many to large multinational corporations. Now the Trump administration’s Energy Secretary Christopher Wright ordered a review of 179 recipients to save $15 billion.

Meanwhile, some recipients of the Biden-era green grants told The Daily Signal they plan to proceed with the projects. 

One of the biggest sources of green grants under the Biden administration was the Energy Department’s Industrial Demonstrations Program. The program was slated to dole out $6.3 billion to 29 taxpayer-funded projects. Projects listed include spending up to $331.9 million for an ExxonMobil project in Texas; up to $375 million for an Eastman Chemical decarbonization project in Texas; up to $95 million to the Dow Chemical project on the Gulf Coast; and up to $75 million to a BASF project in Texas. 

“What we can share is that, as of October 2024, BASF has entered into a cooperative agreement with the DOE for our proposed low-carbon syngas project at our Freeport, Texas site,” Julia Arns, external communications manager for BASF, told The Daily Signal. “With this, we have started Phase 1 of our project: initial planning and analysis. Throughout the entire process BASF will collaborate with the DOE to develop the appropriate deliverables necessary to progress to the following phases.”

Notably on the list, a $500 million subsidy for a project in Vice President J.D. Vance’s Ohio hometown. The Cleveland Cliffs company announced in March 2024 that it would get about $575 million in federal funding for two projects, a $500 million grant for a project in Middletown, Ohio, and another $75 million  grant for a Lyndora, Pennsylvania project. Both projects were canceled, CNN first reported. However, a spokesperson from Cleveland Cliff did not respond to inquiries on voicemail and online for this story. 

Orsted, a Denmark-based energy company, is on the list to get an Energy Department grant of up to $99 million for a Texas Gulf Coast project that involves capturing carbon dioxide to reduce emissions from sectors such as shipping.

“The DOE award is proceeding to schedule as we continue to develop the project,” Jakob Goetzsche Vesterager, senior media relations advisor for Orsted, told The Daily Signal in a statement. “We’re aware that the program is currently under review, but there have been no changes to the award for Project Star at this time.”

The energy secretary’s memorandum said the department will require recipients of money to “provide written responses and supporting documentation to its information requests within communicated timeframes, and to cooperate with program personnel on any follow up requests, including verbal requests, in a timely manner, to facilitate this review.” 

Most of the grants were funded through the Infrastructure Investment and Jobs Act and the Inflation Reduction Act, two major bills passed during the Biden administration. The Industrial Demonstrations Program itself was established in 2020 to boost manufacturing during the last year of the first Trump administration. 

“The Biden administration spent money we didn’t have to pay for things we didn’t need,” James Carter, a former deputy assistant secretary of treasury and former deputy undersecretary of labor in the George W. Bush administration, told The Daily Signal.  

Regarding the administration cutting an expensive project in the vice president’s home turf, Carter said the administration has shown leadership in putting the national interest ahead of parochial or short-term political interest. 

“There are exceptions, but anything enacted during the Biden administration has a bullseye on it,” Carter told The Daily Signal. 

The energy secretary’s memo Thursday, titled “Ensuring Responsibility for Financial Assistance,” comes after the White House budget proposal called for cancelling $15 billion in what it calls “Green New Scam” funds. 

“Over the past 110 days, the Energy Department has been hard at work reviewing the billions of dollars that were rushed out the door, particularly in the final days of the Biden administration, and what we have found is concerning,” Wright said in a public statement

“With this process, the department will ensure we are doing our due diligence, utilizing taxpayer dollars to generate the largest possible benefit to the American people and safeguarding our national security,” Wright continued. “Any reputable business would have a process in place for evaluating spending and investments before money goes out the door, and the American people deserve no less from their federal government.”

This year, Cleveland Cliffs–the firm slated to get $500 million for a project in the vice president’s hometown, reportedly laid off 1,200 workers in Minnesota and Michigan, and was reportedly set to layoff another 950 employees in Illinois and Pennsylvania. Job losses shouldn’t be blamed on canceled government subsidies, said Vance Ginn, a former associate director for economic policy for the U.S. Office of Management and Budget during the first Trump administration. 

“These jobs from government subsidies are temporary jobs,” Ginn, now a senior economic fellow with the Pelican Institute, a Louisiana think tank, told The Daily Signal. “During the Biden years, and the Inflation Reduction Act, we saw this green new scheme grow and grow.”

Government subsidies don’t have the strongest track record. 

  • A 2016 Energy Information Administration report said more than 70% of energy-related physical science grants went to solar energy research. 
  • Meanwhile, 29 states require utilities to generate or obtain specific amounts of electricity from renewable energy sources, according to Just Facts, a conservative-leaning fact checking organization.

Still, despite heavy subsidies since 1978, wind supplied about 3.9% of U.S. energy in 2024, while solar provided 2.7%, according to Just Facts, citing the U.S. Energy Information Administration, Office of Energy statistics from March.

“A Modest Request”: The Supreme Court Hears Challenge to National or Universal Injunctions

Today, the United States Supreme Court will hear three consolidated cases in Trump v. CASA on the growing use of national or universal injunctions. This is a matter submitted on the “shadow docket” and the underlying cases concern the controversy over “birthright citizenship.” However, the merits of those claims are not at issue. Instead, the Trump Administration has made a “modest request” for the Court to limit the scope of lower-court injunctions to their immediate districts and parties, challenging the right of such courts to bind an Administration across the nation.

The case is the consolidation of three matters: Trump v. CASA out of  Maryland; Trump v. Washington out of Washington State, and Trump v. New Jersey, out of Massachusetts. These cases also present standing issues since the Administration challenges the argument that there is a cognizable “injury” to individuals who may travel to the states bringing the actions.

However, the main question is the scope of injunctions.

As I have previously written, district court judges have issued a record number of injunctions in the first 100 days of the Trump Administration. Under President George W. Bush, there were only six such injunctions, which increased to 12 under Obama. However, when Trump came to office, he faced 64 such orders in his first term.

When Biden and the Democrats returned to office, it fell back to 14. That was not due to more modest measures. Biden did precisely what Trump did in seeking to negate virtually all of his predecessors’ orders and then seek sweeping new legal reforms. He was repeatedly found to have violated the Constitution, but there was no torrent of preliminary injunctions at the start of his term.

Yet, when Trump returned to office, the number of national injunctions soared again in the first 100 days and surpassed the number for the entirety of Biden’s term.

This is a rare argument. First, it is a shadow docket filing that usually results in summary decisions without oral argument. Moreover, this matter came after what is commonly viewed as the final day for oral arguments. The Court granted a rare late oral argument, reflecting that multiple justices view this matter sufficiently serious to warrant a break from standard operating procedures.

Rather than arguing a “question presented” on birthright citizenship, the Administration is solely looking for limits on the district courts as appeals continue on the “important constitutional questions” raised by birthright citizenship.

The Administration argues that the Constitution does not give judges the power to issue universal injunctions and that courts are limited to addressing the cases before them in a given district. The Administration acknowledges that class actions can create the basis for universal injunctions, offering a moderate resolution to the Court. In such cases, if the parties can meet the standard for a national class, they can seek a national or universal injunction.

In today’s arguments (which I will be covering for Fox and on X), we can expect to hear from justices who have previously been critical of universal injunctions, including Justice Clarence Thomas, who, in his concurring opinion in Trump v. Hawaii, called them “legally and historically dubious.”

Likewise, Justices Gorsuch and Alito have criticized such injunctions. In a prior dissent to an emergency filing in Department of State v. AIDS Vaccine Advocacy Coalition, Alito was joined by Thomas, Gorsuch, and Kavanaugh in stating that the government “has a strong argument that the District Court’s order violates the principle that a federal court may not issue an equitable remedy that is ‘more burdensome than necessary to’ redress the plaintiff’s injuries.”

Many of us will be watching three members the most closely: Chief Justice John Roberts and Associate Justices Elena Kagan and Amy Coney Barrett. Roberts is the ultimate institutionalist, and we should see in his argument how he views the impact of such injunctions on the court system as a whole. He is very protective of the courts’ inherent authority but may also have misgivings about the scope of these orders.

During the Biden Administration, Justice Kagan has previously criticized universal injunctions. In an interview at Northwestern University Law School, Kagan flagged the “forum shopping” by litigants in filing cases before favorable courts:

“You look at something like that and you think, that can’t be right. In the Trump years, people used to go to the Northern District of California, and in the Biden years, they go to Texas. It just can’t be right that one district judge can stop a nationwide policy in its tracks and leave it stopped for the years that it takes to go through the normal process.”

Justice Barrett previously joined with Kavanaugh in stating that the power of district courts to enter a universal injunction “is an important question that could warrant our review in the future.”

U.S. Solicitor General D. John Sauer will argue the government’s case.

Jeremy Feigenbaum, New Jersey’s solicitor general, will argue for the state and local governments and  Kelsi Corkran, the Supreme Court director at Georgetown’s Institute for Constitutional Advocacy and Protection, will argue for the private individuals and groups.
