Kentucky Court Clerk Kim Davis is getting some national support from former Arkansas governor and presidential candidate Mike Huckabee. Huckabee is holding a rally to protest Davis’ imprisonment on a contempt charge. The rally, called the “I’m With Kim Liberty Rally” will be held in Kentucky on Sept. 8.

“What a world, where Hillary Clinton isn’t in jail but Kim Davis is,” Huckabee said after the clerk was taken into federal custody on Sept. 3.

U.S. District Court Judge David Bunning held Davis, who is the Rowan County court clerk, in contempt for refusing to cp 11issue same-sex marriage licenses after Kentucky Gov. Steve Beshear issued a mandate to issue the licenses. Davis is represented by Liberty Counsel in the case. Mat Saver, founder and chairman of the law group known for addressing religious discrimination issues, will join Huckabee at the rally.

“This is a reckless, appalling, out-of-control decision that undermines the Constitution of the United States and our fundamental right to religious liberty. Having Kim Davis in federal custody removes all doubt of the criminalization of Christianity in our country. We must defend religious liberty and never surrender to judicial tyranny,” Huckabee said.Tyranney Alert

want_rel_liberty_rHuckabee isn’t the only presidential candidate to support Davis. Kentucky Sen. Rand Paul said putting the clerk in jail wasn’t a good idea. “I think it’s absurd to put someone in jail for exercising their religious liberty,” Paul said in an interview after the decision. “I think it’s a real mistake and even those on the other side of the issue, I think it sets their movement back.” Paul said the jailing will harden people’s opinions on same-sex marriage and will encourage local courts across the country to “opt out” of issuing licenses altogether.

Other candidates, including Louisiana Gov. Bobby Jindal and Wisconsin Gov. Scott Walker, said the federal judge went too far. “We are seeing government today discriminate against whether it’s clerks, florists, musicians or others. I think that’s wrong. I think you should be able to keep your job and follow your conscience,” Jindal said.

Walker said religious freedom is a fundamental right. “I read that the Constitution is very clear that people have freedom of religion — you have the freedom to practice religious beliefs out there, it’s a fundamental right,” the Wisconsin governor said.Picture1

CombinedHuckabee said the sticking point in the case is that Davis actually didn’t break any laws. The United States Supreme Court did not make a law when justices issued their same-sex marriage ruling earlier this summer; they simply ruled on the constitutionality of bans states had in place, according to Huckabee. Only Congress can actually make a law, he said. The Kentucky legislature, likewise, has not created a law allowing for same-sex marriage.

Huckabee said that the U.S. Supreme Court had no legal precedent when it ruled on the case, and that their ruling is not backed up by the Constitution. The presidential candidate tweeted that if the refusal to implement federal law should be punished with jail time, there are others across the country who should face the same fate.

“#KimDavis in jail for not issuing same-sex wedding licenses. Why aren’t San Fran officials in jail for ignoring immigration law?” Huckabee said in the tweet.

Texas Clerk Refuses to Issue Same-Sex Marriage Licenses

Freedom is never free

A Texas clerk refused to issue licenses for same-sex “marriage,” and Liberty Counsel has come to the defense of this clerk.

Mat Staver: Matt, this is in Texas, it’s Irion County, and that particular location is the place for a clerk, by the name of Molly Criner, who has issued a statement regarding marriage and the fact that she says she will uphold the Constitution, and therefore must reject the ruling that is lawless.

This is what her statement says in part, “To keep my oath to protect the Constitution I must reject this ruling that I believe is lawless. I have to stand for the Constitution and the rule of law.”

Matt Barber: She is setting an example for millions, frankly, of other American citizens, for clerks, for judges, for attorneys, for teachers…on and on it goes. And what we’re talking about here is the rule of law.

She said, “The justices of the Supreme Court acted outside and against the authority granted to them by the very Constitution that we have sworn to uphold.”

So what she is saying here, Molly Criner, she’s saying I’m going to obey the Constitution and uphold my duty, sworn duty to the Constitution, and I am going to ignore this unconstitutional, lawless decision by these five unelected, unaccountable, justices of the U.S. Supreme Court.Picture3

Clerk employees quit rather than issue gay marriage licenses

Clerk Gwen Pope and employees Sharon Bell and Mickey Butler all said they were resigning because the Supreme Court’s decision to allow same-sex marriages clashed with their religious beliefs. Their last day will be July 14. Currently, Decatur County’s clerk office will not issue a same-sex license, the employees said.

According to Drew Baker, area representative for the Tennessee Equality Project, Decatur County is the only county in the state that has said it won’t issue same-sex licenses. As of Thursday there have been no requests for a same-sex license in the county.

Pope said the decision to step down wasn’t made to make news.

“It’s kind of sort of like you don’t want to draw attention to yourself for any reason,” Pope said. “That’s not why we’re doing this. Not doing it in any way to draw attention to us. It’s for the glory of God. He’s going to get all the glory.”AMEN

All three will be looking for new jobs. There was no backup plan, they said.

Pope has worked on and off in the office since 1994 and has been the clerk since 2008. Butler has worked in the office since 2002 and Bell has been there since 2009.

Pope said God will provide. “I honestly believe God will take care of us,” she said.

Scott King is a resident of Decatur County, and he came by the office to thank the women for their faith. “These three ladies stood upon their beliefs and they stood upon their morals and no one can fault them,” King said. “Too often we as Christians don’t do that. It’s time we followed the lead of what they showed us.”

Kathy Parrish agreed, and she applauded the women’s bravery. She lives in Perry County, but works in Decaturville.

“It (same-sex marriage) is wrong because it goes against the Bible and everything God intended for it to be,” Parrish said. “That wasn’t God’s plan. God’s plan was for men to be with women and women to be with men.”

Baker said he would rather see the women step down than deny people their rights. “That’s unfortunate,” Baker said. “That’s also against the law. They’re opening themselves up to litigation. However, I admire them for the strength of their convictions.”

Carlton Sanders owns a car wash business across the street from the courthouse, and he agreed with Baker. Sanders said he is a Christian, but he doesn’t believe people should discriminate.

“If they were elected, and it’s the law and they don’t want to do what the law says of course you should step down,” Sanders said. “Hey, they decided it. It went to the top. We go by a justice system and that’s how it is.”
